WHEREAS, the Americans with Disabilities Act was signed into Law on July 26, 1990; and WHEREAS, the U.S. Department of Transportation published final Regulations implementing certain provisions of the Act on September 6, 1991; and WHEREAS, the Department of Transportation Regulations requires that Public entities that operated fixed route transportation services for the general public also provide complementary Paratransit Service; and WHEREAS, the Plan was subsequently approved and determined to be "in Compliance" by the Federal Transit Administration on September 8, 1992. WHEREAS, the Department of Transportation Regulations require a complementary Paratransit Service Plan to be updated and recertified annually. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The City of Pueblo adopts and certifies that the Paratransit Service Plan of the Americans with Disabilities Act as being in compliance with the Act. SECTION 2. The President of City Council be, and she is authorized to execute the certification of the Plan on behalf of Pueblo, a Municipal Corporation and the Pueblo Transportation Company, and the City Clerk shall affix the Seal of the City thereto and Attest the same. It was signed into law on July 26, 1990. The purpose of the act is to "provide a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities." The ADA seeks to assure equal opportunity, full participation, independent living and economic self- sufficiency for persons with disabilities. It is not an affirmative action statute. Rather, it seeks to achieve these objectives by prohibiting covered entities from excluding people from jobs, services, activities or benefits based on disability. On September 6, 1991, the U.S. Department of Transportation (USDOT) published final regulations implementing certain provisions of the Americans with Disabilities Act of 1990 (ADA). Included in these regulations was a requirement that public entities operating fixed route transportation service for the general public also provide complementary paratransit service to persons unable to use the fixed route system. The regulation specify: when this service is required; eligibility criteria for these paratransit services; the level of service which must be provided; and, standards for certain aspects of operation. The regulations also require that a plan be updated and submitted to the Federal Transit Administration on January 26, 1993. The original ADA Paratransit Plan was approved and adopted by the Pueblo City Council on December 23, 1991, and certified by the Pueblo Area Council of Governments the Pueblo Metropolitan Planning Organization on December 19, 1991. The ADA Paratransit Plan was then submitted to the Federal Transit Administration within the required timetables and subsequently approved and "in Compliance" on September 8, 1992. The City of Pueblo's Department of Transportation, Urban Transportation Planning Division has provided this Paratransit Service Plan update to fulfill the obligation set forth. I. IDENTIFICATION OF SUBMITTING ENTITY The responsible entity submitting this plan is the City of Pueblo and the Pueblo Transportation Company. The responsible official for ensuring compliance with the Americans with Disabilities Act Plan is City Manager, Lewis Quigley. The City Department of Transportation Director, Donald J. Saling will monitor compliance with all aspects of this plan and will be the contact person. Comments to be received by: Mr. Donald J. Saling Director of Transportation 350 South Elizabeth Street Pueblo, Colorado 81003 (719) 545 -5840 (office) (719) 545 -0934 (fax number) As per Section 49 CFR 73.139(h) the City of Pueblo submits Attachment A, an updated Metropolitan Planning Organization (MPO) Certification that the Pueblo Area Council of Governments, as the MFO has reviewed, and also a Resolution by the Pueblo City Council certifying that the Plan is in conformance with ADA Legislation. I1. PROGRESS REPORT ON MILESTONES The planned comparable paratransit service in Pueblo sponsored by the Pueblo Transportation Company, known as "Citi- Lift ", has progressed rapidly in FY 1992. As illustrated in Table 1, the milestones set for completion in the original plan called for full paratransit service within a 3/4 mile radii of existing fixed route service. The PTC has accomplished this milestone and initiated a wider service area of the community, and the specialized transit service is being provided in the entire Pueblo City limits. This milestone has been accomplished in FY 1992. Another milestone also completed during the