A RESOLUTION APPROVING AN INTERGOVERNMENTAL
AGREEMENT BETWEEN PUEBLO, A MUNICIPAL
CORPORATION, PUEBLO CONSERVANCY DISTRICT,
COUNTY OF PUEBLO, AND THE BOARD OF WATER
WORKS OF PUEBLO, COLORADO RELATING TO THE
HISTORIC ARKANSAS RIVERWALK PROJECT AND
AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL
TO EXECUTE SAME.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The HARP Intergovernmental Agreement between Pueblo, a Municipal Corporation, Pueblo
Conservancy District, County of Pueblo, and Board of Water Works of Pueblo, Colorado (the
"Agreement ") a copy of which is attached hereto and incorporated herein, having been approved
as to form by the City Attorney, is hereby approved. The President of the City Council is
authorized to execute the Agreement in the name of the City.
SECTION 2.
City Council does hereby request that the Participants to the Agreement meet and confer
with respect to specific obligations to be undertaken by each party in furtherance of HARP,
including without limitation, financial and maintenance obligations, and that such meetings and
negotiations commence by December 15, 1995 and be completed on or before March 1, 1996.

HARP INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT is entered into as of the day and year set forth below by and among
Pueblo Conservancy District, Pueblo, a Municipal Corporation, the County of Pueblo, and the Board
of Water Works of Pueblo, Colorado, hereinafter collectively called the "Participants ".
WHEREAS, the Historic Arkansas Riverwalk Project (HARP) consists of a joint effort
among various governmental entities and private enterprises for the purpose of reestablishing the
Arkansas River as it originally flowed before the 1921 flood; and
WHEREAS, it is the overall intent of the HARP to create within the City of Pueblo, a
recreational and commercial area for the enhancement of the Downtown/Union Avenue area, the
promotion of its recreational use, and the development of potential commercial utilization of the
area; and
WHEREAS, the Participants recognize that the HARP will be accomplished only with the
mutual cooperation and support of the Participants as well as others in the community.
NOW THEREFORE and in consideration of the following mutual covenants and conditions,
the Participants agree as follows:
1. The Participants agree to cooperate with one another in the planning and development
of the HARP. Each individual Participant's cooperation shall be solely at the discretion of the
Participant and the Participant's governing body.
2. The Participants agree to contribute resources in cash or in kind as each individual
Participant may determine to be in its best interest for the purpose of accomplishing HARP.
3. The Participants agree to take those steps necessary to promote and encourage the
development of HARP as each individual Participant may determine to be in its best interest.
4. The Participants agree to encourage appropriate staff members of each individual
Participant to meet with staff members of other Participants for the purpose of carrying out the
objectives of HARP, as each Participant deems it in its best interest.
5. The intent of this HARP Intergovernmental Agreement is to express each Participant's
support for the overall objectives of HARP as expressed herein without in any way creating a legal
or binding obligation on behalf of any Participant to this Agreement.
6. This Agreement may be executed in several counterparts, each of which shall be an
original and all of which when executed by each Participant shall constitute but one and the same
instrument.
