A RESOLUTION ACCEPTING AN EASEMENT FROM
LIGHTHOUSE BAPTIST CHURCH OF PUEBLO
WHEREAS, Lighthouse Baptist Church of Pueblo, a Colorado Non - profit
Corporation, on February 20, 1992, granted an easement to the City of Pueblo;
and
WHEREAS, such easement is necessary to construct a drainage channel
across the property located on the west side of Montezuma Road and 20th Street, and has
been approved as to form by the City Attorney; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
The easement granted by Lighthouse Baptist Church of Pueblo, a Colorado
Non - profit Corporation, dated February 20, 1992, which easement is on file with the
City Clerk, is hereby approved and accepted.

BAPTIST CHURCH OF PUEBLO, a Colorado nonprofit
(Grantor), to PUEBLO, a Municipal Corporation
WITNESSETH:
IN CONSIDERATION OF $10.00 and other good and valuable
consideration, receipt of which is acknowledge, GRANTOR grants to
GRANTEE, its successors and assigns, a 20 foot drainage easement
in, through, over, under and across GRANTOR'S property located on
the west side of Montezuma Road at 20th Street, Pueblo, Colorado.
This easement is located in Pueblo County, Colorado, and is
described in attached Exhibit " A " (the Property).
GRANTOR covenants and warrants that GRANTOR is the owner in
fee of the property, has good and lawful right to convey the
property, and the property is free and all liens and encumbrances
except a deed of trust to Full Gospel Outreach, Inc., a Colorado
Nonprofit Corporation, recorded in Book 2476 at Pages 338 to 343
of the records of the Pueblo County Clerk and Recorder, and the
beneficiary of such deed of trust has consented to granting that
this easement.
GRANTOR covenants that it, and its successors or assigns, will
continuously maintain and repair this easement, and the facilities
in the easement, at its expense.
GRANTOR will indemnify and hold harmless GRANTEE from all
claims, expenses, liabilities, loss or damage to property or injury
to or death of persons, caused by the construction, installation,
maintenance or use of this easement.
This easement shall be binding upon and inure to the benefit
of the parties and their successors and assigns.

EXHIBIT "A"
A tract of land located in a part of Section 25, Township
20 South, Range 65 West of the 6th P.M., describing the
center line of a twenty (20) foot drainage easement. Com-
mencing at the NW corner of said Section 25; thence N 89
29'-11" E, a distance of 962.38 feet, said point being the
NE corner of Lot 1, Block 1, Lighthouse Baptist Church Sub-
division, Filing No. 1; thence S 0 00' -00" W, a distance
of 386.63 feet to the POINT OF BEGINNING: thence N 89
11" E, a distance of 337.50 feet more or less to the point
of TERMINUS, said point lying on the west right -of -way line
of Montezuma Road.
