RESOLUTION NO. 7665 A RESOLUTION APPROVING A CONTRACT BETWEEN PUEBLO, A MUNICIPAL CORPORATION, AND THE STATE BOARD OF THE GREAT OUTDOORS COLORADO TRUST FUND RELATING TO THE FOUNTAIN CREEK TRAIL IMPROVEMENT, AND AUTHORIZING THE PRESIDENT OF THE COUNCIL TO EXECUTE SAME BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PUEBLO, COLORADO, that: SECTION 1: An Contract dated May 4, 1995, between the City of Pueblo, a Municipal Corporation, and the State Board of the Great Outdoors Colorado Trust Fund, a copy of which is on file in the office of the City Clerk, having been approved as to form by the City Attorney, is hereby approved. SECTION 2: The President of the City Council is hereby authorized to execute and deliver said Contract on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the Seal of the City thereto and attest the same. SECTION 3: This resolution will become effective upon final passage. The Board is a political subdivision of the State of Colorado, created by Article XXVII of the Colorado Constitution, adopted at the November, 1992 General Election. The Constitution appropriates a portion of the net proceeds of the Colorado Lottery to the Board and directs the Board to invest those proceeds in the State's parks, wildlife, open space and recreational resources. In 1994, the Board created a statewide grant program, pursuant to which eligible entities could apply for grants from the State Trails Program, to which Grantee responded with a detailed application (the "Project Application "). C. Grantee submitted a Project Application to the Board which contemplates the execution of the project named above (the "Project "), a copy of which is incorporated by reference and attached as Appendix A. D. The Board approved Grantee's Project Application on April 13, 1995, subject to the execution of a detailed Grant Agreement, subject to the conditions set forth herein. E. Grantee anticipates that the Project described in the Project Application will be substantially completed no later than December 31, 1996. F. Grantee has undertaken responsibility for obtaining the match (funds and in -kind contributions) described in the project application. G. The parties intend this document to be the detailed Grant Agreement required by the Board. The Grantee shall carry out the project in accordance with this agreement and a work program to be approved by the Executive Director of the Board pursuant to this agreement. AGREEMENT The parties agree as follows: 1. Grant and Project The Board hereby grants to Grantee the sum not to exceed $25,000 subject to the terms of this Agreement. These funds shall be used by Grantee solely to complete the project described in Grantee's Project Application as approved by the Board. Grantee hereby agrees to use its best efforts to complete the project. 2. Project scope The Project, Fountain Creek Trail Improvement, as described in the Project Application, will not be materially modified by the Grantee without the written approval of the Executive Director of the Board. 3. Information to be provided upon execution of this Agreement NO FUNDS WILL BE DISBURSED BY THE BOARD UNLESS AND UNTIL THE GRANTEE FURNISHES THE BOARD WITH THE INFORMATION REQUIRED BY THIS C5ICE \WPWIN \CON "CRACT\TRAILS \KMERGE.WPD 5/4/95 - AGREEMENT. Promptly upon execution of this Agreement, Grantee will submit the following information to the Board's staff: a. A resolution adopted by the governing body of the Grantee authorizing the execution of this agreement and approving its terms and conditions; b. A detailed Work Plan and Budget for this Project. Grantee hereby agrees to promptly submit all material revisions to their Workplan and Budget. As provided further below, the Board reserves the right at any stage of the Project to withhold funding if (i) modifications to the Project are so substantial as to make it, in the Board's reasonable judgment, substantially different in quality or kind from that approved by the Board, or (ii) there have been delays in the implementation of the Project which, in the Board's reasonable judgment, make the Project impracticable; C. Written evidence that all permits and approvals necessary to the completion of the project under applicable local, state and federal laws and regulations have been obtained; d. The Project funding schedule (which will be attached to this Agreement as Appendix B), which will (i) briefly identify each major stage or milestone of the Project, (ii) set out the source, amount and anticipated date of each transfer of funds for the Project, and (iii) show the Board payment with respect to the Project; and Plans for the erection of signs and placards for the Project, as provided in Section 9(d) below. f. Full payment of the contract amount will be made upon substantial completion of the Project. A listing of Project Expenditure documentation required prior to final payment is attached as Appendix C. The information required by this paragraph 3 and an executed contract, along with periodic progress reports and the submission and approval of a final written report are also required. 