A RESOLUTION CERTIFYING THE CITY OF PUEBLO /PUEBLO
TRANSPORTATION COMPANY FY 1994 UPDATE PARATRANSIT
SERVICE PLAN OF THE AMERICANS WITH DISABILITIES ACT.
WHEREAS, the Americans with Disabilities Act was signed into Law on July
26, 1990; and
WHEREAS, the U.S. Department of Transportation published final Regulations
implementing certain provisions of the Act on September 6, 1991; and
WHEREAS, the Department of Transportation Regulations requires that Public
entities that operated fixed route transportation services for the general public
also provide complementary Paratransit Service; and
WHEREAS, the Plan was subsequently approved and determined to be "in
Compliance" by the Federal Transit Administration on September 8, 1992.
WHEREAS, the Department of Transportation Regulations require a
complementary Paratransit Service Plan to be updated and recertified annually.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The City of Pueblo adopts and certifies that the Paratransit Service Plan
of the Americans with Disabilities Act as being in compliance with the Act.
IN
SECTION 2.
The President of City Council be, and she is authorized to execute the
certification of the Plan on behalf of Pueblo, a Municipal Corporation and the
Pueblo Transportation Company, and the City Clerk shall affix the Seal of the City
thereto and Attest the same.

INTRODUCTION
The Americans with Disabilities Act extends civil rights protection in many
areas to persons with disabilities. It was signed into law on July 26, 1990.
The purpose of the act is to "provide a clear and comprehensive national
mandate for the elimination of discrimination against individuals with
disabilities."
The ADA seeks to assure equal opportunity, full participation, independent
living and economic self- sufficiency for persons with disabilities. It is not
an affirmative action statute. Rather, it seeks to achieve these objectives
by prohibiting covered entities from excluding people from jobs, services,
activities or benefits based on disability.
On September 6,1991, the U.S. Department of Transportation (USDOT) published
final regulations implementing certain provisions of the Americans with
Disabilities Act of 1990 (ADA). Included in these regulations was a
requirement that public entities operating fixed route transportation service
for the general public also provide complementary paratransit service to
persons unable to use the fixed route system. The regulations specify: when
this service is required; eligibility criteria for these paratransit
services; the level of service which must be provided; and, standards for
certain aspects of operation. The regulations also require that a plan for
implementing complementary paratransit service be submitted on January 26,
1994.
The original ADA Paratransit Plan was approved and adopted by the Pueblo City
Council on December 23, 1991, and certified by the Pueblo Area Council of
Governments the Pueblo Metropolitan Planning Organization on December 19,
1991. The ADA Paratransit Plan was then submitted to the Federal Transit
Administration within the required timetables and subsequently approved and
"in Compliance" on September 8, 1992.
The City of Pueblo's Department of Transportation, Urban Transportation
Planning Division has provided this FY 1994 Updated Paratransit Service Plan
to fulfill the obligation set forth.
I. IDENTIFICATION OF SUBMITTING ENTITY AND MPO CERTIFICATION
The responsible entity submitting this plan is the City of Pueblo and the
Pueblo Transportation Company. The responsible official for ensuring
compliance with the ADA Plan is City Manager, Lewis Quigley. The City
Department of Transportation Director, Donald J. Saling will monitor
compliance with all aspects of this plan and will be the contact person.

