HomeMy WebLinkAbout7704RESOLUTION NO. 7704 A RESOLUTION SUBMITTING TO THE ELIGIBLE ELECTORS OF THE CITY OF PUEBLO AT THE GENERAL MUNICIPAL ELECTION TO BE HELD NOVEMBER 7, 1995 INITIATED ORDINANCES AMENDING THE PUEBLO FIREMEN'S PENSION FUND WHEREAS, initiative petitions for the adoption of ordinances amending the Pueblo Firemen's Pension Fund have been filed with the City Clerk at least sixty (60) days before the general municipal election to be held November 7, 1995, and WHEREAS, the City Clerk previously approved the form and first proof of the petitions, and WHEREAS, the City Clerk has certified that the petitions are signed by registered electors of the City in numbers equal to ten (10) percent or more of the total vote cost in the last general municipal election of the City, and WHEREAS, pursuant to Article 18 of the Charter of the City, City Council shall either pass the ordinances without alteration within thirty (30) days, or shall submit same to a vote of the qualified electors at the next general City election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The initiated ordinances amending the Pueblo Firemen's Pension Fund by the addition of Sections 17 and 18 to Chapter 2 of Title II of the 1971 Code of Ordinances on file with and certified by the City Clerk are hereby submitted to the eligible electors of the City at the general municipal election to be held on November 7, 1995. SECTION 2 The ballot title for the initiated ordinance amending the Pueblo Firemen's Pension Fund by the addition of Section 17 to Chapter 2 of Title II of the 1971 Code of Ordinances shall be: QUESTION NO. - SHALL AN ORDINANCE AMENDING THE PENSION PLAINT FOR FIRE FIGHTERS HIRED BEFORE APRIL 8, 1978 TO INCREASE THE RETIREMENT BENEFIT OF 50% OF SALARY UPON REACHING ELIGIBILITY FOR RETIREMENT (AGE 50 WITH 20 YEARS OF SERVICE) BY AN ADDITIONAL 4% FOR EACH FULL YEAR OF ACTIVE SERVICE AFTER THE ELIGIBILITY DATE IS REACHED, PROVIDED THE YEAR OF SERVICE OCCURS AFTER JANUARY 1, 1994 AND THE TOTAL BENEFIT DOES NOT EXCEED 74% OF SALARY, AND TO INCREASE THE RANK ESCALATION BENEFIT (50% OF ANY INCREASE TO THE SALARY OF THE RANK HELD AT RETIREMENT) BY THE SAME PERCENTAGE INCREASE, BE ADOPTED? FOR TIE ORDINANCE AGAINST THE ORDINANCE SECTION 3 The ballot title for the initiated ordinance amending the Pueblo Firemen's Pension Fund by the addition of Section 18 to Chapter 2 of Title II of the 1971 Code of Ordinances shall be: QUESTION NO. _ - SHALL AN ORDINANCE AMENDING THE PENSION PLAN FOR FIRE FIGHTERS HIRED BEFORE APRIL 8, 1978 TO PERMIT FIRE FIGHTERS TO ELECT A REDUCED PENSION PAYABLE TO THE FIRE FIGHTER DURING HIS LIFE AND UPON HIS DEATH EITHER (i) ALL OF THE REDUCED PENSION OR (ii) ONE -HALF OF THE REDUCED PENSION TO BE PAID TO HIS DESIGNATED BENEFICIARY FOR LIFE WHICH ORDINANCE DOES NOT AFFECT OTHER BENEFITS PAYABLE TO A RETIRED FIRE FIGHTER'S SURVIVING SPOUSE OR DEPENDENT CHILDREN WHICH INCLUDE, FOR THE SURVIVING SPOUSE, A MONTHLY ANNUITY EQUAL TO ONE -THIRD OF THE MONTHLY SALARY OF A FIRST -GRADE FIRE FIGHTER AT THE TIME OF RETIREMENT SO LONG AS THE SURVIVING SPOUSE REMAINS UNMARRIED, AND FOR EACH SURVIVING DEPENDENT CHILD, A MONTHLY ANNUITY OF $30.00, OR IF THERE IS NO SURVIVING SPOUSE OR THE SURVIVING SPOUSE DIES, THE AMOUNT THE SURVIVING SPOUSE WOULD RECEIVE OR IS RECEIVING IS DIVIDED AMONG THE SURVIVING CHILDREN UNDER 18 YEARS OF AGE, BE ADOPTED? FOR THE ORDINANCE AGAINST THE ORDINANCE SECTION 4 -2- The City Clerk is directed to publish the proposed ordinances in full in the form petitioned for not less than thirty (30) days prior to the November 7, 1995 general municipal election.