last quarter of FY 1992, was the approval by the Pueblo City Council to increase the "Citi -Lift" fare from $.25 cents to $1.00 per trip to eligible clients starting January 1993. Public Hearings were conducted as per Section 37.137 and minutes are included in the public participation section of this document. The Pueblo City Council has also given their approval for the purchase of the new accessible vehicles for service expansion of the paratransit service in FY 1993. This milestone was scheduled for completion on January 1994. It is City of Pueblo's intention to reach this objective one -year prior to the projected completion date. Vehicle specifications will be completed and Request for Proposals will be solicited in the Spring of FY 1993. Consequently, the vehicles should be in revenue service during the last quarter of FY 1993. -1- The City will also implement and comply with Sunday calls for Monday service in January 1993 by having a dispatcher on duty seven days a week to accept calls. This milestone was originally scheduled for July 1995. With the accomplishment of the aforementioned milestones, it is the intention of the City of Pueblo to be in full compliance with ADA Legislation by January 1, 1994. Please see Table 2 for revised five year service plan and implementation time table. III. DEMAND ESTIMATE Table 3 is a demand forecast of ridership for ADA complementary paratransit service utilizing the Federal Transit Administration methodology. O - F- U O F- F- F w H r--r N M -cr to to TABLE 5 I N V. - PUBLIC PARTICIPATION During FY 1992, the City of Pueblo /Pueblo Transportation Company conducted numerous Transit Advisory Committee (TAC) Meetings to discuss the operations of the Citi -Lift Paratransit Service. The meetings were conducive to information sharing and opportunities for comments for the improvement of service. Advisory members also recommended an increase in fares for clients using the Citi -Lift Service, City Council and the T.A.C. authorized staff to proceed with soliciting public comments. The PTC conducted two Public Hearings in FY 1992. The PTC advertised the hearings in the local newspaper and also mailed notices to all Citi -Lift clients notifying them personally about the hearings. The hearings were held on October 28, 1992 to receive comments from the public on the proposed increase. Based on comments received, a resolution was drafted detailing the proceedings (See Attachment B) of the hearings and a recommendation for the increase in fares beginning January 1, 1993. Consequently, City Council reviewed and adopted the Resolution on the fare increase on November 23, 1992. VI. UNRESOLVED ISSUES After initial review by the Federal Transit Administration of the 1992 Plan, the PTC received as "in compliance" review correspondence (See Attachment C). Currently, the PTC does not have any unresolved issues. VII. OTHER ISSUES The PTC has experienced 2 1/2 years of contracted paratransit service from June 1, 1990 - December 31, 1992. The initial Request for Proposal (2 1/2 year contract) was awarded to the Pueblo Senior Citizen Resource Development Agency, Inc. (SRDA) who throughout the term of the contract performed exemplary. During FY 1992, the PTC advertised and accepted RFP's for the Citi -Lift Paratransit Service for the period of January 1, 1993 to December 31, 1994. Three (3) firms submitted proposals and the PTC recommended to the Pueblo City Council that SRDA should perform the specialized service for two more years. The Pueblo City Council awarded the Contract to S. R.D.A. on November 23, 1992. Consequently, the continuity of a seasoned service provider shall remain in the hands of an experienced provider with limited disruption of service to the disabled community. m ATTACHMENT A ATTACHMENT A MPO CERTIFICATION PARATRANSIT SERVICE The Pueblo Area Council of Governments (PACOG) as the Metropolitan Planning Organization (MPO) hereby certifies that it has reviewed the ADA Paratransit Plan prepared by the City of Pueblo Urban Transportation Planning Division as required under 49 CFR Part 37.139(h) and finds it to be in conformance with the transportation plan developed under 49 CFR Part 613 and 23 CFR Part 450 (the FTA /FHWA Joint Planning Regulation). RECOMMENDATION: Staff recommends adoption and certification that the updated plan is in compliance with the requirements of the Americans with Disabilities Act. BACKGROUND: On July 26, 1990, the Americans with Disabilities Act (ADA) was signed into law. The stated national goal include assuring that persons with disabilities