As per Section 49 CFR 37.139(h) the City of Pueblo submits Attachment A, an
updated Metropolitan Planning Organization (MRP) Certification that the Pueblo
Area Council of Governments, as the MPO has reviewed, and also a Resolution by
the Pueblo City Council certifying that the Plan is in conformance with ADA
Legislation.
II TIMETABLES AND PROGRESS REPORT ON MILESTONES
Table 1 is a depiction of the PTC ADA Paratransit Plan Timetable and Progress
Report. The three milestones identified in the 1993 Update were successfully
accomplished during FY '93. The three milestones are as follows:
1) To increase fares from .50 cents to $1.00 on the Paratransit Service
"Citi- Lift". Complying with requirements of no more than twice the base
fixed -route fare for eligible individuals.
2) Request for service accepted on all day prior to days of service (e.g.
weekends /holidays).
3) Purchase of two new accessible mini -vans available for the Paratransit
Service "Citi- Lift".
With the accomplishment of the above - mentioned milestones, the City of
Pueblo /PTC will be in full compliance with ADA Legislation January 1, 1994.
Tables 2 & 3 summarize the PTC's commitment and compliance with the six
individual paratransit service criteria of the ADA Legislation. As can be
seen, the PTC is in compliance with all pertinent criteria and is on schedule
to fulfill the projected time frame for full compliance.
Also enclosed (Attachment B) is the PTC's ADA Paratransit Eligibility
Certification Application.

IV. BUDGET, COSTS, AND VEHICLE ESTIMATES
Table 5 is an updated budget summary that forecast the capital and operating
expenses for all paratransit services at the PTC.
Table 6 is an updated budget summary that forecast the total capital and
operating expenses for all transit services within the PTC.
Table 7 is an inventory of past, present, and projected fixed -route rolling
stock that are accessible. This table includes those vehicles in active
service that are equipped with pre -ADA lift /ramps and also those vehicles that
comply with ADA Legislation.
Table 8 is an inventory of past, present, and projected para- transit vehicles
that are owned by the PTC.

PUBLIC PARTICIPATION
During FY 1993, the City of Pueblo /Pueblo Transportation Company conducted
numerous Transit Advisory Committee (TAC) Meetings to discuss the operations
of the "Citi -Lift" Paratransit Service. The meetings were very constructive
and provided an opportunity for information sharing and comments for the
improvement of the service. Outreach and Consultation activities took place
on the following dates and locations:

conjunction with the Colorado Developmental Disabilities Planning Council and

The FY 1994 Updated ADA Draft Plan was advertised for public comment on
November 19, 1993. The Draft Plan was available for distribution in various
accessible formats. Specifically, the PTC provided the Updated Plan in large
print, braille and audio format for those individuals with impairments.
The PTC also conducted two Public Hearings for public review of the Updated
Plan. The PTC advertised the Public Hearings in the Pueblo Chieftain
(Attachment D) which will be held at City Hall, #1 City Hall Place, Pueblo,
Colorado on December 7, 1993 at 10:00 a.m. and 7:00 p.m.
UNRESOLVED ISSUES
The City of Pueblo /Pueblo Transportation Company received an "in compliance"
review, by the FTA, of the 1993 ADA Plan Update on May 21, 1993 (see
Attachment E). One comment of concern in the FTA Review of the 1993 ADA
Update was for the PTC to allow proper spacing of photocopying of the Public
Notice and Affidavit in a manner that would allow the publication date to be
read. Hopefully this concern will be addressed in the 1994 Update and
subsequent submittals.
OTHER ISSUES
No significant issues to report at this time.

BACKGROUND: On July 26, 1990, the Americans with Disabilities Act (ADA) was
signed into law. The stated national goal include assuring that
persons with disabilities have equality of opportunity, a chance to
fully participate in society, are able to live independently, and
can be economically self - sufficient.
A substantial part of this legislation addressed transportation
provided by public entities. Paramount to public entities is the
requirement that those entities which provide fixed route public
transportation service also must offer comparable paratransit
service.
On December 23,1991, the Pueblo City Council approved and adopted
the paratransit service plan of the Americans with Disabilities Act
for FY 1992.
The Plan was subsequently approved and determined to be "in
Compliance" by the Federal Transit Administration (FTA) on
September 8, 1992.
A requirement of this legislation is to update each plan annually
and to include any significant changes and revisions to the
timetables for implementation. Each entity must also update the
achievements of projected milestones and any slippages that have
occurred in the Plan throughout the year.
Also, included within the requirement is to submit this updated
plan by January 26, 1994.
Through City Councils direction and cooperation, the City of
Pueblo /Pueblo Transportation Company will have met all requirements
and milestones in FY 1993 and be in total compliance by January
1994, two years ahead of schedule.