4. Other conditions precedent to disbursement upon completion of Project Prior to the payment by the Board at the completion of the Project, the Grantee must provide written assurance to the Board that: a. The Project has been substantially completed according to the work plan and budget, along with Project Expenditure documentation and reports as noted above to support this claim; ( 5AO ITICE\ WPWIN \CONTRACTITRAILS \KMERGE.WPD 5/4/95 - 3 b. No material modifications or delays have been made or experienced (or the Board has been advised of the modifications or delays and has elected to continue to participate in the funding of the Project); C. Matching funding has been received (or the status of efforts to secure matching funding has been disclosed to Board staff and it has been found to be satisfactory); and d. The representations made to the Board in the grant application continue to be true (or, if there have been any material changes, the Board has been advised of such changes and has assented to them). e. Grantee shall, upon the request of the Colorado Natural Heritage Program, provide additional information, including but not limited to maps of the proposed project. A copy of the Project Application has been provided to the Colorado Natural Heritage Program to help the Board identify any potential conflicts between trail projects and sensitive species and habitats. If potential conflicts are identified, the Board requests the Grantee to demonstrate how the trail project could be modified to avoid or minimize any adverse impacts to sensitive species or habitats. f. Disbursement shall be made on the basis of costs incurred, upon the Grantee's satisfactory completion of the Project and in compliance with all aforementioned conditions in Sections (3) and (4). 5. Project operation and maintenance Grantee agrees: a. Grantee or its successor will operate and maintain the Project facilities in a reasonable state of repair for the purposes specified in the Project Application for at least 25 years, in accordance with generally accepted standards in the parks /recreation/wildlife community. The parties understand and agree that the Board shall not be liable for any cost of such maintenance, management or operation. b. Grantee wili, upon request, provide the Board with the operating and maintenance costs of the Project, and give the Board appropriate information concerning the use of the Project by the public and the impact of the Project. 6. Compliance with regulatory requirements and federal and state mandates The Grantee hereby assumes responsibility for compliance with all regulatory requirements in all applicable areas, including but not limited to nondiscrimination, worker safety, local labor preferences, preferred vendor programs, equal employment opportunity, use 6 AUW�ICE\ WPWIN \CONTRAC1nTRAILS \KMERGE.WPD 5/4/95 — 4 of competitive bidding, and other similar requirements. The Grantee will indemnify the Board from any liability for any failure to comply with any such applicable requirements. 7. Public access Grantee agrees, for itself and its successors in interest, to allow reasonable access to the members of the public to the Project. 8. Nondiscrimination During the performance of this agreement, the Grantee and its contractors shall not unlawfully discriminate against any employee or applicant for employment because of race, religion, color, national origin, ancestry, physical handicap, medical condition, marital status, age or sex. The Grantee and its contractors shall ensure that the evaluation and treatment of their employees and applicants for employment are free of such discrimination. 9. Publicity and Project Information Grantee agrees: a. Grantee shall acknowledge Board funding in all publicity issued by it concerning the Project. b. Grantee shall cooperate with the Board in preparing public information pieces. C. Grantee shall give the Board the right and opportunity to use information gained from the Project. d. Grantee shall erect signs visible from the nearest public roadway directing the public to the Project. In addition, Grantee shall erect placards acknowledging assistance by the Board and the Colorado Lottery, if applicable, unless Grantee incorporates this acknowledgment into other signage in a manner approved by the Board's Executive Director. The Board will provide reproducible samples of its logo and other identifying indicia to Grantee for this purpose. Plans describing the number, design, placement and wording of the signs and placards shall be submitted to the Board for review and written approval prior to completion of the Project. Final payment may be withheld by the Board pending placement of the signs and placards in the manner approved by the Board. e. Grantee shall give the Board 30 -day notice of and opportunity to participate in Project dedications. f. Grantee shall give timely notice of the Project, its inauguration and significance to the local members of the Colorado General Assembly, members of the board of (5M3W ICE\ WPWIN \CON'rRACT\TRAILS \KMERGE.WPD 5/4/95 - 5 county commissioners of the county or counties in which the Project is located, as well as to other appropriate public officials. 