A RESOLUTION ACCEPTING EASEMENTS FOR ROADWAY
PURPOSES TO PUEBLO, A MUNICIPAL CORPORATION
WHEREAS, Joseph DeMetrio Vega dba SV Developers has granted to
the City of Pueblo easements for roadway purposes; and
WHEREAS, such easements are necessary for public rights of way
and future city development.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1
The City Council approves and accepts for public rights of way
purposes the easements granted by Joseph DeMetrio Vega dba SV
Developers to Pueblo, a Municipal Corporation. Such easements are
dated November 2, 1994, and are attached to this resolution.

EASEMENT FOR ROADWAY PURPOSES
THIS EASEMENT, granted this day of f►/p 1994, by
JOSEPH DEMETRIO VEGA dba SV DEVELO E S, GRANTOR, to the CITY 'OF PUEBLO, e
Municipal Corporation, GRANTEE:
WITNESSETH:
THAT FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) and other
good and valuable consideration, paid by GRANTEE, receipt of which is hereby
acknowledged, GRANTOR hereby grants to GRANTEE, its successors and assigns,
an easement for the purpose of roadway and appurtenant facilities, in, through,
over, under and across GRANTOR'S property situate in Pueblo County, Colorado,
and described as follows:
The East 12.5 feet of the following described
parcel:
Commencing at the Northwest corner of the South
1/2 of Block 2 of Prairie Avenue Place, 2nd Filing;
thence East along the North property line of the
South 1/2 of Block 2, 350 feet more or less, to a
pin and cap (L.S. #10093) being the point of be-
ginning for this parcel; thence South 72 feet along
the West property line of Parcel 'B', recorded in
Book 2743, Page 632, to a pin and cap (L.S. #10093);
thence East 100 feet to a pin and cap (L.S. #10093)
on the right of way of Mason Drive; thence North 72
feet along the West right of way of Mason Drive to
a pin and cap (L.S. #10093) on the North property
line of the South 1/2 of Block 2; thence West 100
feet along the North property line of the South 1/2
of Block 2, to the point of beginning.
TOGETHER WITH the right to enter upon said property for the purpose of
construction, maintenance, control, and repair, and together with the right to
use so much of the adjoining property of GRANTOR that may be reasonably neces-
sary during the period of initial construction for said purposes. The GRANTOR
reserves the right to use and occupy said property for any purpose consistent
with the right and privilege above granted and which will not interfere with
or endanger any of the GRANTEE'S equipment or facilities therein or use thereof
Such reservation by the GRANTOR shall in no event include the right to locate
or erect or cause to be located or erected any building or any other structure
or mobile home trailer unit upon the easement herein granted.
"GRANTOR" shall include the plural and the feminine. This easement shall
be binding upon, and shall inure to the benefit of the heirs, personal repre-

sentatives, successors, or assigns of the GRANTOR and GRANTEE.

thence North 72 feet parallel to the Carol Drive
right of way to a pin and cap (L.S. #10093) on the
North property line of the South 1/2 of Block 2;
thence West 100 feet along the North property line
of the South 1/2 of Block 2, to the point of be-
ginning.
