HomeMy WebLinkAbout7352RESOLUTION NO. 7352 A RESOLUTION OF INTENT AND AUTHORIZATION TO ACQUIRE REAL PROPERTY FOR THE MAIN STREET BRIDGE REPLACEMENT PROJECT WHEREAS, the City will undertake the construction and installation of the Main Street bridge replacement project, and WHEREAS, certain real property adjacent to the existing Main Street bridge is necessary and required for the Main Street bridge replacement project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The City Council hereby finds and determines that the interest of the City of Pueblo and its residents; the preservation of the public health, safety and general welfare; the public need, interest and necessity will be served by the Main Street bridge replacement project and the acquisition of real property for such project located in Pueblo County, Colorado, and described as: The Easterly 100 feet of Lots 1 and 2; Lot 3, except that portion conveyed to Pueblo, a Municipal Corporation by Deed recorded July 2, 1935 in Book 805 at Page 31, Instrument No. 538104; Lot 5; and Lot 6, excluding that part of Lot 6 lying SE of the NW line of the alley if said alley were extended to the intersection of Corona Avenue; all in Block 1, Wayland Place, Pueblo County, Colorado. Street addresses, 626, 630, 636 and 640 South Main Street, Pueblo, Colorado (the "Property "). and, that such Main Street bridge replacement project be used, constructed and developed in a manner necessary and convenient for public use and purposes. SECTION 2 The City Council does hereby further find and determine that it is necessary and desirable and in the best interest of the City to acquire title to and possession of the Property for the Main Street bridge replacement project. SECTION 3 The City Manager or his designated representative be and hereby is authorized and directed to obtain an appraisal of the fair market value of the Property by a competent and qualified appraiser and to negotiate for and on behalf of the City with the owner or owners of the Property for the purchase thereof by the City. If such negotiations for the purchase of the Property are unsuccessful, the City Attorney is hereby authorized and empowered to institute condemnation proceedings in the name of the City for the acquisition of the Property through the exercise of the City's power of eminent domain.
