A RESOLUTION ADOPTING AND APPROVING AN AMERICANS WITH
DISABILITIES ACT (ADA) TRANSITION PLAN FOR THE CITY
OF PUEBLO
WHEREAS, the Americans with Disabilities Act of 1990 (ADA) was signed into
Law on July 26, 1990; and
WHEREAS, the ADA requires that the City of Pueblo adopt by the end of July
1992 an ADA Transition Plan identifying structural changes to existing facilities
which will be undertaken to achieve program accessibility required under the ADA;
and
WHEREAS, the ADA also requires that the City of Pueblo designate one or
more ADA Coordinator; and
WHEREAS, the ADA Task Force has formulated the enclosed City of Pueblo ADA
Transition Plan, which reviews ADA requirements, analyzes structural problems,
addresses compliance issues in the personnel area, recommends structural changes
needed to comply with the ADA, and estimates the cost of such changes;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The City of Pueblo hereby adopts and approves the attached City of Pueblo
Compliance with Disability Legislation: ADA Transition Plan.

SECTION 2.
The City Manager is hereby designated as the responsible employee under 28
CFR 35.107 to coordinate the efforts of the City of Pueblo to comply with and carry
out its responsibilities under the Americans with Disabilities Act of 1990, and the
regulations promulgated thereunder, including any investigation of any complaint
communicated to it alleging its noncompliance therewith or alleging any actions
that would be prohibited thereby.
The City Manager may designate one or more individuals as the responsible
employee(s) under 28 CFR 35.107 and delegate to such person(s) the authority to
perform some or all of the functions therein required.
SECTION 3
The City Manager is hereby authorized and directed to execute any
federally required certifications that the City of Pueblo has adopted the enclosed
ADA Transition Plan.

INTRODUCTION
The Americans with Disabilities Act of 1990 is a landmark law which has been
aptly characterized as the most important social legislation since the Civil
Rights Act of 1964. Section 2(b) of the ADA provides that it is the purpose
of this Act --
1) to provide a clear and comprehensive national mandate for the
elimination of discrimination against individuals with disabilities;
2) to provide clear, strong, consistent, enforceable standards addressing
discrimination against individuals with disabilities;
3) to ensure that the Federal Government plays a central role in enforcing
the standards established in this Act on behalf of individuals with
disabilities; and
4) to invoke the sweep of congressional authority, including the power to
enforce the fourteenth amendment, and to regulate commerce, in order to
address the major areas of discrimination faced day -to -day by people
with disabilities.
The ADA contains five major parts:
Title I -- Employment
Title II -- Public Services
Title III -- Public Accommodations & Services Operated by Private Entities
Title IV -- Telecommunications
Title V -- Miscellaneous Provisions
Not every person with a disability is covered by the ADA. ADA Title II,
requires that program accessibility be afforded to each "Qualified
individual with a disability ", which term is defined in 28 CFR 35.104 to mean
"an individual with a disability who, with or without reasonable
modifications to rules, policies, or practices, the removal of architectural,
communication, or transportation barriers, or the provision of auxiliary aids
and services, meets the essential eligibility requirements for the receipt of
services or the participation in programs or activities provided by a public
entity."

I. OVERVIEW
The City of Pueblo is required to adopt an ADA Transition Plan because of the
following provisions of the regulations of the U.S. Department of Justice
implementing ADA Title II which appear at 28 CFR 35.150(d)(1):
"In the event that structural changes to facilities will be undertaken to
achieve program accessibility, a public entity that employs 50 or more
persons shall develop, within six months of January 26, 1992, a transition
plan setting forth the steps necessary to complete such changes. A public
entity shall provide an opportunity to interested persons, including
individuals with disabilities or organizations representing individuals with
disabilities, or participate in the development of the transition plan by
submitting comments. A copy of the transition plan shall be made available
for public inspection."
The following paragraph (d)(2) provides:
"If a public entity has responsibility or authority over streets, roads, or
walkways, its transition plan shall include a schedule for providing curb
ramps or other sloped areas where pedestrian walks cross curbs, giving
priority to walkways serving entities covered by the Act, including State and
local government offices and facilities, transportation, places of public
accommodation, and employers, followed by walkways serving other areas."
The following paragraph (d)(3) provides:
"The plan shall, at a minimum --
(i) Identify physical obstacles in the public entity's facilities that
limit the accessibility of its program or activities to individuals
with disabilities;
(ii) Describe in detail the methods that will be used to make the
facilities accessible;
(iii) Specify the schedule for taking the steps necessary to achieve
compliance with this section and, if the time period of the transition
plan is longer than one year, identify steps that will be taken during
each year of the transition period; and
(iv) Indicate the official responsible for implementation of the plan."
The City of Pueblo Compliance with Disability Legislation: ADA Transition
Plan represents the culmination of the City of Pueblo ADA Taskforce charter
to review disability legislation, evaluate the City's compliance, and to
develop a transition plan for improved compliance. The document is organized
in nine sections which describe the process undertaken by the City, the
recommended transition plan and timetable, the procedures for ensuring
response to concerns, and annual updates.

