A RESOLUTION ACCEPTING THE TRANSFER OF LAND
FROM THE BISHOP OF PUEBLO, A CORPORATION SOLE
TO PUEBLO, A MUNICIPAL CORPORATION FOR
HIGHWAY PURPOSES
WHEREAS, the Bishop of Pueblo, a Corporation Sole, has conveyed to the City a portion
of real property adjacent to Lehigh Avenue, Pueblo, Colorado for highway purposes and such
conveyance should be accepted by the City, Now Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Quit Claim Deed dated September 6, 1995 transferring land from The Bishop of Pueblo,
a Corporation Sole, to Pueblo, A Municipal Corporation, a copy of which is attached hereto and
incorporated herein, having been approved as to form by the City Attorney, is hereby approved. The
City Clerk is directed to record the Quit Claim Deed in the office of the Pueblo County Clerk and
Recorder.

a corporation duly organized and existing under and by virtue of the laws of the State of
Colorado grantor, and Pueblo, a Municipal
Corporation,
a corporation duly organized and existing under and by virtue of the laws of the State of
Colorado grantee, whose legal address is One City Hall Place, Pueblo,
Colorado 81003
WITNESS, That the grantor, for and in consideration of the sum of Ten Dollars ($10) and other good and

the receipt and sufficiency of which is hereby acknowledged, has remised, released, sold, conveyed and QUf1 CLAIMH), and by these presents does
remise, release, sell, convey and QUITCLAIM unto file grantee, its successors and assigns forever, all the tight, title, intcicsl, claim and demand which
the grantor has in and to the real property, together with improvements, if any, situate, lying and being in the * County
of Pueblo and State of Colorado, described as hollows: See attached Exhibit "A. "
This conveyance is made on the condition that the strip of land conveyed
shall be used for a public highway and for no other purpose. In the event
that Grantee, its successors or assigns, abandons the use of the strip
of land for highway purpgses, the ownership of the strip shall immediately
revert to Grantor, or its successors or assigns, who may immediately upon
abandonment may reenter and occupy the property.
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and privileges thereunto belonging, or in anywise thcicunto
appertaining, and all the estate, right, title, interest and claim whatsoever, of the grantor, either in law or equity, to the only proper use, benefit and behoof
of the grantee, its successors and assigns forever.

A parcel of land being the Southerly portion of that parcel of land
described in deed recorded on August 23, 1967, in Book 1620 at Page 630
of the Pueblo County records, located in the NW 1/4 of the NW 1/4 of
Section 10, Township 21 South, Range 65 West of the 6th Principal Meridian,
being more particularly described as follows:
Bearings of this description are based on the centerline of Lehigh Ave.
as monumented with a standard City of Pueblo monument at its intersection
with the centerline of Clemson Dr. (formerly known as Fordh'am Dr.) and
a standard City of Pueblo monument at its intersection with the center-
line of Pueblo Blvd., as being N- 39 " -W.
Commencing at the City of Pueblo monument located at the intersection of
the centerline of Lehigh Ave. and the centerline of Clemson Dr.; thence
N- 89 " -t-J along said centerline of Lehigh Ave., a distance of 30.00
feet; thence N- 00 " -E, a distance of 40.00 feet to a point on the
Northerly right -of -way line of Lehigh Ave. at its intersection with the
Westerly right -of -way line of Clemson Dr. and the point of beginning for
this description; thence N- 39°5,2'21 " -',J along the Northerly right -of -way
line of Lehigh Ave., a distance of 419.25 feet to a point on the Easterly
right -of -way line of Pueblo Blvd.; thence N- 00 " -W along said Easterly
