HomeMy WebLinkAbout7279RESOLUTION NO. 7279 RESOLUTION OF THE CITY COUNCIL OF PUEBLO, COLORADO, ADOPTING THE CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) DRAFT STATEMENT OF OBJECTIVES AND ACTIVITIES FOR 1994 WHEREAS, the City of Pueblo, hereinafter called City, is designated as an entitlement city under the Housing and Community Development Act of 1974, as amended through 1990; and WHEREAS, the Citizens' Advisory Committee on Community Development has received and reviewed applications for the use of 1994 CDBG funds. Said Committee has made its recommendations to the City Council on the projects to be approved; and WHEREAS, the City held a Public Hearing on November 8, 1993, and in addition, Quadrant Meetings at various locations within the City to obtain the views of citizens and various groups on the City's housing and community development needs; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: Section 1. The City Council hereby authorizes the publication of the City's Community Development Block Grant Statement of Objectives and Activities for 1994. This publication will afford affected citizens an opportunity to examine the statement's contents and the City's proposed use of 1994 Community Development Block Grant funds, and to provide comments on the proposed statement. December 28, 1993 THE CITY OF PUEBLO, COLORADO, COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) DRAFT STATEMENT OF OBJECTIVES AND ACTIVITIES FOR 1994 The City Council of Pueblo, Colorado, proposes the following objectives for use of CDBG funds in 1994. CDBG funds are intended to provide decent housing, suitable living environment and economic opportunities, principally for low- and moderate - income persons through rehabilitation and preservations, economic /job development and public facilities improvements. It is estimated that approximately $1,800,000 in CDBG funds will be received by the City of Pueblo in 1994, along with program income from Housing Loan paybacks of approximately $140,000. It is the intent of the City of Pueblo that approximately 70% of the program funds would benefit the needs of low- and moderate - income persons. Permanent involuntary displacement of neighborhood persons or businesses is not anticipated. Any low- and moderate - income housing which is demolished or converted will be replaced in compliance with the CDBG regulations. Final adoption of 1994 CDBG projects will be finalized by this date, including amendments as a result of actual funding to the estimated total of $1,800,000. PRE IDENT OF CITY COUNCIL To: Lew Quigley, city Manager Members of City Council From: Tony Berumen, Director of Housing and Community Servic Subject: Conflict of interest complaint from Larry Francher concerning four members of 1994 Citizens Advisory Committee (CAC) Date: December 27, 1993 On December 22, 1993, I was approached by the news media, concerning the make -up of the members that serve on the Citizens Advisory Committee and the possible conflict of interest for the following four non - profits that are represented on the CAC: Pasada Homeless Shelter Independent Living Center for Handicap Pueblo Martin Luther King Commission Minnequa Redevelopment Corporation Each of the above groups represent either the homeless, black community, handicap, or the Bessemer commercial area, however, each of the above groups do have one member that served on the Citizens Advisory Committee and are involved in the decisionmaking process in regards to the 1994 CDBG recommendations made to City Council on November 29, 1993. Citizen Participation Plan Followed: Currently, the City of Pueblo follows a detailed Citizen Participation Plan as required under the CDBG regulations. Under the plan citizen membership on the CAC should involve and represent a balanced viewpoint of the community needs. When citizen complaints are received the guidelines state that I should be contacted and seek a satisfactory solution of the complaint. If the complainant is not satisfied with the response, he may appeal to any member of the City Council. The Voting Process Used by CAC: It should be noted that all members of the above groups, in order to avoid an appearance of a conflict of interest with other CAC members, withdrew themselves from voting on their agency's funding amount at the public meeting held on November 18, 1993. This was brought to the media's attention. However, if there is any complaint as to the process we should deal with it in an effective way that HUD would allow. There are several factors HUD will consider when an appearance of conflict of interest is questioned. HUD can then resolve the dispute by ruling on an exception as allowed under the CDBG regulations. Solution to the Complaint: Since City Council will be publishing the 1994 CDBG "Draft" Statement of Activities to allow a 30 day public comment period and since this complaint should properly be considered before any final expenditure decisions are made by City Council by January 24, 1994, final adoption should proceed as follows: During the 30 day public review period I will submit to HUD a letter of the stated complaint and request clarification and possible exception, since Denver HUD office does have authority to grant exceptions to the conflict of interest provision. Exceptions can only be granted where threshold requirements are met and after consideration of the regulations granting exceptions. HUD shall consider the cumulative effect of the following factors, where applicable: Whether the exception will provide an essential degree of expertise to the CDBG program or projects that will otherwise not be available; Whether the person affected is a member of a group or class of low and moderate income persons intended to be the beneficiaries of the assisted activity; Whether the affected person has withdrawn from his or her functions or decisionmaldng process with respect to the specific assisted activity in question; Whether undue hardship will result either to the recipient or the person affected when weight against the public interest served by avoiding the prohibited conflict; Following a reply from HUD I will notify City Council before final passage of the 1994 CDBG list of activities.