The City of Pueblo, primarily because of its receipt of federal and state
financial assistance, must comply with certain federal legislation, including
the following:
The Rehabilitation Act of 1973 (amended in 1974. 1977, 1988
Section 504 of this act provides that "No otherwise qualified handicapped
person in the United States shall, solely by reason of his handicap, be
excluded from the participation in, be denied the benefits of, or be
subjected to discrimination under any program or activity receiving federal
financial assistance."
In essence, the legislation and its accompanying regulations define and
forbid acts of discrimination against qualified handicapped persons (1988
amendment uses the term qualified individuals with a disability) in
employment and in the operation of services, programs and activities.
The Americans with Disabilities Act of 1990 (ADAM
ADA Title II (Nondiscrimination on the basis of disability in state and local
government services) extends the prohibition of discrimination under Section
504 of the 1973 Rehabilitation Act to all activities of state and local
governments, including those that do not receive federal financial
assistance. Section 504 requirements provide the foundation for Title II.
This document is scheduled for presentation to Pueblo City Council for review
and adoption in July 1992. Prior to this date, input from City departments
and community citizens /organizations will be sought. The final adopted
document will be on file in the designated coordinator's office and the City
Manager's office.
A Self- Evaluation of current City of Pueblo services, policies, and
practices, and the effects thereof, that do not or may not meet the
requirements of ADA Title II will be separately prepared and submitted to the
City Council for approval not later than January 1993.

11. BACKGROUND
The ADA Task Force was initiated by City Manager, Lewis Quigley during a
meeting held on April 27, 1992. Mr. Quigley introduced Victor H. Velarde as
the ADA Coordinator and requested that each City department identify a
representative to participate in the ADA Task Force. In addition to the
City representatives other ADA Task Force Members include City employees with
disabilities, resource contacts, and interested citizens with disabilities.
The purpose is to review the Americans with Disabilities Act of 1990, and all
other related federal or state legislation, to analyze its impact on City
employment, public services and facilities, and to develop the City of Pueblo
Compliance with Disability Legislation: ADA Transition Plan. The ADA Task
Force will also serve as a resource and information clearinghouse to the
community and City Council.
The ADA Task Force will continue to work through December 1992 to develop a
City of Pueblo Self- Evaluation of programs and services. The self - evaluation
is also required under Title II of the ADA, and will be presented to the City
Council for approval not later than January 1993.
The ADA Ta$k Force has analyzed the City's employment policies and public
facilities, identified deficiencies and formulated recommendations to ensure
compliance with the various disability statutes. This required several
activities:
o a review of Federal and State disability legislation to assess City
accessibility and non - discrimination policies;
o an analysis of public building and employment services accessibility
through: 1) surveying all City buildings and services; 2) reviewing
recruitment, hiring, reclassification, and reasonable accommodation
employment policies and procedures; and 3) refining and expanding
ongoing employee training on reasonable accommodation issues; and
o an expansion of community and business contacts for advisory resources
on disability matters.

