A RESOLUTION AUTHORIZING THE TRANSFER OF LAND
TO THE HOUSING AUTHORITY OF THE CITY OF PUEBLO
RELATING TO A HOUSING PROJECT
WHEREAS, The Housing Authority Of The City Of Pueblo (the
"Housing Authority ") is applying through the Farm Home
Administration for funding for a project specifically geared
toward housing by families who derive at least twenty -five percent
of their income from agriculture, and
WHEREAS, the Housing Authority has requested the City to
transfer certain vacant lots or parcels of land in the Eastwood
Heights Area to the Housing Authority for use in such housing
project, and
WHEREAS, such lots or parcels of land owned by City are
surplus to the City's needs; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:

The Quit Claim Deed and the transfer of the real property
therein described from Pueblo, a municipal corporation to the
Housing Authority of the City of Pueblo, a copy of which is
attached hereto and incorporated herein, having been approved as
to form by the City Attorney, are hereby approved.

The President of the City Council is authorized to date, sign
and deliver the Quit Claim Deed in the name of Pueblo, a municipal
corporation and the City Clerk is directed to affix the seal of
the City thereto and attest same, subject to and contingent upon:
(a) The approval of the Housing Authority of the City of
Pueblo's application for funding for the housing project by the
Farm Home Admininstration.
(b) The payment and discharge of all liens and encumbrances

against the real property by the Housing Authority of the City of
Pueblo.

Resolution #7274 as follows:
a. The Housing Authority was approved for the FmHA Farm
Worker Housing Program on August 5, 1994. See attached
FmHA Notice of Preapplication Review Action.
b. In response to the payment and discharge of liens and
encumbrances, the attached Commitment for Title will
address to this concern.

in favor of the proposed Insured named in Schedule A, as owner or mortgagee of the estate or interest covered

resolution must be property certified by an officer

TITLE OF PUEBLO, but need not be recorded.
2. Deed executed by COUNTY OF PUEBLO to HOUSING AUTHORITY OF PUEBLO. (As to
Parcel B)
NOTE: Duly certified copy of .resolution of the Board
of County Commissioners of the County of Pueblo,
a body politic and corporate, authorizing the sale
of subject property.
3. Deed executed by CITY OF PUEBLO to HOUSING AUTHORITY OF PUEBLO. (As to Parcel

but prior to the date the proposed Insured acquires of record for value the estate or
interest or mortgage thereon covered by this Commitment.

(1) Rights or claims of parties in possession not shown by the public records.
(2) Encroachments, overlaps, boundary line disputes, and any matters which would be
disclosed by an accurate survey or inspection of the premises including, but not
limited to, insufficient or .impaired access or matters contradictory to any
survey plat shown by the public records.
(3) Easements, or claims of easements, not shown by the public records.
(4) Any, lien or right to a lien, for services, labor or material heretofore or
hereafter furnished, imposed by law and not shown by the public records.
(5) (a) Unpatented mining claims; (b) reservations or exceptions in patents or in Acts
authorizing the issuance thereof; (e) water rights, claims or title to water,
whether or not the matters excepted under. (a), (b), or (c) are shown by the public
records.
(6) Taxes or special assessments which are not shown as existing liens by the public
records of any taxing authority that levies taxes or assessments on real property
or by the public records. Proceedings by a public agency which may result in
taxes or assessments, or notices of such proceedings, whether or not shown by
the records of such agency or by the public records.
Paragraphs 1, 2, 3, 4, 5 and 6 will not appear as printed exceptions on extended coverage
policies, except as to such parts thereof which may be typed as a Special Exception in
Schedule B- Section 2.
