HomeMy WebLinkAbout7621RESOLUTION NO. 7621 A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE WITH COLORADO REVISED STATUTES SECTION 31 -12- 107 (1) OF THE PETITION FOR ANNEXATION OF THE AREA COMMONLY KNOWN AND DESCRIBED AS NORTH OF COLORADO STATE HIGHWAY NO. 78 AND SOUTH OF REGENCY PARK WHEREAS, a Petition For Annexation of the area described in Section 1 hereof has been filed with the City Clerk, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The Petition For Annexation of the following described area situated in Pueblo County, Colorado, is hereby found and determined to be in substantial compliance with the provisions of C.R.S. X31 -12 -107 (1): Parcel 1A. A parcel of land situated in the SE 1/4 of Section 9, Township 21 South, Range 65 West of the 6th Principal Meridian and located within Columbia Heights according to the recorded plat thereof, filed for record May 23, 1888, and being more particularly described as follows: Beginning at a point on the Northwesterly right -of way of Colorado State Highway No. 78, said point also being the East line of New York Avenue of said Columbia Heights; Thence Northerly along said East line a distance of 1215.19 feet (exist- ing City limits line); Thence Easterly parallel with the North line of the SE 1/4 of said Section 9 a distance of 302.86 feet; Thence along a curve to the left a distance of 286.24 feet, said curve having a radius of 420.00 feet and a central angle of 39° 02' 52 "; Thence Northeasterly to the South line of Ashland Avenue of said Columbia Heights, said point being 44.39 feet West of the Northeast corner of Block 14 of said Columbia Heights; Thence Easterly along the North line of said Block 14 and the North line of Block 13 of said Columbia Heights a distance of 124.91 feet; Thence leaving (Existing City limits line) South- easterly perpendicular to the right -of -way of Colorado State Highway No. 78 a distance of 596.56 feet to the North right -of -way of said Highway; Thence Southwesterly along said North right -of -way a distance of 1831.05 feet to the point of beginning. Excepting Lots 32, 33, 34 and 35 of Block 16 of said Columbia Heights, containing 25.79 acres more or less. Parcel 2A. A parcel of land situated in the SE 1/4 of Section 9, Township 21 South, Range 65 West of the 6th Principal Meridian and located within Columbia Heights according to the recorded plat thereof, filed for record May 23, 1888, and being more particularly described as follows: Beginning at a Point on the Northwesterly right - of -way of Colorado State Highway No. 78, said point also being the (Existing City limits line); Thence Northwesterly perpendicular to the right - of -way of Colorado State Highway No. 78 a distance of 587.79 feet to the centerline of Ashland Avenue of said Columbia Heights; Thence Easterly along the centerline of said Ashland Avenue a distance of 424.78 feet to the centerline intersection of Ashland Avenue and Eiler Avenue of said Columbia Heights; Thence Southerly along the centerline of said Eiler Avenue a distance of 414.10 feet to the Northerly right -of -way of said Highway No. 78; Thence Southwesterly along said right -of -way a distance of 80.12 feet to the point of beginning, containing 2.56 acres more or less. SECTION 2. A public hearing to determine if the area proposed to be annexed meets the applicable requirements of C.R.S. §31 -12 -104 and X31 -12 -105 to establish eligibility for annexation under -2- the Municipal Annexation Act of 1965 shall be held before the City Council in Council Chambers, Second Floor, City Hall, One City Hall Place, Pueblo, Colorado, on Monday, June 26, 1995, commencing at 7:30 o'clock p.m. or as soon thereafter as City Council Business allows. The City Clerk shall publish notice of the public hearing once a week for four successive weeks in the Pueblo Chieftain. The first publication of such notice shall be at least thirty (30) days prior to the date of the hearing. A copy of the published notice, together with a copy of the Petition For Annexation shall be sent by registered mail by the City Clerk to the Board of County Commissioners and the County Attorney of Pueblo County and to any school district or special district having territory within the area to be annexed at least twenty -five days prior to the date of the hearing.