IV. DESIGNATED COORDINATOR:
Until further notice, the City Manager will serve as the ADA Coordinator for
the City of Pueblo Compliance with Disability Legislation: ADA Transition
Plan and will coordinate the City's effort to comply with federal and state
disability legislation.
The ADA Coordinator or his designee, in consultation with the ADA Task Force
will be responsible to ensure ongoing notification to employees,
participants, beneficiaries and applicants, that the City does not
discriminate on the basis of disability under Section 504 of the
Rehabilitation Act, the ADA, or companion disability statutes. The ADA
Coordinator or his designee will be responsible for consideration of
disability related comments or complaints from all interested persons.
Primary Tasks of the ADA Coordinator or designee shall include:
o Analyze various disability definitions
o Analyze each of the five ADA legislative titles as to overview, issues,
needed resources, impact, recommendations
o Track amendments to ADA regulations
o Develop a long range implementation plan and department /agency protocols
o Inventory current accessibility resources, capabilities and plans
o Designate support staff on programs accessibility and reasonable
accommodation issues
o Coordinate dissemination of information through the public information
office
o Prepare cost analysis of the proactive plan
o Investigate all complaints relating to ADA issues

V. EMPLOYMENT
A. Overview
The City of Pueblo's Personnel Department's mission is to develop,
initiate and maintain pro- active programs including: ongoing
union /management relations; interpretations of contracts and
ordinances; coordination with department heads and preparation of
documentation for disciplinary hearings, negotiations and arbitrations;
affirmative action; temporary and rule of 3 employment processes;
supervisory and general training; employee relations, benefit
coordination and processing including health, dental, life insurances,
worker's compensation, retirement; classification; preparation of
salary schedule; responsible for the administration of employee
assistance programs; research and analysis, and preparation of salary
surveys.
B. Recruitment /Staffing
If the City Physician indicates that the candidate, who has been offered
employment contingent upon passing a physical or psychological
examination, can perform the essential functions of the position with a
reasonable modification of the duties, responsibilities, and activities,
a worksite analysis will be performed under the direction of the ADA
Coordinator, Director of Personnel and the affected Department Head.
The purpose of this worksite review will be to identify any
modifications which can be reasonably made to facilitate the placement
of the disabled individual. If such reasonable modifications are
identified, the affected Department shall proceed to make these
modifications. If serious financial, structural, or other concerns
arise, the ADA Coordinator, Director of Personnel, the affected
Department Head, and City Manager will meet to attempt to find a
solution. If an accommodation cannot be made, the individual shall have
full recourse through the grievance procedure.
The City of Pueblo is in compliance with the Personnel Requirements of
the ADA in the following areas:
1) Physical examinations and psychological examinations (where
required) are given only after conditional offers of employment.
2) Each Civil Service job description also has a description of the
basic physical and mental qualifications (with attached examples)
which is provided to the City physician.
3) The only information provided to the supervisor is that which is
medically necessary or needs accommodation. Other information is
kept by the City physician.
C. Training
The City has performed training in such areas as AIDS awareness. Such
training into disabilities and areas of disability will be continued.

VI. PUBLIC SERVICE /PROGRAM ACCESSIBILITY
A. Overview
Section VI of this document describes the proposed structural changes to existing
facilities identified as necessary to ensure that all public buildings owned by
the City which are used by the general public in significant numbers will be
accessible to and usable by individuals with disabilities. This section was
designed to address significant immediate accessibility needs and to provide a
proactive long range plan that will assist participation by all citizens in
various City functions.
The City of Pueblo will, wherever feasible, comply with the basic ADA
accessibility requirements through the following means allowed under 28 CFR
35.150(b) (1):
o redesign of equipment
o reassignment of services to accessible buildings
o assignment of aides to beneficiaries
o home visits
o delivery of services at alternate accessible sites
o alteration of existing facilities and construction of new facilities
o use of accessible rolling stock or other conveyances
o any other methods that result in making its services, programs or activities
readily accessible to and usable by individuals with disabilities.
New Construction and Alterations:
Each facility or part of a facility constructed or altered by, on behalf of, or
for the use of the City of Pueblo shall be designed, constructed or altered in
accordance with the requirements of 28 CFR 35.151, if the construction or
alteration was commenced after January 26, 1992. The City will follow either the
Uniform Federal Accessibility Standards or the Americans with Disabilities Act
Accessibility Guidelines for Buildings and Facilities, and any departures from
particular requirements of the chosen standard will be done in accordance with
the requirements of that section.
Communications:
As part of its ADA Transition Plan, the City of Pueblo in accordance with the
requirements of 28 CFR 35.163(a) "Information and Signage ", will ensure that
interested persons, including persons with impaired vision or hearing, can obtain
information as to the existence and location of accessible services, activities,
and facilities.

