HomeMy WebLinkAbout7374RESOLUTION NO. 7374 A RESOLUTION APPROVING THE REVISED PHASE II WORK TASKS, PROJECTED HOURS AND FIXED FEE BETWEEN ABEL ENGINEERING PROFESSIONALS, INC., AND THE CITY OF PUEBLO FOR PROFESSIONAL ENGINEERING AND SURVEY SERVICES IN CONJUNCTION WITH THE PUEBLO CENTER SUBDIVISION, FILING NO. 3, AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PUEBLO, COLORADO, that: SECTION 1: A letter outlining a Revised Scope of Work dated May 5, 1994, a copy of which is on file at the office of the City Clerk and made a part hereof by reference, after having been approved as to form by the City Attorney, by and between Pueblo, a Municipal Corporation, and Abel Engineering Professionals, Inc., is hereby approved. SECTION 2: City funds for these services will be paid from Account No. 09- 1994 - 448- 0- 40 -20. SECTION 3• The President of the City Council is hereby authorized to execute Phase II, Vacation Plats and Subdivision of said Scope of Work on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the Seal of the City thereto and attest the same. The main reason for the revision is to expedite the project and to eliminate portions of the subdivision that are directly related to the site development. Enclosed is Appendix A (Phase II- Vacation Plats and Subdivision). The primary change is the elimination of the improvement plans. This will reduce the proposal by $5,200 and result in a Phase II project of $8,260. We are prepared to make every effort to meet a submittal date of May 31, 1994, however this schedule is dependent on several variables. Many of these variables are beyond our control. Variables include notice to proceed, complete title work, resolution of any boundary or title inconsistencies, coordination with the engineering, planning and development in establishing of lot lines and parcels, and review time. Phase I - Initial Boundary and Topography is progressing well with the exception of Title work that is being reviewed. We anticipate delivering the product within two weeks. One Set of Working Drawing Blue Lines for review ( maximum of 2 reviews) 2. One Set of AEP Finals Vellum Reproducible Computer Generated Diskette (Auto Cadd Version 12) We can start immediately with the objective and Phase II submitted for subdivision approval by May 31, 1994. CONDITIONS The following items are binding parts of this proposal for us to keep the cost at this level. 1. Work will be billed monthly, based on a percentage of work completed. Monthly statements are payable within thirty (30) days of the date of billing. A monthly 2 percent fee will be charged to late payments. 2. Under no circumstances, will retainage be withheld on work completed. 3. We anticipate a commitment from the city for review priority. The maximum review time from any department will be 72 hours. 4. Any major revision prior to 2 weeks before submittal for subdivision will relieve us of our time frame obligation. 5. The City of Pueblo is the only governmental agency we anticipate answering to. 6. Would appreciate standard City of Pueblo monuments to be set as indicated on the plat of Pueblo Center Filing #1.
