HomeMy WebLinkAbout7005RESOLUTION NO. 7005 A RESOLUTION ESTABLISHING A COMMITTEE ON DIS- POSITION OF FORFEITED PROPERTY AND APPOINTING THE CITY COUNCIL'S REPRESENTATIVE THERETO WHEREAS, §16 -13 -701 et. seq. C.R.S. requires the prior approval for the use or expenditure of property or proceeds forfeited to the Pueblo Police Department as a seizing agency pursuant to any state or federal law, and WHEREAS, §16 -13 -702 C.R.S. creates for each seizing agency a committee on disposition of forfeited property, and WHEREAS, the composition of such committee for the Pueblo Police Department as a seizing agency shall at a minimum, include the District Attorney for the Tenth Judicial District or a designee of such person, the Chief of Police of the Pueblo Police Department, or his designee, and a representative of the City Council appointed by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: CPrTT( - )M 1 _ The City Council does hereby establish a committee on dispos- ition of forfeited property for the Pueblo Police Department as a seizing agency pursuant to g16 -30- 702(3) C.R.S. ( "Committee "). The Committee shall be composed of the District Attorney for the Tenth Judicial District or his designee, the Chief of Police or his designee, and a representative of the City Council to be appointed by the City Council. The members of the Committee shall not select other members to serve on the Committee. All seized property and proceeds shall be used for official law enforcement purposes but shall not be considered a source of revenues to meet normal operating needs of the Pueblo Police Department. gPCTTONT 7 _ Samuel Cors entino is hereby appointed as the representative of the City Council on the Committee for a term expiring October 1, 1994. QPrmTr)M Q The Pueblo Police Department shall (a) adopt policies and procedures for the expeditious release of seized property which is not subject to forfeiture pursuant to §16 -13 -301 et. seq., C.R.S. when such release is appropriate, (b) insure that forfeited property reclaimed for official law enforcement use is subject to controls consistent with controls which are applicable to property acquired by the Pueblo Police Department through the normal appropriations process, (c) conform with reporting, audit, and disposition procedures enumerated in Article 13 of Title 16, C.R.S., and (e) prohibit employees of the Pueblo Police Department from purchasing forfeited property. CG'r IP T nN1 A The Director of Finance shall cause to be reported in the City's primary financial statements concerning the acquisition, disposition and status of forfeited property and such information shall be subject to audit.