10. Information supplied and made available to the Board Grantee shall maintain records of Project receipts and expenditures consistent with generally accepted accounting practices. The Board shall have the right, upon reasonable notice to the Grantee, to audit the books and records of Grantee which pertain to the Project and to the use and disposition of Board funds. 11. Withdrawal of Board funding The Board may withdraw its approval of funding to the Grantee and cease funding of the Project if, in its sole discretion, it determines conditions have occurred which fundamentally change the expectations of the parties or which make the grant infeasible or impractical. 12. Grantee's inability to complete Project If the Grantee determines with reasonable probability that the Project will not or cannot be completed as reflected in the Project Application the Grantee will promptly so advise the Board, and cooperate in good faith with respect to alternative solutions to the problem before any further funds are advanced. 13. Inspection Throughout the term of this Agreement, the Board shall have the right to inspect the Project area to ascertain compliance with this Agreement. 14. General provisions The parties agree as follows: Grantee may not assign its rights under this Agreement without the consent of the Board. b. There is an obligation of good faith on the part of both parties, including the obligation to make timely communication of information which may reasonably be believed to be of interest to the other party. Colorado law applies to the interpretation and enforcement of this Agreement. d. Grantee is an independent contractor acting in its separate capacity and not as an officer, employee or agent of the Board. e. Except as expressly provided herein, this Agreement constitutes the entire agreement of the parties. No oral understanding or agreement not incorporated in this Agreement shall be binding upon the parties. No changes in this Agreement shall be valid unless made as an amendment to this contract, approved by the Board, and signed by the parties in this Agreement. 15. SubiW to .AnnuaL approp riation. Any provision of this agreement or its attachments which impose upon Grantee, directly or indirectly, any financial obligation whatsoever to be performed or which may be performed in any fiscal year subsequent to the year of execution of this agreement is expressly made contingent upon and subject to funds for such financial obligation being appropriated, budgeted and otherwise made available. Earthwork /Grading /Drainage: Earthwork and grading will consist of the preparation of a 15 -foot trail base grade, maintaining the necessary minimum ADA slope. The trail base provides enough room for an 8 -foot concrete trail to be formed and poured with very little preparation by a contractor. The 3 -foot crusher fine trail will be installed by volunteer labor. Drainage improvements will be made as necessary to prevent further erosion problems along this section of the trail project. Trail Construction: The trial will be approximately 4,000 linear feet and will have a dual- surface, which consists of an 8 -foot concrete surface and a 3 -foot crusher fine surface. The concrete trail will be formed and poured by a licenced contractor on the trail base grade prepared by the Department of Public Works. Site Preparation /Revegetation of Disturbed Areas_: The estimated area of the disturbance is approximately 2 acres. This area will be revegetated by a salt tolerant native seed mix. Nichol son R a ti Fountain Creek Trail Improvement (B) Project Management Several sections of the asphalt Fountain Creek Trail which was built in the mid 1980's are in need of replacement, repair, better trail grading, drainage and erosion control. The total cost of this project is estimated to be $70,000 and will include the replacement and relocation of an approximately 3960 foot section of trail and drainage improvements. This section connects Haaff Elementary School to neighborhoods to the north and to a trail to the Pueblo Mall. The existing trail section travels on a bluff of the Fountain Creek where soil erosion of the creek banks have caused unstable and unsafe conditions. Also drainageways from neighborhood streets cause regular washouts of the trail crossing through these drainages. The Fountain Creek Trail connects the Arkansas River Trail and the Runyon Lake Fishing and Wildlife Area and Runyon Baseball Field and Recreation Area with the east and north sections of the city. In addition, the new Runyon Commuter trail connects the Fountain Creek and Arkansas River Trails to the downtown area of Pueblo. The City and County of Pueblo have allocated $35,000 in 1995 for maintenance, repair, improved drainage and erosion control of the Fountain Creek Trail and the Arkansas River Trail system. In addition, a fundraising event called "March for Parks" is scheduled for April 22, 1995 (Earth Day) that the Friends of the River Trail and the Greenway and Nature Center are sponsoring in conjunction with a national program sponsored by the National Parks and Conservation Association. This event is expected to raise an additional $1,000 to $2,000 for trail improvements. Unfortunately, these are not sufficient funds to complete repairs for this trail. A $35,000 matching State Trails grant would assist