The City of Pueblo will provide signage at all inaccessible entrances to each of
its facilities used by significant numbers of the general public, directing users
to an accessible entrance or to a location at which they can obtain information
about accessible facilities. The international symbol for accessibility shall be
used at each accessible entrance of such a facility.
Section VI, (Pages 15 -24) are developed in a chart format consistent with the
City Inventory of Owned /Leased Real Property. This format allowed for
identification of all public buildings owned or leased by the City and provides a
simple mechanism for follow -up. The recommendations listed herein include cost
estimates and target completion dates.

VII. GRIEVANCE PROCEDURE
The City of Pueblo has adopted this Grievance Procedure in order to provide
prompt and equitable resolution of complaints alleging any action prohibited
by the Americans with Disabilities Act (ADA). If, due to a disability, you
feel that you are unable to participate in a program or activity that you
would otherwise qualify for, and feel that you have been denied reasonable
accommodation, please complete the attached form.
If you are unable to complete the Grievance Form, assistance will be
provided.
PROCESS
Step 1. Please complete the attached form and deliver or mail it to Lewis
Quigley, City of Pueblo ADA Coordinator, #1 City Hall Place,
Pueblo, CO 81003. Telephone: (719) 584 -0800 TDD Available.
This form is available in all City Departments. If this form is
not available or you wish to have it mailed to you, please contact
the ADA Coordinator.
Step 2. Upon receipt of the grievance form, the ADA Coordinator will
investigate the grievance /problem. You will be contacted and given
an opportunity to present relevant information. The ADA
Coordinator will also contact appropriate administrative personnel.
Step 3. The ADA Coordinator will respond to you, in writing or by
non - visual media within thirty (30) days of receipt of the
grievance form. A copy will also be sent to the involved
administrative personnel.
Step 4. If you are dissatisfied with the initial response of the ADA
Coordinator, you may file an appeal with the ADA Coordinator at the
above address within ten (10) days of the date of mailing of the
initial response. The ADA Coordinator will review the response,
the investigation, ask for additional material if required and
respond to you in writing or by non - visual media within ten (10)
days. If you are dissatisfied with this response, the ADA provides
rights of further appeal to the federal agencies which have ADA
enforcement responsibilities.
If you need assistance in this process, please contact the ADA Coordinator.
If a grievance involving the ADA has also been filed under an employee union
contract or with the Civil Service Commission, the contract or Commission

VIII. MONITORING PROCEDURES
Annual Plan Update
This plan will be submitted by July 27, 1992 and updates will be submitted
annually thereafter to report any significant changes and /or implementation
time table reviews and revisions, to include milestone accomplishments.
Public participation procedures will augment the completion of updated plans
as required.

IX. UNDUE FINANCIAL HARDSHIP /UNDUE BURDEN
This City of Pueblo is facing undue hardship /undue burden in three areas:
1) the number of curb ramps needed and the number of existing curb ramps
needing alteration in downtown Pueblo and in other areas of the City,
2) rebuilding of restrooms in Mineral Palace Park, and
3) installation of truncated domes (detectable warning devices on
corners).
The City of Pueblo understands that under 28 CFR 35.150(a)(3), it has the
burden of proving that compliance with the basic requirements would result
in such burdens. The decision that compliance will result in such burdens
shall:
1) be made by the City Manager or his designee;
2) after considering all resources available for use in the funding and
operation of the service, program, or activity; and
3) shall be accompanied by a written statement of the reasons for reaching
that conclusion.
The City of Pueblo proposes to complete the changes herein designated over
the next six years.
The City of Pueblo will be requesting approval of alternatives to truncated
domes on street corners both because of the expense involved and because of
concerns as to whether truncated domes are the best technology to accomplish
the accessibility goal.
The Director of Public Works and the City Manager have determined project
priorities for 1993 through 1999.
Total approximate cost for the projects listed herein is $456,000.