A RESOLUTION CERTIFYING THE CITY OF PUEBLO /PUEBLO
TRANSPORTATION COMPANY FY 1994 UPDATE PARATRANSIT
SERVICE PLAN OF THE AMERICANS WITH DISABILITIES ACT.
WHEREAS, the Americans with Disabilities Act was signed into Law on July
26, 1990; and
WHEREAS, the U.S. Department of Transportation published final Regulations
implementing certain provisions of the Act on September 6, 1991; and
WHEREAS, the Department of Transportation Regulations requires that Public
entities that operated fixed route transportation services for the general public
also provide complementary Paratransit Service; and
WHEREAS, the Plan was subsequently approved and determined to be "in
Compliance" by the Federal Transit Administration on September 8, 1992.
WHEREAS, the Department of Transportation Regulations require a
complementary Paratransit Service Plan to be updated and recertified annually.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The City of Pueblo adopts and certifies that the Paratransit Service Plan
of the Americans with Disabilities Act as being in compliance with the Act.

Eligibility Criteria for Specialized Transit Services
1. The user's physical, developmental or mentally disordered disabilities has
been certified within the guidelines, as outlined in Attachment A.
Certification of disability is to be completed by a Physician.
Once eligibility has been established in accordance with Item #1 above, the
following general guidelines will be considered for utilization of the SRDA
Specialized Transit Services.
2. The severity of the user's disabilities prevents him /her from safely boarding
a fixed route accessible bus without the assistance of the operator, or an
aide. It is the user's responsibility to provide an aide /guide when needed.
3. The user's necessary auxiliary equipment is too extensive (i.e., electric
wheelchair, etc.) to allow independent use or safety on a fixed route
service.
4. Memory and /or learning disabilities prevent the user from learning or
utilizing fixed route service.
5. Due to user's disability, transfer difficulties prohibit the user from
getting to /from the destination on fixed route service, or infrequency of
service can result in physical hardship to the user.
6. The distance between the user's home /destination and the bus stop on the
fixed route is too lengthy, or the terrain is to difficult (based on the
user's certified disability) to permit access to the fixed route service.

DEPARTMENT OF TRANSPORTATION NUMBER: PTC -CL -001
POLICY & PROCEDURE DATE: November 15, 1990
SUBJECT: CITI -LIFT CERTIFICATION REVISED: December 4, 1992
PURPOSE: The purpose of this Policy /Procedure is to ensure a consistent
standard certification processing of Citi -Lift applicants with
little or no delay to the applicant.
PROCEDURE: Effective the date of this Policy /Procedure,
Certification/ Processing of Citi -Lift users shall be as follows:
PROCESSING:
1) Certification Forms received in the PTC Office shall be date
stamped; reviewed, assuring all data is complete, and that a -
licensed medical doctor has signed the form.
2) A certification number shall be assigned to the form, signed,
and dated. (See attached list of types of certifications
available).
a) If the applicant is issued a temporary certification, a
"T" will precede the number (Tool).
b) If the applicant is issued an emergency certification
(must be approved by Transit Administrator or Director),
an "E" will precede the number (E004). This is a one
time, emergency certification only. Applicant must be
certified following regular guidelines to utilize
Citi -Lift in the future.
3) Each new applicant shall be sent a "Welcome to Citi -Lift"
letter, notifying them they have been certified to ride
Citi -Lift. Arrangements will be made with the applicant to
take their photo and issue their Citi -Lift Photo
Identification Card.
4) New applicants (names, addresses, etc.) will be entered into
the computer to update records.
5) SRDA will be notified daily of new applicants.
6) A complete list, by last name, of all applicants will be
printed and forwarded to SRDA weekly.
7) Original Certification Forms are filed in a secure area to
protect their confidentiality.