have equality of opportunity, a chance to fully participate in society, are able to live independently, and can be economically self- sufficient. A substantial part cf this legislation addressed transportation provided by public entities. Paramount to public entities is the requirement that those entities which provide fixed route public transportation service also must offer comparable paratransit service. On December 23, 1991, the Pueblo City Council approved and adopted the paratransit service plan of the Americans with Disabilities Act for FY 1992. The Plan was subsequently approved and determined to be "in Compliance" by the Federal Transit Administration (FTA) on September 8, 1992. A requirement of this legislation is to updated each plan annually and to include any significant changes and revisions to the timetables for implementation. Each entity must also update the achievements of projected milestones and any slippages that have occurred in the Plan throughout the year. Also, included within the requirement is to submit this updated plan by January 26, 1993. Through City Councils direction and cooperation, the City of Pueblo /Pueblo Transportation Company will have met all requirements and milestones in FY 1993 and be in total compliance by January 1994, two years ahead of schedule. WHEREAS, the Americans with Disabilities Act was signed into Law on July 26, 1990; and WHEREAS, the U.S. Department of Transportation published final Regulations implementing certain provisions of the Act on September 6, 1991; and WHEREAS, the Department of Transportation Regulations requires that Public entities that operated fixed route transportation services for the general public also provide complementary Paratransit Service; and WHEREAS, the Plan was subsequently approved and determined to be "in Compliance" by the Federal Transit Administration on September 8, 1992. WHEREAS, the Department of Transportation Regulations require a complementary Paratransit Service Plan to be updated and recertified annually. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The City of Pueblo adopts and certifies that the Paratransit Service Plan of the Americans with Disabilities Act as being in compliance with the Act. -14- SECTION 2. The President of City Council be, and she is authorized to execute the certification of the Plan on behalf of Pueblo, a Municipal Corporation and the Pueblo Transportation Company, and the City Clerk shall affix the Seal of the City thereto and Attest the same. Council Agenda ATTACHMENT B Title: : CITI -LIFT FARE INCREASE Agenda Item # Department: ISSUE: PUEBLO TRANSPORTATION COMPANY Date: November 3, 1992 RECOMMENDATION: Should City Council raise the Passenger Fares for Citi -Lift Transportation Services to $1.00 each way and the Monthly Pass Fee to $18.00. Staff recommends the fares be increased. BACKGROUND: Since its inception in June of 1990, Citi -Lift has been a very expensive service. Currently for every dollar the Pueblo Transportation Company expends for Citi -Lift, it recovers 3.95 cents. The enabling legislation that set up our Citi -Lift Program (Section 504 of the Rehabilitation Act of 1973) mandated that our fares be comparable to our fixed route system (.25 cents). Now under the Americans with Disabilities Act of 1990, we have been given the flexibility of increasing those fares to twice our regular fixed route rate (.50 cents). With an increase to _$1.00 per trip it is projected that the expense to revenue ratio will increase to 15.30 cents for every dollar spent. Currently our fixed route system recovers 20.07 cents per dollar. On October 28, 1992 we held two Public Hearings, pursuant to Federal Requirements for citizen input regarding the proposed increase. In addition, letters were sent to all registered Citi -Lift users asking for input and comments. A summary of the Public Hearings and the comments received at the Pueblo Transportation Company office are attached. FINANCIAL IMPACT: It is projected that with the proposed fee increases, farebox revenue for Citi -Lift will increase from $5,500 per year to $22,000. -16- RESOLUTION NO. A RESOLUTION AUTHORIZING THE PUEBLO TRANSPORTATION COMPANY TO INCREASE CITI -LIFT PASSENGER FARES. WHEREAS, the Pueblo Transportation Company, a wholly -owned Municipal Corporation of the City of Pueblo, currently operates "Citi- Lift ", a specialized transportation service at a deficit; and WHEREAS, the Americans with Disabilities Act of 1990 recognizes the expenses associated with this specialized transit; and Whereas, the Americans with