Nancy Pryor, commented that she would like to see a portable microphone
system made available in Council Chambers.
Vic Velarde, ADA Coordinator stated that Braille copies of the Paratransit ADA
Plan will be made available to the National Federation of the Blind. He also
stated that once the plan was reviewed and approved by City Council that
copies of the plan will be available to anyone interested if they call.
George Florom, ADAPT, wanted to know how much lead time was needed if someone
needed an interpreter at a meeting. Vic Velarde stated that approximately 48
hours would be a good time frame.
Vic Velarde stated that the National Federation of the Blind was holding a
meeting July 25th to discuss the City Transition Plan and he would attend to
answer any questions. Vic will then submit their ideas to John Scorge, City
Attorney. If need be, an addendum would be added to the Plan, as the Plan
will be printed and approved by that date.
Questions from Kay Howard, President National Federation of the Blind through
Treva Bright: Clarify on Page 7 'if AIDS Training if disease oriented or
other. Also, are the pay phones at the airport accessible to the visually or
hearing impaired? Beth Vega stated no, but that a disabled person could get
assistance at the ticket window. If a person were hired by the City who was
visually impaired, would they be provided with some sort of directory
assistance to make phone calls. Yes, this would be provided.
National Federation of the Blind would like to see the Grievance Procedure
(Page 24) changed to state that any grievance can be made "in writing or by
non - visual media."
How would a blind person know about the Grievance Procedure? The Procedure
could be made accessible through the NFB, by either having someone read it to
them or in Braille.

A RESOLUTION ADOPTING AND APPROVING AN AMERICANS WITH
DISABILITIES ACT (ADA) TRANSITION PLAN FOR THE CITY
OF PUEBLO
WHEREAS, the Americans with Disabilities Act of 1990 (ADA) was signed into
Law on July 26,1990; and
WHEREAS, the ADA requires that the City of Pueblo adopt by the end of July
1992 an ADA Transition Plan identifying structural changes to existing facilities
which will be undertaken to achieve program accessibility required under the ADA;
and
WHEREAS, the ADA also requires that the City of Pueblo designate one or
more ADA Coordinator; and
WHEREAS, the ADA Task Force has formulated the enclosed City of Pueblo ADA
Transition 'Plan, which reviews ADA requirements, analyzes structural problems,
addresses compliance issues in the personnel area, recommends structural changes
needed to comply with the ADA, and estimates the cost of such changes;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The City of Pueblo hereby adopts and approves the attached City of Pueblo
Compliance with Disability Legislation: ADA Transition Plan.

Mr. Quigley thanked everyone for attending and explained that the City needs to
begin the process to come in compliance with the Americans with Disabilities Act
(ADA). Every City department which is affected by this Act needs to do the
necessary things which will abide by this law.
Lew also stated he has asked Vic Velarde to organize this process and work with
every department as a contact person to make sure City departments get into and
stays in compliance with the ADA Compliance Guide.
Mr. Velarde gave a brief presentation stating that he has been in contact with the
ADA Representatives and they will report back to him if the City is required to
provide plans for individual departments or the City as a whole. Mr. Velarde will
keep in touch with Mr. Quigley as to the departments progress and upkeep.
It was stated that the City is and has been in compliance with the 504 Handicapped
Requirements, therefore should be pretty close to being in compliance with the ADA
with only minor changes.
A brief discussion was held referring to the Transportation Department's Plan which
was prepared by Rick Valdez and Don Saling. A copy of the ADA Compliance Guide is
available in the City Manager's Office for those who are interested in reviewing
them. Vic reported that the timeliness to be in compliance are important, as there
are suits currently being filed in court for corrections.
It was brought up that job descriptions will also need to meet the requirements,
however Beth Vega reported that the City is in good shape and stated that our
current job descriptions did not need to be re- written.
Mr. Clint Tawse, Executive Director of the Regional Building Department explained
that along with various other cities, they are taking a "hands -off attitude" and
will continue current building regulations as normal, which include handicapped
regulations for new construction. It was stated that any new public building
construction must meet ADA Requirements.
All departments are to contact Vic Velarde in order to form a task force type of
group to get the City in total compliance with the ADA and also to clarify
specifically which departments are affected by these requirements. This committee
is to compose one total plan for all City Departments.

