The Amendment to the Agreement for Professional Engineering Services as- sociated with the replacement of the Main Street Bridge, by and between the City of Pueblo, a Municipal Corporation, and Lonco, Inc., a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of the City Council is hereby authorized and directed to execute said Amendment in substantially the same form as attached, for and on behalf of the City of Pueblo, and the City Clerk is hereby directed to attest same and affix the seal of the City thereto. cFrTTnm 2 Funds for said Professional Services, in the amount of $351,642.00, shall be paid from Highway User Trust Funds, Account Number 005 -1993- 413 -000- 040 -3550. INTRODUCED December 13 ,1993 ATTEST: City Clerk By MICHAEL OCCHIATO Councilperson APPROVED Pr si ent of the Council AMENDMENT TO AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES THIS AMENDMENT To Agreement for Professional Engineering Services is made and entered into this 13th day of December, 1993 by and between the City of Pueblo, a Municipal Corporation (here- inafter referred to as "Owner ") and Lonco, Inc. a professional engineering firm (hereinafter referred to as "Engineer "). WHEREAS, Owner and Engineer have heretofore entered into an Agreement (hereinafter "the Agreement ") dated May 10, 1993 wherein Engineer agreed to render certain professional engineering and related services for Owner in connection with the Main Street Bridge Replacement Project (hereinafter referred to as the "Project "); and WHEREAS, the parties contemplate that the Project shall continue into a subsequent phase or other work not within the original scope of the Agreement, and it is necessary and desirable that the Agreement be amended to include the subsequent phase services or other work; NOW, THEREFORE, in consideration of the foregoing and the mutual terms and conditions set forth herein, the parties agree as follows: 1. The Agreement is amended by expanding the scope of work to include iii professional engineering services reasonably required or necessary for the "Final Design Phase including preparation of Bid Documents" as contemplated within paragraphs 1.1 and 2.3 of the Agreement. 2. Appendix "A" to this Amendment shall be added to the original Appendix A - Scope of Services and Engineer shall complete the work items described generally in Appendix "A" to this Amendment in accordance with the terms of the Agreement for the performance of professional services in the Final Design and Bidding Phase of the Project. 3. Paragraph 2.3 of the Agreement shall be amended to include a new subparagraph 2.3(j) to read as follows: "(j) Consult with Owner concerning administrative proceedings, if any, concerning the Project before any state or federal regulatory agency or commission." 4. With respect to Engineer's services provided during the Final Design and Bidding Phase, Appendices "B" and "C" to this Amendment shall apply to compensation payable to Engineer, and to key personnal and consultants employed or retained by Engineer, in connection with Engineer's services during said phase of the Project. 5. Except as expressly modified by this Amendment, the Agreement shall remain in full force and effect. Any obligations remaining to be performed under the original Agreement by either party, relating to the professional services to be performed by Engineer generally or with respect to other phases of the project are not waived or excused in any manner, but shall be fully performed in accordance with the terms and conditions of the Agreement as it existed prior to this Amendment. PUEMAIN- 0.I -COR INTRODUCTION This "Scope of Services" consists of the performance of specific roadway engineering services for the improvement of Main Street roadway and the replacement of the Main Street Bridge, structure number PUEMAIN- 0.I -COR. The engineering services required shall include final bridge and roadway design, preparation of right -of -way description, construction specifications and contract plan documents. Project Construction is scheduled for July /August 1994 to August 1995. The Engineer shall be responsible for performing the necessary engineering and preparing the specific documents as outlined. The applicable American Association of State Highway and Transportation Officials (AASHTO), the Colorado Department of Transportation (CDOT) and the City of Pueblo design and specification standards shall provide the design criteria and requirements necessary for performing the work. The Engineer understands that this project is being funded primarily with Special Bridge Funds from the State of Colorado. Upon final inspection of the completed bridge by a CDOT bridge inspection consultant, the bridge must be removed from the Select List of the Federal Bridge Inventory as evidenced by the revised Sufficiency Rating, and it must meet the legal load limits. When completed, if it is not removed from the Select List, the Engineer will be responsible for the additional design and construction cost and loss of funding due to a failure in the Engineer's design of the project to meet the above criteria. Additional instruction is provided herein as it pertains to each task in the project. II. PROJECT ADMINISTRATION The City of Pueblo will be the sole contracting agency for this project. All work will be subject to the review and approval of the Director of Public Works or his authorized representatives. Mr. Tom Cvar, P.E. Director of Public Works (719) 543 -2860 FINAL DESIGN SCOPE OF WORK PAGE 2 EXISTING INFORMATION The following information, data and services related to the Project area will be made available and provided by the City: A. Existing Right -of -Way Information B. Floodplain Reports C. City Utility Information D. Traffic Counts E. Street Drainage System Reports F. City of Pueblo Design Standards, Criteria and Details G. Master Plan Reports and Studies (Development and Bike Path Related) IV. PROJECT TASKS AND INSTRUCTIONS A. General All work shall be prepared in accordance with the latest editions of the AASHTO AND CDOT Standards, City specifications and directions in this document. The standards and specifications to be used are: 1. AASHTO "Standard Specifications for Highway Bridges ". 