A RESOLUTION ADOPTING A RESIDENTIAL ANTIDIS-
PLACEMENT AND RELOCATION ASSISTANCE PLAN UNDER
THE CITY OF PUEBLO'S HOME INVESTMENT PARTNER-
SHIP PROGRAM
WHEREAS, the City of Pueblo is a recipient of federal
financial assistance and participating jurisdiction pursuant to
the HOME Investment Partnership Program; and
WHEREAS, it is a requirement of the HOME Investment Partner-
ship Program and Section 220 of the Housing and Community Develop-
ment Act of 1992 (HCDA) that a participating jurisdiction certify
under its 1994 Comprehensive Housing Affordability Strategy (CHAS)
that it is following a residential antidisplacement and relocation
plan ( "Plan ") equivalent to the plan required by the CDBG Program
under Section 104(d) of the Housing and Community Development Act
of 1974; and
WHEREAS, by Resolution No. 6324, City Council has heretofore
adopted a Plan in connection with its use of CDBG funds; and
WHEREAS, before obligating or expending HOME funds for an
HCDA assisted activity that will directly result in demolition or
conversion of low /moderate- income dwelling units to another use,
the City of Pueblo must adopt a Plan and conduct such activities
in conformance therewith; and
WHEREAS, City as a recipient of HOME funds may provide
relocation payments and assistance to certain persons in
connection with activities subject to the Uniform Relocation
Assistance and Real Property Acquisition Policies Act of 1970
(URA) (42 U.S.C. 4601); NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1
The City of Pueblo, subject to availability of funds and
subject to budgeting and appropriation of funds in accordance with
law, hereby adopts the Antidisplacement and Relocation Assistance
Plan, attached hereto as Exhibit "A" and incorporated herein by
reference, as the policy of the City of Pueblo in compliance with
requirements of Section 220 of the Housing and Community Develop-
ment Act of 1992.

Nothing in this Resolution is intended to, nor shall it be
construed as, any repeal of the provisions of Resolution No. 6853,
it being the intention of the City Council that the Antidisplace-
ment and Relocation Assistance Plan adopted herein be supple-
mentary to the Relocation Policies and Procedures adopted by
Resolution No. 6853.

I have reviewed the draft resolution you provided
relating to the above matter and recommend some revisions.
Enclosed for your use is the original of a revised Resolu-
tion for your consideration and use.

CITY OF PUEBLO'ANTIDISPLACEMENT
AND RELOCATION ASSISTANCE PLAN
The City. of Pueblo will replace all occupied and vacant occupiable low /moderate - income
dwelling units demolished or converted to a use other than as low /moderate- income housing
as a direct result of activities assisted with funds provided under the Housing and
Community Development Act of 1974, as amended, as described in 24 CFR 570.606(b)(1).
All replacement housing will be provided within three years of the commencement of the
demolition or rehabilitation relating to conversion. Before obligating or expending
funds that will directly result in such demolition or conversion, the City of Pueblo will
make public and submit to the HUD Field Office the following information in writing:
1. A description of the proposed assisted activity;
2. The general location on a map and approximate number of dwelling units by size
(number of bedrooms) that will be demolished or converted to a use other than as
low /moderate- income dwelling units as a direct result of the assisted activity;
3. A time schedule for the commencement and completion of the demolition or conversion;
4. The general location on a map and approximate number of dwelling units by size
(number of be- drooms) that will be provided as replacement dwelling units;
5. The source of funding and a time schedule for the provision of replacement dwelling
units; and
6. The basis for concluding that each replacement dwelling unit will remain a low/
moderate- income dwelling unit for at least 10 years from the date of initial occupancy.
The City of Pueblo will provide relocation assistance, as described in 570.606(b)(2),
to each low /moderate - income household displaced by the demolition of housing or by the
conversion of a low /moderate - income dwelling to another use as a direct result of
assisted activities.
Consistent with the goals and objectives of activities assisted under the Act, the City
of Pueblo will .take the following steps to minimize the displacement of persons from
their homes:
1. Formulate a phased relocation program which will enable the City to proceed in a
manner designed to minimize inconvenience to families expected to be relocated.
2. Provide an information program which will keep the City, and in particular, any
affected persons, advised of relocation activities on a continuing basis.
3. Assist in relocating all families and individuals into Housing that is decent,
safe and sanitary, within their financial means, in reasonably convenient locations,
and with a minimum of hardship.