Tony Berumen stated the City needs to update the current 504 Plan as soon as
possible. The updates need to come from the Parks Department, Public Works and the
Housing Department. All updates need to be sent to the Personnel Department.
Mr. Quigley asked Don Saling if the citizens group they used for their plan would
be interested in assisting the City in composing the City's overall plan and he
stated that he would ask and report back to either Lew or Vic.
Beth Vega expressed her concerns for departments not to commit to something that
they cannot do unless it is a requirement.
Various classes on how to comply with ADA requirements were discussed. There are
many organizations putting this type of class on and if any representatives from
the City wish to attend they should be careful that it covers the information which
will assist in getting the City departments in compliance.

Handed out sections of an ADA Plan obtained from Virginia for review. This is
the type of format that the City will use for its ADA Plan.
Resource Contact Members will oversee the task force and tour
facilities /buildings for accessibility and attend meetings to give input.
Beth Vega and Dennis Maroney will be key members of the task force, since they
will oversee Personnel and Buildings. Part of Beth's overview in personnel will
state that all City buildings that hire employees will accommodate special needs
employees hired with a disability at the time of hire.
Task Force will need to get a complete listing of all City Buildings, then
complete accessibility evaluations on the buildings and list any deficiencies
found. All buildings that are accessible to the public will need to meet ADA
Requirements. Dennis will obtain list of buildings and then meet with Vic next
week to discuss which buildings are accessible to the public. They will then
contact the person who will complete the accessibility evaluation and return to
Dennis or Vic. All public used buildings should be in compliance by January 1,
1995 unless a waiver is requested because of undue financial burden. All new
buildings or renovations will have to meet compliance immediately.
Minor changes to buildings will include, telephones, fountains, parking
standards, restrooms and TDD Systems. Dennis' self evaluation should be
completed as soon as possible, which will tell the person doing the accessibility
study what corrections need to take place. This will make it easier for the
person doing the final inspection.

Updates will be sent to each department as they are completed /available.

Question was raised about the Airport Museum. Does it fall under the City?

the Summary Sheet for review.
Dennis will get a detailed Transportation Ordinance on Parking from Dan Centa.
Beth has the 504 Plan on City Hall. Need to check to see if it is updated.
The Resource Contacts will tour some of the buildings for accessibility and for
their comments and ideas.
Vic will look up the "Reasonable Accommodations Clause" for its interpretation of
what are reasonable accommodations.
There are currently 59 buildings that self - evaluation forms should be completed
for accessibility. We still need a list of Airport Buildings.

Jim Duff stated that on Page 8, Employment Issues - pg. 2 of 2, there are
no responses to the last two items. Virginia stated that these are
"ongoing training issues ". This will be placed in the plan. Also stated
that we should use titles instead of names. In some instances, names
should be used to identify who will be performing the function.
Virginia Mitzner stated that on Page 4, Steve Bolton should be listed as
Civil Service, not Personnel.
Vic Velarde stated that City Attorney, John Scorge will be reviewing and
making changes to the Plan.
Nancy Pryor stated that on the last page, Paratransit Advisory Board, Alice
Bouy is no longer with Goodwill and her phone number is 564 - 1133..
Nancy Pryor and George Florom went on tours of buildings with Dennis
Maroney to identify problem areas.

ITEMS DISCUSSED:
ADA Transition Plan was reviewed by Members of the Paratransit Advisory Board and
Task Force Members.
City Attorney, John Scorge will be finalizing the Plan after the Public Hearings.
After the Transition Plan is completed, anyone interested in obtaining copies can
call Vic.
The City of Pueblo Transition Plan is a separate plan from the Paratransit Plan.
Members of the blind community were given two copies of the Transition Plan for
their input. They will meet, then will give their input at a later date.
George Florom stated that he and Nancy went on tours of the buildings with Dennis
Maroney and it was determined that the Curb Cuts /Ramps are the most important items
since many are old, too steep or in bad shape. He also stated that the blind
community should have input as to the marking of curb cuts /ramps. Vic stated that
the detectable warning devices are dangerous in the winter and should be evaluated.
Beth Vega discussed the personnel section and stated that she was going to redo
parts of it. Vic recommended that she give her changes to John Scorge,
Tom Cvar discussed the cost factors and whether all items can be completed with
current budget restraints. Vic stated that these were going to be prioritized with
Lew Quigley and a decision will be made after the plan is completed.