Disabilities Act of 1990 permits the establishment of a fare for a trip charged to an ADA Paratransit eligible user not to exceed twice the fare that would be charged to an individual paying full fare; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. Section 504 stated that you could charge the same rate as what the fixed route system was. When the ADA act went into affect, it stated that you could increase the fare twice the amount of the fixed route system. In the first six months, Citi -Lift supplied 10,352 trips, received $2,701.95 in revenue and the cost to run the service was $68,392.20. For every dollar spent we receive .0395 cents in return. If the fare is increased to $1.00, we would receive .15 cents for every dollar spent. The cost to run the fixed route service is $611,000, received $123,000 in revenue which equates to .20 cents for every dollar spent. Newsletters were sent to all 892 clients certified on Citi -Lift to attend the Public Hearings. After the Hearings a recommendation is being made to City Council to increase the fare to $1.00 per trip. We have budgeted for 2 additional vans (smaller than current ones) in the 1993 budget. There will be an additional phone line added and a dispatcher on Sunday to schedule Monday's appointments. We will be issuing Photo ID Cards to Clients in 1993. DISCUSSION Anna Fujaros - Thinks the increase is steep, would like to see fare at .50 cents per trip. Opal Hankins - Praises Citi -Lift, can't drive across town for one dollar. Thinks raise is due, but will be difficult to budget on fixed income. May ride less but will still ride. Sometimes has trouble getting through on line. Katherine Gordon - Is on Social Security Income. Thinks $1.00 a trip is reasonable. Would like to see more ride consolidation. Rides approximately 5 times a month. in Public Hearing - October 28, 1992 Citi -Lift Fare Increase Don Salina - Stated that some of the problems with ride consolidation are that many passengers do not want to ride with other people, or stay on the van while they pick up other passengers. Can not prioritize trips. Norma Walker - Rides 4 time a week. Feels that Citi -Lift is life giving. She is able to go places that she would not normally be able to go, besides therapy and grocery shopping. May have to budget more and ride less, but thinks it's worth it. Clients need to make sure they are ready and waiting for van to come, tell driver where they want to be picked up. Don Salina - We are recommending that the Citi -Lift Bus Pass be increased to $18.00 per month. This will help passengers who ride often to save a little. Currently charging $9.00 for a Citi -Lift Bus Pass. Vic Velarde - There is also a problem with cancellations and "no shows ". We have anywhere from 75 to 100 cancellations a month. Some clients have 5 to 10 "no shows ". Letters are being sent to clients who repeatedly are "no shows ", giving them the opportunity to explain why they did not show up. If they do not have a good excuse, they are removed from the Citi -Lift Certification List for a month. Continued abuse could result in removal permanently. Isabel Kosmeroskv_ - Praises bus drivers, think they are wonderful. Bus passes are great to have. Joyce Lawrence - Wanted to know if we could block off times for Doctors appointments for those who need them. Don stated that we can not prioritize trips. Laurene DunlatJ - Thinks that the pass is good. Enjoys riding, this is her only means of transportation. Need to make sure when canceling that the machine gets your message. John Vecchio - Has had a few bad experiences; driver said he was there to pick him up, Mr. Vecchio was waiting and never saw the driver. Called office, boss said he was wrong, driver was there. Mr. Vecchio had 3 witnesses that said driver wasn't there. Driver finally admitted that he was at the wrong location. Drivers need to learn city streets and locations, get lost to often and makes passengers late. If person is not out waiting for van, then van should leave and go to next destination. Could improve pick ups by asking if person is visually or hearing impaired, etc. Need better service. Chris Spangler - Most drivers are courteous. Based on the documentation you have provided, the FTA has determined that your plan is in compliance with the requirements of DOT's regulation. Be advised that the ADA definition of "discrimination" includes failure to submit, or commence implementation of a plan (ADA Section 223(e). Any such failure jeopardizes your continued eligibility to receive Federal financial assistance from the FTA.