2. AASHTO HS -20 -44 Loading. 3. AASHTO "A Policy on Geometric Design of Highways and Streets ", 1990. 4. CDOT "Standard Specifications for Road and Bridge Construction ", 1991. 5. CDOT "Roadway Design Manual ", 1990. 6. City of Pueblo Drainage Standards Manual. 7. Applicable CDOT M &S Standards 8. FHWA "Manual of Uniform Traffic Control Devices ", 1988. 9. The road will be closed to traffic at the project bridge site and traffic will be detoured around the construction site. 10. Dead load will include an allowance for a future four inch asphalt overlay in addition to the final design surface. 11. The replacement structure cross - section will be analyzed for the existing 100 -year floodplain. 12. Four 12 -foot driving lanes. B. Special Instructions 1. Meetings: The Engineer will be required to attend the following: a. One meeting with the City and Railroad Companies to discuss design criteria and progress. FINAL DESIGN SCOPE OF WORK PAGE 3 b. Monthly progress meetings with the City. C. One presentation to the City Council during the day. d. Final design meeting with the City. e. Four additional meetings as requested by either the City or the Engineer. f. Pre -Bid Meeting C. Life Cycle Cost Analysis: The Engineer will perform a life cycle cost analysis for two structural systems: precast concrete girders and painted steel girders. The analyses will utilize a useful life cycle for each system and determine the present value of maintenance and operating costs for each system. D. Surveys: The Engineer will obtain supplemental field survey information additional to the Preliminary Design Survey Information required to complete the design of the project, including right -of -way surveys, existing property corners, right -of -way plans and descriptions. A project baseline including all horizontal and vertical control will be established and referenced. Additional existing and new roadway alignment, profile and cross - sections will be obtained. Cross - sections of the Arkansas River channel will be obtained as necessary to supplement the existing topographic mapping for the hydraulic analysis. The additional existing utilities will be located based upon visible surface evidence and surface markings supplied by the utility companies. E. Geotechnical Investigation and Pavement Design: 1. The site will be investigated using a drill rig to determine depth and capabilities of the bearing formation. A minimum of seven deep and eight shallow holes will be drilled. The work will include the necessary field and laboratory tests to provide recommendations on foundation type, allowable loadings, gradation of stream bed material for scour studies, asphalt and concrete pavement design from CBR values and recommendations for the design and construction of approach fills. The results of the soils and foundation investigation along with the recommendations will be summarized in a report. The boring logs will be shown on the plans on an Engineering Geology Sheet. F. Environmental Assessments 1. A field investigation of the soil borings will be performed to better assess site conditions. A report will be prepared outlining the work conducted, visual observations and potential environmental concerns, the results of analytical testing, and summary with conclusions and recommendations. FINAL DESIGN SCOPE OF WORK PAGE 4 2. The Engineer will coordinate with the Colorado Department of Wildlife and other state agencies to prepare an environmental assessment report for the project. G. Drainage /Hydraulics /Hydrology: A hydrologic and hydraulic investigation of the Arkansas River shall be performed. Specific items to be investigated in the design shall include but not be limited to the following: a. Background Research - The hydrologic and hydraulic data contained in the latest City of Pueblo Flood Insurance Study will be used to conduct water surface profile analyses on this project. b. Hydrologic Analysis - Hydrology for this reach is contained in the report referenced above. C. Hydraulic Analyses - The replacement structure shall convey flows equal to or greater than flows conveyed by the existing bridge. Field surveyed cross - sections will be used to analyze the replacement structure using the HEC -2 computer program. The results of this analysis will be used to design the pier footings below the determined slow depth. d. Roadway and Bridge Storm Drainage - The storm drainage for the project shall be analyzed using approved criteria from the City, County and /or State. In the event conflicting criteria arises, the most stringent shall be used upon approval of the City. The design of the new facilities for construction shall follow the most current criteria and details as provided or approved by the City. e. Individual Site Permit - In conjunction with the final design, the Engineer will prepare cross - sections and plans required for the Corps of Engineers Individual Site permit. The Engineer will prepare all correspondence and applications necessary for the permit. f. Offsite Storm Drainage Analysis - This analysis pertains to the offsite storm sewer system downstream of the project. This system includes the line from "C" Street to "D" Street and the line in "D" Street to the trunk line at Santa Fe Avenue. The system will be analyzed using