A RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN AN AGREEMENT
EXTENDING THE LEASE BETWEEN THE CITY OF PUEBLO AND THE STATE
OF COLORADO, DEPARTMENT OF CORRECTIONS, DIVISION OF
CORRECTIONAL INDUSTRIES.
WHEREAS, the City of Pueblo entered into a lease the 26th day
of June, 1974 with the State of Colorado, Department of
Corrections, Division of Correctional Industries; and
WHEREAS, the term of said existing Lease expired June 30, 1994
and the first Lease Extension Agreement expires August 31, 1994,
and negotiations for a new lease are still in progress; and
WHEREAS, it is the desire of the City Council to extend the
term of said Lease to allow time for continued negotiations;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO,
COLORADO, THAT:
SECTION 1
The City Manager is hereby authorized to sign an
agreement extending the term of said Lease to
December 31, 1994.

LEASE EXTENSION AGREEMENT
This Agreement made and entered into this lel— day of Q , 1994, by the State of
Colorado, acting by and through the Department of Natural Aesources, for the use and
benefit of the Division of Parks and Outdoor Recreation and Board of Parks and Outdoor
Recreation, whose address is 1313 Sherman Street, Room 618, Denver, Colorado 80203,
hereinafter referred to as "DPOR ", and the City of Pueblo CO 81003, hereinafter referred
to as the "City ".
WHEREAS, the State of Colorado, Department of Corrections, Division of
Correctional Industries entered into a lease the 26th day of June, 1974, recorded at Book
1790 Page 290, Reception Number 477946 of the Pueblo County Clerk & Recorders Office
(the "Lease ") with the City for certain lands now owned by DPOR; and
WHEREAS, the term of said existing Lease expired June 30, 1994, and the first
Lease Extension Agreement expires August 31, 1994, and the DPOR and the City are
negotiating a new lease on the property; and
WHEREAS, negotiations for the new lease are not expected to be completed prior
to the termination date of the 1st lease extension agreement, and the parties hereto desire
to extend the existing Lease and Lease Extension Agreement beyond its current termination
to allow additional time for negotiating and executing a new lease.
NOW T ORE, the parties hereto agree as follows:
1. The termination date of the existing Lease and 1st Lease Extension agreement shall be
amended to December 31, 1994.
2. Any rental payments made by the City under the existing Lease covering the period
beyond June 30, 1994 shall be pro -rated as rental payment for July through December,
1994. In the event no payments are made to cover the period July 1 - December 31, 1994,
the State may bill and the City shall pay for that period either under the new lease or as
a separate billing, at the State's option.
3. All other provisions and agreements of the existing Lease remain in full force and effect
in all other respects.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day
first above written.
