HomeMy WebLinkAbout7061"As Amended 1/25/93" RESOLUTION NO. 7 0 61 A RESOLUTION OF THE CITY COUNCIL OF PUEBLO, COLORADO, ADOPTING THE CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FINAL STATEMENT OF OBJECTIVES AND ACTIVITIES FOR 1993 AND AUTHORIZING THE CITY MANAGER TO SUBMIT THE FINAL STATEMENT AND OTHER NECESSARY DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT TO OBTAIN APPROXIMATELY $1,887,000 IN FEDERAL CDBG FUNDS WHEREAS, the City of Pueblo, hereinafter called City, is designated as an entitlement city under the Housing and Community Development Act of 1974, as amended through 1990; and WHEREAS, the City held a public hearing on November 9, 1992, to obtain the views of citizens on the City's housing and community needs; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: Section 1. The City Council hereby declares the City of Pueblo's Community Development Program has been developed so as to give maximum feasible priority to activities which will benefit low- and moderate - income families and /or aid in the prevention or elimination of slums and blight. Section 2. The City Council hereby adopts the attached Community Development Block Grant Final Statement of Objectives and Activities for 1993, which attachment is made a part of this Resolution. Section 3. The City Manager is hereby authorized and directed to submit the Final Statement of Objectives and Activities for 1993, together with the other necessary documentation, including the required assurances, to the U. S. Department of Housing and Urban Development for approximately $1,887,000 in Federal Community Development Block Grant funds and to affix his signature thereto. Rather than have HUD question our Final Statement, because of a large projects to be determine account, as passed by City Council, on January 25, 1993, I will submit the final statement by classifying an account on the final statement as "Reserve for Senior Center Bid" in the amount $205,474. The actual amount to be allocated under the Final Statement for the Senior Center will be $100,000. I feel this will better meet the spirit of the attached HUD directive and meet City Council's intent. Once the Senior Center bid comes in City Council will then determine what to do with this reserve by formal resolution. In tracking these funds in subsequent Grantee Performance Reports, we have found cases where "contingency funds" have been used to fund new activities for which the required citizen participation and amendment requirements have not been fulfilled. We would therefore like to clarify the appropriate use and 1b reporting of "contingency funds" in connection with eligible CDBG activities. Prior to 1981, section 104(b)(1) of the statute did permit grantees to use 10 percent of their annual entitlement for local option activities. In 1981, amendments to the statute removed this provision. Furthermore, the 1983 amendments added a new provision at section 104(a) requiring grantees to provide citizens an opportunity to comment on substantial changes to the annual program of activities. (Clearly, the addition of a new activity would be a substantial change.) This new requirement makes the co of local option activities, which by their nature are not subject to citizen cou&6nt, contrary to the amended Act. Although grantees may no longer budget funds for local option activities, they may set aside small amounts of "contingency funds" for potential cost overruns for activities described in the Final Statement. It is important to recognize that "conti ngency funds" may not be used to, in effect, maintain a "local option" fund. Although the CDBG regulations do not contain any cost limitations regarding funds budgeted under this category, the amount should be reasonable in relation to the cost of the activity. r. 14 If any contingency amounts have not been budgeted for a specific activity by the end of the program year, they should be shown on the Activity Summary form (HUD 4949.2) of the Grantee Performance Report. Specifically, they should be identified as "Unprogrammed Funds" in column (b) and the amount of these funds entered in column (j). We wish to emphasize that contingency funds may not be used for activities not listed in the Final Statement, unless applicable citizen participation requirements are followed and an amendment to the Final Statement is submitted to HUD. Please provide copies of this guidance to all entitlement grantees within your jurisdiction and to all CPD staff responsible for reviewing Final Statements and /or Grantee } Performance Reports. 4 . CDBG funds are intended to provide decent housing, suitable living erMronment and economic opportunities, principally for law— and moderate — income persons through rehabilitation and preservation, economic/job development and public facilities improvements. It is estimated that approximately $1,887,000 in CDBG funds will be received by the City of Pueblo in 1993, and program Income from Housing Loan paybacks of approximately $ 106,000.