previous reports and data that apply to the area and the current project. In the event it is discovered the project adversely affects the system downstream redesign (pending City approval) may need to be done using detention in an effort to reduce the effects of this project on the downstream system. H. Utilities: The Engineer will research and collect information concerning existing utilities. The City and utility companies will be contacted to obtain updated information about existing facilities and future requirements. A full size set of plans will be submitted to all utility companies for review and comment. Upon receiving comments from the utilities, new or revised utility locations will be added to the plans. Also, the requirements to accommodate the utilities such as block -outs in the abutments and piers will be incorporated into the final design and plans. FINAL DESIGN SCOPE OF WORK PAGE 5 2. Utility Companies to be contacted include but will not be limited to the following: a. Public Service Company of Colorado b. WestPlains Energy C. U.S. West Communications d. TCI Cable e. Pueblo Board of Water Works f. City Public Works - Sanitary Sewers - Storm Drainage g. SP /D & RGW Railroad h. AT & SF Railroad i. MCI I. Right -of -Way: 1. The Engineer shall determine all right -of -way needs as well as provide the parcel legal descriptions, slope and construction easements and right -of -way descriptions necessary for right -of -way acquisition. These will be in suitable form for the City's negotiators to acquire necessary right -of -way and easements. After the City has acquired the required right -of -way the Engineer shall set property pins or right -of- way markers for a total of five (5) properties located at Main and "B" Streets and at Main and Church Streets in accordance to the plans and agreements. J. Final Design Documents Development: 1. Upon receipt of the City's written Notice to Proceed and the City's approval of the preliminary plans; the final design, detail drawings, construction schedule, specifications, and an estimate of probable construction costs will be prepared. The drawings will be prepared using vellum and will be suitable for reproduction. Specifications, quantities, and estimates will be consistent with CDOT Standard items and specifications. Information shown on the Contract Plans will be in sufficient detail to permit the construction contractor to prepare complete shop details for fabrication and erection of the structure. The Engineer will perform the load rating check to conform with CDOT requirements. Independent design check of key structural components, calculations and traffic study results will also be included. 2. At approximately the 60% completion phase, the Engineer will submit two (2) sets of drawings to the City for review and comment. The City will respond with comments within a reasonable time frame for the Engineer so as to maintain project progress and not delay the project bid date. 3. Throughout the project, the Engineer may also submit individual drawings to the City for review and comment. 4. The following drawings, as appropriate, will be included in the construction bid package: FINAL DESIGN SCOPE OF WORK PAGE 6 Title Sheet with project site map, summary and sheet index - Summary of approximate quantities Roadway general notes and typical cross - sections - Proposed construction schedule and performance criteria Geology data: Location of test holes, boring log and legend, soil test results Hydrology /Hydraulic data: flow line elevation, design flow, design velocity, discharge vs. recurrence interval, discharge vs. stage Bridge general notes Foundation layout: estimated pile tip elevation and maximum end bearing pile load or caissons layout or spread footings Substructure layout and details Abutment plan and details Pier plans and details Superstructure plan and details Girder details Top of Deck elevations Utility accommodation details Bridge rail and guard rail layout and details Roadway plan and profile: Stationing, construction centerline, section line, corners, ties to corners, temporary benchmark elevations and locations, topography, existing and proposed drainage, if applicable utilities, existing right -of -way, and new right -of -way, new easements, names of property owners, vertical curve design data, and horizontal curve design data, if applicable. Superstructure layout and details Demolition phasing and details Roadway cross sections Retaining wall plans and details Lighting plan and details Striping plans and pavement markings Final roadway signing Traffic detour route and signing 5. The Engineer will include the limits of the existing and new right -of -way, the limits of the new easements, and the names of the property owners on the plan sheets, whenever applicable. The Engineers will provide legal descriptions for new right - of -way, if required. 6. The City will review the final detour route and traffic control plan and return it to the Engineer. 7. The Engineer will prepare a project constructibility review and submit the report to the City for review. 