A RESOLUTION ACCEPTING AN EASEMENT FROM
BERNARDO SR. AND MOLLY MONTOYA
WHEREAS, Bernardo Sr. and Molly Montoya, on January 31, 1994,
granted an easement to the City of Pueblo; and
WHEREAS, such easement is necessary to construct alley improve-
ments across the Southwest corner of the property located at 1235 Taylor
Avenue, and has been approved as to form by the City Attorney; now, there-
fore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The easement granted by Bernardo Sr. and Molly Montoya, dated
January 31, 1994, which easement is on file with the City Clerk, is hereby
approved and accepted.
SECTION 2.
The City Clerk is directed to record said easement in the office
of the Pueblo County Clerk and Recorder.

ALLEY RIGHT -OF -WAY EASEMENT
THIS EASEMENT, granted thi day of d� ��z� 1994, by
BERNARD MONTOYA, SR. and MOLLY MONTOYA, GRANTOR, to the CITY OF PUEBLO, a
Municipal Corporation, GRANTEE:
WITNESSETH:
THAT FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) and other
good and valuable consideration, paid by GRANTEE, receipt of which is hereby
acknowledged, GRANTOR hereby grants to GRANTEE, its successors and assigns,
an easement for the purpose of alley paving and public utilities, in, through,
over, under and across GRANTOR'S property situate in Pueblo County, Colorado,
and described as follows:
An easement located within that parcel of land
situated in the Southeast quarter of the South-
east quarter of Section 1, Township 21 South,
Range 65 West of the 6th Principal Meridian,
being more particularly described as follows:
Beginning at the Southwest corner of Lot 28,
Block 4, City Hall place, Second Filing, a sub-
division and addition to the Town of Bessemer,
now part of the City of Pueblo, according to the
plat thereof; thence Northerly along the Westerly
line of said Lot, a distance of 8.50 feet; thence
Southeasterly to a point on the South line of said
lot, said point being 13.66 feet East of the South-
west corner of said lot; thence Westerly along the
South line of said lot, a distance of 13.66 feet
to the point of beginning.
TOGETHER WITH the right to enter upon said property for the purpose of
construction, maintenance, control, and repair, and together with the right to
use so much of the adjoining property of GRANTOR that may be reasonably neces-
sary during the period of initial construction for said purposes. The GRANTOR
reserves the right to use and occupy said property for any purpose consistent

with the right and privilege above granted and which will not interfere with
or endanger any of the GRANTEE'S equipment or facilities therein or use there-
of. Such reservation by the GRANTOR shall in no event include the right to
locate or erect or cause to be located or erected any building or any other
structure or mobile home trailer unit upon the easement herein granted.
"GRANTOR" shall include the plural and the feminine. This easement shall
be binding upon, and shall inure to the benefit of the heirs, personal repre-
sentatives,
successors,
or assigns
of the GRANTOR and GRANTEE.