greatly in this process. The $35,000 city and county allocation is administered by the Friends of the River Trail Organization and the City of Pueblo Park and Recreation Department. Trail maintenance and improvement projects are coordinated by this group and are physically carried out by volunteers and the maintenance and construction staff of the City of Pueblo Park and Recreation Department. Trail improvements for this project on the Fountain Creek Trail would be coordinated by the Friends of the River Trail organization and carried out by the City of Pueblo Park and Recreation Department and volunteer groups. FRIENDS OF THE RIVER TRAIL (Letter of support forthcoming in Addendum) - A regional trails advisory group includes citizens advocates and government SENIOR WALKERS (Letter of support forthcoming in Addendum)- A community -wide senior citizen walking group which supports trails. PUEBLO BIKE 'N DINE (Letter of support forthcoming in Addendum) - A Pueblo area bicycle club dedicated to bicycle riding, both roadway and trails. SOUTHERN COLORADO RUNNERS (Letter of Support forthcoming in Addendum) - The running club uses the trail system extensively for training and organized races. AMERICAN VOLKSMARCH ASSOCIATION (Letter of support forthcoming in Addendum) - A national walking and running group that utilizes the Pueblo trails and trails throughout the nation. 2. Show how specific trail corridor design supports each type of use (ATV, bicycle, cross- country ski, equestrian, foot, four - wheel drive vehicles, snowmobile, trail motorcycle) . DUAL TRAIL DESIGN: -The trail - corridor design is designed to accommodate primarily bicycle and pedestrian use and any other non - motorized uses. (ATV, four -wheel drive vehicle, snowmobile, and trail motorcycle and any other motorized uses are prohibited on the River Trail by City Ordinances). Emergency and maintenance vehicles are exempt from this ordinance. Replaced trail sections utilize a dual trail designed for the following users: - bicycle /pedestrian: 8 foot wide concrete; - equestrian user may be the only user group in which this section of trail is limited due to the urban intensity of the density of the trail. 2 3. Provide evidence of support for this project from community leaders, service organizations, recreation and environmental groups, schools, businesses, and other non - government groups (letters, petitions, news articles, event descriptions, etc.). The following groups have been informed about the project and have expressed an interest of support: GREENWAY AND NATURE CENTER (REGIONAL NONPROFIT)- Recreation, Education, and Environmental Center and Greenway /river trail supporter operated by the University of Southern Colorado. (Letter of support enclosed) TRAIL RANGERS (VOLUNTEER ORGANIZATION)- Volunteer group coordinated by the Greenway and Nature Center that regularly patrols trails providing information and trail user assistance. (Letter of support enclosed). PUEBLO COUNTY COMMISSIONERS- (Letter of support forthcoming in Addendum). PRESIDENT OF PUEBLO CITY COUNCIL- (Letter of support forthcoming in Addendum). HAAFF ELEMENTARY SCHOOL (SCHOOL DISTRICT 60 ELEMENTARY SCHOOL) - Elementary school located adjacent to Fountain Creek Trail that utilizes the trail for recreation and access to environmental study areas and the proposed "Earthship" building. (Letter of support forthcoming in Addendum). GREAT DIVIDE SKI BIKE AND HIKE SHOP (BUSINESS)- (Letter of support forthcoming in Addendum). 4. Describe volunteer efforts for this project. LANDSCAPING AND CLEAN -UP: Each spring and fall, about 300 -500 volunteers assist with an organized trail -wide clean -up called "Clean Up the Rivers Day ". The entire Pueblo River Trail system utilizes an "adopt -a- trail" concept whereby different groups and organizations adopt mile -long sections of the trail to clean -up and monitor. Volunteers have also been helping on an ongoing basis to clean -up graffiti along the trail. Volunteers would also assist with tree planting and nonprofessional landscape work in disturbed areas. TRAIL PLANNING, FUNDRAISING, MAINTENANCE, AND EVENT PLANNING: The Friends of the River Trail organization is a coalition of volunteer citizens advocates and representatives of pertinent organizations, and government which serve as an advisory group for trail planning, maintenance, fundraising, and event planning. 3 The Greenway and Nature Center of Pueblo staff and community and university advisory boards also assist with trail planning, fundraising, patrol of the trail with its volunteer trail ranger program, fundraising for trail improvement, and special events such as the Clean up the Rivers Days in the Spring and Fall, Earth Day Walk for Parks program, volunteer recognition picnic after the fall clean -up, and others. 5. In addition to funds to meet any required match, list other sources of funds, in -kind services, and materials (excluding volunteer labor). FUNDRAISING EVENT: a fundraising event called "March for Parks" is scheduled for April 22, 1995 (Earth Day) that the Friends of the River Trail and the Greenway and Nature Center are sponsoring in conjunction with a national program sponsored by the National Parks and Conservation Association. This event is expected to raise an additional $1,000 to $2,000 for trail improvements. IN -KIND SERVICE: City of Pueblo Department of Public Works will supply preliminary engineering, survey and layout. Pueblo Department of Parks and Recreation will supply site preparation for revegetation of disturbed areas. 