8. The Engineer is required to provide two (2) sets of the final contract documents and original vellum to the City. One stamped set of bluelines will be provided to the City. FINAL DESIGN SCOPE OF WORK PAGE 7 J. PUC (Public Utilities Commission) Hearing Assistance: The Engineer shall assist the City in Performing needed services for the scheduled PUC Hearing and other related work to the PUC process. This work consists of providing documents, depositions, attendance at meetings, attendance at the PUC Hearings and testimony. Compensation for this work is not included in this contract. Compensation will be provided as Additional Services, additional time and expenses incurred to perform this work will be at the rates outlined in the attached Fee Schedule. K. Bid Assistance: The Engineer shall assist the City during the project bid phase. The work will include the distribution of bid documents, attendance at the pre -bid meeting as a representative of the City, addenda distribution as necessary to clarify the Contract Documents, attend the bid opening with the City, prepare a bid tabulation to verify the accuracy of the bids, verify the proper bond documents, and make recommendation to the City for project award. The project award recommendation shall complete the Engineering work under this portion of the contract. V. TIME SCHEDULE PROPOSAL All work on this project shall be completed within 250 Calendar days from the Notice to Proceed in December, 1992. Time extension will be reviewed by the City for delays beyond the Engineer's control. The Engineer will provide to the City a detailed schedule of the necessary work elements to perform the final design. A monthly progress report will be provided to the City. VII. ACCEPTANCE AND APPROVAL Work performed under this specification shall be subject to review and examination by the Director of Public Works or his authorized representative any place where such work is being performed. The City of Pueblo shall have the right to reject inaccurate or substandard work at any time. All rejected work shall be satisfactorily correct and replaced without cost to the City of Pueblo. As soon as practical after delivery for review, all materials submitted will be checked. The Engineer shall coordinate operations to permit a reasonable and rapid check of the work by the City representative in order to assure that the accuracy and quality of workmanship comply in all aspects with the terms and provisions of this specifications. FINAL DESIGN SCOPE OF WORK PAGE 8 A final meeting will be held when all design work is completed. This will be a joint review with the City's representatives and the Engineer to discuss the design and answer questions by either party. Upon completion of the contract all materials and data used by the Engineer for preparing the design shall become the sole property of the City of Pueblo. These materials and data shall include any and all notes, computations, plans, maps, photographs and other pertinent materials. VIII. PROFESSIONAL LIABILITY INSURANCE The Engineer shall provide Professional Liability Insurance in the amount of One Million Dollars ($1,000,000) in a form, and with a deductible, acceptable to the City. IX. CONTINUATION OF WORK INTO THE CONSTRUCTION PHASE Upon satisfactory completion of the above design work, the City if desired can request a proposal from the Engineer to continue the administration and monitoring of the project during the construction period. APPENDIX "B'- FEE SCHEDULE CITY OF PUEBLO MAIN STREET BRIDGE REPLACEMENT CONTRACT COMPENSATION AND FEES: The City shall pay the Engineer for work which it performs under this Agreement in accordance with the scheduled rates for labor and expenses as shown in Exhibit 2. The Engineer agrees that its invoiced costs for completing all of the work described in the Scope of Work shall not exceed $351,642.00 Dollars as shown in Exhibit 1. It is understood and agreed that the hourly rates and reimbursable expenses shall apply for all work which the Director of Public Works instructs the Engineer to perform. The City further agrees to reimburse the Engineer for all costs incurred for work which is performed by each subcontractor at the hourly rates and the reimbursable expenses shown for each subconsultant respectively in Exhibit 3. The Engineer agrees to establish and maintain records in such form for work to be performed hereunder as the Director of Public Works or the City's Auditor may require and to make such records available to the City for any audit it deems necessary. The Engineer shall submit to the City at the end of each month a detailed statement of the total amount due for work performed during that month along with a statement of progress covering the status of the work and the percentage of the whole that has been accomplished. ADDITIONAL SERVICES: The Engineer shall also perform work, hereinafter referred to as Additional Services, which relates to the work covered by this Agreement but which the Director of Public Works determines is either not described in or exceeds the requirements in APPENDIX "B" FEE SCHEDULE PAGE 2 the Engineer's Scope of Work. If the Director of Public Works requests such work in writing or the Engineer believes that certain work should be performed which falls in this category, the Engineer shall submit a written description of such Additional Service to the Director of Public Works along with a schedule and an estimate of its cost. The Engineer and the Director of Public Works shall agree on a schedule, payment procedure and cost for each such Additional Service and the Director of Public Works shall approve such schedule, payment procedure and cost in writing before work begins. The Engineer shall be paid for approved Additional Services as a lump -sum fee if the parties have agreed to a lump -sum fee for completing the service. If no lump -sum fee has been agreed upon, Engineer shall be paid based upon the hourly rates for personnel and expenses to perform the service which are shown in the hourly rate schedules that are located in Exhibit 2. If this payment procedure is used, Engineer shall submit to the City monthly invoices for the work performed. Services rendered by the Engineer during any period of extended delay or stoppage of the Program which is not the fault to the Engineer shall be paid for and may, at the option of the City, be charged as an Additional Service.