APPENDIX C - Continued
TYPES 1) REGULAR - Any individual who meets the criteria for
eligibility shall be deemed a regular user with no
restrictions.
2) TEMPORARY
a) Disabili - Any individual who has a temporary
disability attested by a licensed medical doctor may
utilize Citi -Lift until the date identified by the doctor
on the submitted certification form.
b) Visitor - All visitors are eligible for Paratransit
Service for the first 21 days of their stay upon
presentation of their ADA Eligibility Card or upon
self - certification or verification that "they are unable
to use the City of Pueblo's Fixed Route Transit Service ".
3) EMERGENCY - Any individual authorized by the Transit
Administrator, Director of Transportation, or designee may
certify an individual for a one -time emergency.
4) PERSONAL CARE ATTENDANT - A certified personal care
attendant is eligible to ride with the applicant at no
charge.
Visitors may only be required to apply for eligibility if they need to receive
Citi -Lift Service beyond the first 21 days.
ADMINISTRATIVE APPEALS PROCESS
An individual will receive written notification identifying the reasons for
the denial or suspension and the procedures which may be utilized to appeal
the decision. Correspondence will be sent utilizing accessible formats, i.e.,
Braille, etc.
2. Individuals who are denied eligibility can obtain review of the denial and
appeal the decision within 60 days of the denial of the application.
3. Individuals will be afforded the opportunity to be heard and to present
information and arguments with the Director of Transportation for the City of
Pueblo, who is not involved with the initial decision to deny eligibility as
per Section 37.125.
4. The PTC will submit, in writing, written (accessible format) information of
the decision to the individual in a timely manner.
5. If the PTC has not rendered a decision within 30 days of the completion of the
appeal process, the PTC shall provide Citi -Lift Service from that time unless
a decision to deny the appeal is issued.
6. This appeals process shall also apply to those individuals who have been
suspended from the Citi -Lift Service for such infractions as: missed
scheduled trips "No Shows ", violent or threatening behavior, etc.

THOSE INDIVIDUALS WHO, BY REASON OF ILLNESS, INJURY, CONGENITAL MALFUNCTION, OR
OTHER PERMANENT OR TEMPORARY INCAPACITY OR DISABILITY IS UNABLE AT THIS TIME TO
UTILIZE EXISTING LOCAL MASS TRANSPORTATION FACILITIES AND SERVICES EFFECTIVELY
WITHOUT SPECIAL FACILITIES OR EQUIPMENT.
PHYSICAL DISABILITIES:
1. Non - Ambulatory Disabilities. Impairments that, regardless of cause,
necessitate the use of a wheelchair.
2. Semi - Ambulatory Disabilities. Impairments that cause individuals to
walk with difficulty or insecurity including individuals using a long
leg brace, a walker or crutches to achieve mobility.
& Semi - Ambulatory Disabilities. Persons who due to any cause, suffer
arthritis which causes a functional motor deficit in any two major limbs
(arms and /or legs).
American Rheumatism Association criteria may be used as a guideline for
the determination of arthritic handicap. Therapeutic Grade III or worse
and Functional Class III or worse and Anatomical State III or worse are
evidence of arthritic handicap.
4. Semi - Ambulatory Disabilities. Persons with amputation of; or anatomical
deformity of (i.e., loss of major function due to degenerative changes
associated with vascular or neurological deficiency, traumatic loss of
muscle mass or tendons and X -ray evidence of bony or fibrous ankylosis
at an unfavorable angle, joint subluxation or instability).
a. Both hands; or
b. One hand and one foot;
c. Amputation of lower extremity at or above the tarsal region (one or
both legs)
5. Semi - Ambulatory Disabilities. Cerebrovascular accident (stroke) with
one of the following four months post -CVA:
a. Pseudobulbar palsy; or
b. Functional motor deficit in any of two extremities; or
c. Ataxia affecting two extremities substantiated by appropriate
cerebellar signs of proprioceptive loss.