6. Provide evidence of cooperation among adjoining jurisdictions and other government agencies in planning and development of the trail project. PUEBLO AREA COUNCIL OF GOVERNMENTS (PACOG)- has passed a resolution to develop an integrated natural resource management plan for Pueblo County. The Pueblo trail systems will be an integral part of this plan. CITY OF PUEBLO AND COUNTY OF PUEBLO- the City of Pueblo allocated $20,000 in 1995 for river trail maintenance and repair. In addition, the County of Pueblo through the County Human /Community Services Funding Assistance Program allocated $15,000 for river trail maintenance and repair for a total allocation of $35,000 from the two entities. HAAFF ELEMENTARY SCHOOL AND UNIVERSITY OF SOUTHERN COLORADO -are working together to develop an "Earthship" environmental building which will be a model of energy efficiency and will use earth friendly and recycled building materials. The Fountain Creek Trail will provide access to this new community facility. 0 7. Describe the technical, scenic, and /or unique features of this trail segment that will provide a quality experience for trail users. The Fountain Creek Trail connects with the Arkansas River Trail in the Runyon Lake area which is a fishing and urban wildlife sanctuary. The trail follows Fountain Creek through scenic riparian and wetland environments. The trail also borders Haaff Elementary School and provides access to a school environmental area and proposed "Earthship" building. 8. Show how this trail segments links or provides direct access to other trail systems, parks, recreation sites, or open public lands. The trail will lead users to: 1) The Runyon Lake Fishing and Wildlife Area and Runyon Baseball Field Recreation Area, and the trails around them. 2) The downtown area via the new Runyon Commuter Link through the Historic Arkansas River Park (HARP). Separate bicycle and pedestrian trails will be located through the HARP area and to the soon to be built Pueblo Convention Center Complex 3) The Arkansas River Trail which provides access to the famous river murals along the river, the riparian natural areas to the west and the Greenway and Nature Center and Lake Pueblo State Park. 3) Access to Haaff Elementary School and the school's environmental area and proposed "Earthship" building. 4) The Pueblo Mall area, University Park and the University of Southern Colorado on the North end of the trail. 5) All segments of the Fountain Creek and the Arkansas River Trail System are identified as Priority 1 trails in the 1992 Colorado State Recreational Trails Master Plan. 5 9. Show how the project aids in the protection, rehabilitation or improvement of the environment in this segment of the trail corridor. At present some bank and soil erosion is occurring along segments of this trail. Some of this soil runs off into Fountain Creek effecting water quality and loss of soil. This project will involve improved drainage structures along the trail to prevent erosion and damage from runoff. Revegetation of eroded slopes and for aesthetic reasons along the trail to include planting shade trees and shrubs for wildlife cover and food, and reestablishing native plants. The volunteer trail clean up and refuse removal efforts described earlier contribute to a cleaner trail environment. 10. Describe how you will publicize and promote this trail or project. USER AND TRAIL ADVOCACY GROUPS: Elementary school children and their parents at Haaff Elementary School would be asked to help as volunteers for the revegetation and clean -up aspects of the project. At the completion of the improved trail, a grand re- opening would be scheduled at the school for the children and their families, the PTO organization, and appropriate local officials. The Friends of the River Trail and the groups that they represent, the Greenway and Nature Center, and the Trail Rangers would all be part of the volunteer effort to revegetate and clean -up. NEWS MEDIA: The entire project and its elements will be publicized in the local newspapers including the Pueblo Chieftain and Pueblo West Horizon and Eagle, all local TV channels and radio stations, and the Greenway and Nature Center newsletter, The Cottonwood (cir. 1200) . GENERAL TRAIL INFORMATION PUBLIC FACILITIES: Trail improvement information will be distributed to trail access points and information facilities such as the Greenway and Nature Center, Pueblo City Park and Recreation Department, Pueblo Lake State Park, Pueblo Chamber of Commerce, and others. Copies of invoices for all expenditures listed on the expenditure report. This should include expenditure reimbursement. Invoices must indicate those items which apply to the project. 3. Copies of all canceled checks for the above invoices. 4. Copies of all contracts awarded. 5. Copies of all change orders to contracts. 6. Evidence of payment of contract amounts.
