A RESOLUTION ESTABLISHING PROCEDURES
REGARDING APPLICATIONS FOR RENEWAL OF
LIQUOR OR BEER LICENSES
WHEREAS, the Liquor and Beer Licensing Board of the City
of Pueblo has been designated by the City Council as the local
licensing authority under the Colorado Liquor Code and Colorado
Beer Code; and
WHEREAS, state law requires that applications for
renewal of liquor or beer licenses be made to the local licensing
authority at least 45 days prior to the date of expiration, and
WHEREAS, late filing of renewal applications has impeded
the processing of such applications before the license expiration
date, and
WHEREAS, the Liquor Board wishes to conform its local
renewal application procedures to the procedures used at the
state level by the Liquor Enforcement Division of the Colorado
Department of Revenue,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
PUEBLO, that:

1. Pursuant to the provisions of section 12- 47- 106(b)
of the Colorado Liquor Code and section 12 -46- 106(13) of the
Colorado Beer Code, the Liquor and Beer Licensing Board of the
City of Pueblo shall apply the following procedures to late
filings of applications for renewal of existing licenses:
(a) Whenever any licensee has failed to file an appli-
cation for renewal of an existing license with the City Clerk
not less than forty -five days prior to the date of expira-
tion, the Board through the City Clerk shall issue and cause to
be served on such licensee a notice of hearing and order to show
cause why the Board should waive the time requirement for renewal
applications and why renewal of the license should not be denied.
2. A license renewal application filed with the City
Clerk less than 45 days prior to the date of expiration shall not
extend the date of expiration unless and until license renewal
has been approved before the date of expiration at a regular
public meeting of the Board. If such a license expires before
renewal is approved, the applicant shall cease selling or serving
alcohol during the period from the date of expiration until a
license renewal has been approved by the Board.
3. Filing of a renewal application with the City Clerk
shall not constitute either acceptance or approval of such
application by the Board.
4. No application for renewal of a license shall be
accepted by the Board after the date of expiration.
SECTION 2
This resolution shall become effective immediately upon
final passage.