6. Semi - Ambulatory Disabilities - Pulmonary Ill's. Persons with re
impairment (dyspnea) as defined by the Journal of the Americar
Classes of Respiratory Impairment
Class 3 Dyspnea does not occur at rest but does occur during the usual
activities of daily living. However, the patient can walk a
mile at his /her own pace without dyspnea although he /she
cannot keep pace on the level with others of the same age and
body build. Percent disability 40 -50.
Class 4 Dyspnea occurs during such activities as climbing one flight
of stairs or walking 100 yards on level, or less exertion or
even at rest.
Class 6 Dyspnea present on slightest exertion, such as dressing,
talking, at rest.
7. Semi - Ambulatory Disabilities - Cardiac Ill's. Persons with functional
classifications of cardiac disease, Classes III and IV and therapeutic
classification, Classes C, D, E, and defined by Diseases of the Heart and
Blood Vessels - Nomenclature and Criteria for Diagnosis, 6th Edition,
Boston, Little, Brown and Company by the New York Heart Association.
Functional Classification
Class III Persons with cardiac disease resulting in marked limitation of
physical activity. They are comfortable at rest. Less than
ordinary physical activity causes fatigue, palpitation,
dyspnea, or anginal pain. For instance, inability to walk one
or more level blocks or climbing flight of ordinary stairs.
Class IV Persons with cardiac disease resulting in inability to carry
on any physical activity without discomfort. Symptoms of
cardiac insufficiency or of the anginal syndrome may be
present even at rest. If any physical activity is undertaken,
discomfort is increased.
Therapeutic Classification
Class C Persons with cardiac disease whose ordinary physical activity
should be moderately restricted, and whose more strenuous
efforts should be discontinued.
Class D Persons with cardiac disease whose ordinary physical activity
should be markedly restricted.
Class E. Persons with cardiac disease who should be at complete rest,
confined to bed or chair.

8. Semi - Ambulatory Disabilities - Dialysis. Persons who in order to live,
must use a kidney dialysis machine.
9. Sight Disabilities. This section includes only the legally blind.
A. Those persons whose vision in the better eye after best correction
is 20/200 or less; and /or
B. Those persons whose visual field is contracted (commonly known as
tunnel vision)
i. to 10 degrees or less from a point of fixation, or
ii. so the widest diameter subtends an angle no greater
than 20 degrees
10. Hearing Disabilities. Deafness or hearing incapacity that may make an
individual insecure in public areas because the individual is unable to
communicate or hear warning signals, including only those persons whose
hearing loss with amplification is an average of 90 dba or greater in
the 500, 1000, 2000, Hz ranges.
11. Disabilities of Incoordination. This section includes those persons
with faulty coordination or palsy from brain, spinal or peripheral nerve
injury and any person with a functional motor deficit in any two limbs
or who suffers manifestations which significantly reduces mobility,
coordination and perceptiveness not accounted for in previous
categories.
DEVELOPMENTAL DISABILITIES
Persons who are so developmentally disadvantaged from infancy or before reaching
maturity that they are incapable of managing themselves and their affairs
independently with ordinary prudence, or of being taught to do so, and who
require supervision, assistance, and care, for their own welfare, or for the
welfare of others, or for the welfare of the community. Further, any person who
is unable, or likely to be unable to physically or mentally respond to an oral
instruction relating to danger and without assistance take appropriate action
relating to such danger.
12. Mental Retardation. Refers to subaverage general intellectual
functioning which originates during the developmental period and is
associated with impairment in adaptive behavior (a general guideline is
an IQ which is more than two standard deviations below the norm). This
section also applies to adults who by reason of illness or accident
suffer mental retardation.

