HomeMy WebLinkAbout7625RESOLUTION NO. 7625 A RESOLUTION AUTHORIZING THE RELEASE OF EASEMENTS IN THE REGENCY PARK SUB- DIVISION, 5TH FILING BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: CF('TTnN 1 The attached Release of Easements for property within the Regency Park Subdivision, 5th Filing, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of the City Council is hereby authorized to execute such Release on behalf of the City of Pueblo, and the City Clerk is directed to affix the seal of the City thereto and attest the same. (50') drainage, water, and sanitary sewer easement described in Book 2154 at Page 501 of the Pueblo County records and identified as Easement No. 1, in Regency Park, 5th Filing. Easement No. 2 : (Partial Release) All that portion of the fifteen ft. (15') drainage, water, and sanitary sewer easement described in Book 2154 at Page 501 of the Pueblo County records and identified as Easement No. 2, in Regency Park, 5th Filing. Easement No. 3 All that portion of the thirty ft. (30') public utility easement described in Book 2027 at Page 472 of the Pueblo County records and identified as Easement No. 1, in Regency Park, 5th Filing. Easement No. 4 All that portion of the fifteen ft. (15') public utility easement described in Book 2027 at Page 472 of the Pueblo County records and identified as Easement No. 2 in Regency Park, 5th Filing. Easement No. 5: All that portion of the pedestrian and public utility easement described in Book 2163 at Page 955 of the Pueblo County records in Regency Park, 5th Filing. RELEASE OF EASEMENTS This release of easements is made on M=�, 8 , 1995, by Pueblo, a Municipal Corporation (City), whose legal address is One City Hall Place, Pueblo, Colorado 81003, to Vintage Development Company, a Colorado Corporation (Owner). WHEREAS, the Owner is the developer and property owner for the property known as Regency Park Business Center, Filing No. 2, according to the recorded plat thereof; and WHEREAS, the Owner is the Grantor or the successor in interest of the Grantor, and the City is the Grantee of easements described in at- tached Exhibit "A" for drainage and other utilities across Owner's property; and WHEREAS, the Owner has granted to the City alternate easements for such purposes; and NOW, THEREFORE, in consideration of Owner granting such alternate easements, the City hereby releases the easements described in attached Exhibit "A ".