13. Cerebral Palsy. Persons having a disorder dating from birth or early
infancy, non - progressive, although is not treated, there is marked
regression in functioning characterized by examples of aberrations of
motor functions (paralysis, weakness, coordination) and often other
manifestations of organic brain damage such as sensory disorders,
seizures, mental retardation, learning difficulty and behavioral
disorders.
14. Epilepsy (Convulsive Disorder). Clinical disorder involving impairment
of consciousness, characterized by major motor seizures (grand mal or
psychomotor) substantiated by EEG, occurring more frequently than once a
month in spite of prescribed treatment. With:
a. Diurnal episodes (loss of consciousness and convulsive seizure); or
b. Nocturnal episodes which show residuals interfering with activity
during the day.
15. Autism. Persons having 1) a syndrome described as consisting of
withdrawal very inadequate social relationships, exceptional object
relationships, language disturbances, and monotonously repetitive motor
behavior; many children with autism will also be seriously impaired in
general intellectual function; 2) this syndrome usually appears before
the age of 6 and is characterized by severe withdrawal and inappropriate
response to external stimuli.
16. Neurological Handicap. A syndrome characterized by learning, perceptual
and /or behavioral disorders of an individual whose IQ is not less than
two standard deviations below the norm. These characteristics exist as
a result of brain disfunction (any disorder in learning or using the
senses) neurological disorder, or any damage to the central nervous
system whether due to genetic, hereditary, accident, or illness
factors. This includes persons with severe gait problems who are
restricted in mobility.
MENTALLY DISORDERED DISABILITIES:
This section carries no age restriction.
17. Emotionally Disturbed. To the extent of total disability and:
a. living in a board and care home; or
b. living at home under supervision.

TRAVEL SAFETY TIPS
• Know your destination, routes and schedules
• Know bus arrival times at your bus stops. Avoid unnecessary waits
• Walk down the middle of the sidewalks, avoiding bushes and
doorways. Avoid shortcuts through alleys.
• Know what's nearby that can act as a safe refuge, i.e. open businesses.

• Avoid talking with a driver or passenger of any vehicle that stops -
exceptions include police or emergency vehicle that is clearly marked.

• Have your money or bus tickets ready in your hand.
• When boarding, make sure the bus is going to your destination. If
unsure ask the bus driver.
• Sit close as you can to the bus driver, not only for better visibility but
also in case you need assistance.
• Always wear clothing that allows you to be seen at night and during
the day.
• Casually keep your head and eyes moving at all times to observe
movement around you. Be aware of your surroundings!
• Be assertive, walk with your head up, not looking down. See people
with your eyes first and look them in the eye. This lets people know
you are aware, alert, and not afraid.

1994 American's with Disabilities Act (ADA) Updated Plan
Notice is hereby given to all interested parties that the City of Pueblo and the Pueblo
Transportation Company is offering for public review the FY 1994 Americans with
Disabilities Act (ADA) Paratransit Service Draft Updated Plan. The proposed ADA
Plan identifies those Transit Issues which apply to the City of Pueblo and the PTC
and conform to the Legislation passed July 26, 1990. The Plan is offered for review
and public comment and available in accessible format if requested. Interested
parties may contact the Department of Transportation for a copy of the draft ADA

Americans with Disabilities Act (ADA) Plan
Notice is hereby given to all interested parties that two Public Hearings will be held
by the City of Pueblo, Department of Transportation, Pueblo Transportation
Company on Tuesday, December 7, 1993, at 10:00 a.m. and 7:00 p.m. in the COG
Conference Room, #1 City Hall Place - 3rd Floor for the purpose of comment,
suggestion, and public participation in considering the City's proposed 1994
Americans with Disabilities Act (ADA) Paratransit Service Plan. This location is
accessible to the disabled. All interested parties or agencies will be afforded an
opportunity to comment in regard to the Social, Economic, Operations, Planning, and
Environmental aspects of this project at this hearing. The proposed Updated ADA
Plan is available for inspection at the City of Pueblo Department of Transportation,
350 South Elizabeth. Considerations will be made at the. Public Hearing for
individuals with hearing or sight impairments. If requested, an interpreter will be
present at the hearing. This request can be made by calling 545 -5840 prior to this
hearing. Questions regarding the Public Hearing or the proposed ADA Plan should
