A RESOLUTION REFERRING COLLECTIVE BARGAINING
MATTERS TO A VOTE OF THE QUALIFIED ELECTORS OF
THE CITY AT THE GENERAL MUNICIPAL ELECTION TO
BE HELD NOVEMBER 5, 1991 PURSUANT TO SECTION
8 -14(k) OF THE CHARTER
WHEREAS, the City of Pueblo and the International Association
of Fire Fighters Local No. 3, the International Brotherhood of
Police Officers Local 537, and the Pueblo Association of Govern-
ment Employees, which are the three unions which represent the
classified employees of the City, have not reached agreement on
contracts to replace the present contracts which will expire
December 31, 1991, within the time limits set by the City Charter;
and
WHEREAS, the City Charter requires that such impasse be
submitted to a vote of the people at an election held for such
purpose; and
WHEREAS, the City's 1991 annual average cost for salary and
the following benefits provided to typical classes of employees in
this bargaining unit with the City wide average of thirteen years
of service is:

WHEREAS, in addition to the above salary and benefits, each
employee in the PAGE bargaining unit with 10 to 15 years of
service is entitled to: paid leave each year consisting of 18 days
vacation, 10 days of paid holidays, 2 days paid personal leave, 18
days paid sick leave with an accrual of 200 days; overtime compen-
sation of one and one -half times regular salary; call back
compensation; one year injury leave with full salary and benefits;
and, if applicable, 6 days paid funeral leave, paid union business
leave, military leave, and educational incentives; and
WHEREAS, in addition to the above salary and benefits, each
police officer in the bargaining unit with the departmental
average of thirteen years of service is entitled to: paid leave
each year consisting of 18 days vacation, 10 days additional
vacation in lieu of holidays, 2 days personal leave, 18 days sick
leave with an accrual of 190 days; overtime compensation of one
and one -half times regular salary; call back compensation; one
year injury leave with full salary and benefits; and, if appli-
cable, 4 days paid funeral leave, paid union business leave,
military leave, and educational incentives; and
WHEREAS, in addition to the above salaries and benefits, each
fire fighter in the bargaining unit on a twenty -four hour shift
schedule with the departmental average of thirteen years' service
is entitled to: paid leave each year consisting of 8 twenty -four
hour shifts vacation, 6 twenty -four hour shifts additional leave
in lieu of holidays, 8 -1/2 twenty -four hour shifts sick leave with
an accrual of 84 twenty -four hour shifts; overtime compensation of
one and one -half times regular salary; call back compensation; one

year injury leave with full salary and benefits; and, if applica-
ble, paid funeral leave, paid union business leave, military
leave, and educational incentives; and
WHEREAS, the City Council finds and determines that the
salaries and other benefits payable to members of the classified
service are fair and reasonable; and
WHEREAS, the PAGE union has submitted a final written
proposal which purports to provide for no wage increase, but which
in fact requires substantial additional expenditures and limita-
tions on management of the City work force; and
WHEREAS, the police officers' union has accepted the
arbitrator's recommendation for a 4% salary increase January 1,
1992, plus another 4% salary increase January 1, 1993, plus a
reopener on wages for 1994, plus increased City contributions
toward the cost of health and dental insurance; and
WHEREAS, the fire fighters' union has accepted the arbitra-
tor's recommendations for a 5.6% salary increase January 1, 1992,
a change in the language on health insurance contributions; and a
one year contract; and
WHEREAS, the 1992, 1993 and 1994 budgets for the City of
Pueblo will require substantial expenditures in all areas of
essential public services, capital expenditures, and economic
development; and
WHEREAS, three year contracts with all three employee unions
will eliminate the time, turmoil and expense which otherwise would
be involved in the negotiation and arbitration process each year;
and

WHEREAS, the City Council finds that for all of the above
reasons, fiscal responsibility requires that the City's final wage
and benefit proposal for calendar years 1992, 1993 and 1994 to the
three classified employee unions be limited to a continuation of
the City's insurance contributions under the present formulas
contained in each contract, with a cap on City contributions at
present levels in each contract, and a salary increase of $105 per
month payable as a $25 per month increase in January 1992, a $35
per month increase in January 1993, and a $45 per month increase
in January 1994; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

The final written proposals and recommendations of arbitra-
tors are hereby referred to a vote of the qualified electors of
the City at the general municipal election to be held Tuesday, the
5th day of November, 1991, pursuant to Section 8 -14(k) of the
Charter.

There is hereby submitted to a vote of the qualified electors
of the City of Pueblo at said general municipal election the
following proposals: (a) Police Officers -- the arbitrator's
recommendations of August 1991, which recommendations were
accepted by the Union, and the final written proposal of the City
made not less than 10 days prior to the start of advisory arbitra-
tion proceedings, (b) Fire Fighters -- the arbitrator's recommen-
dations of August 1991, which recommendations were accepted by the
Union, and the final written proposal of the City of Pueblo made

The City Council hereby finds and determines that voting
machines are not available for said general municipal election.
The votes on the proposals shall be registered by the use of an
electronic voting system which will permit each qualified elector
to record his or her vote.
SECTION 4
The election shall be held during the same hours and polling
places as the general municipal election and shall be conducted
and the returns thereof made in the same manner and by the same
officers of elections who act in like capacity at the general
municipal election. Votes cast at the election shall be canvassed
and the results ascertained, determined and certified in the same
manner and at the same times and by the same officials who perform
like functions at the general municipal election. The City Clerk
and other City officials who are required to conduct elections,
make publication and give notice in respect of the submission of
any proposal to the electors at a general municipal election shall
give all requisite notices and make all requisite publication of
the proposals hereby submitted to a vote of qualified electors of
the City of Pueblo at said municipal election at the same time and
in the same manner as the general municipal election.
SECTION 5.
The proposals submitted to a vote of the qualified electors
of the City of Pueblo will be in substantially the following form:
POLICE OFFICERS
(Vote For Only One Of The Following Proposals)
PROPOSAL NO. 1. Arbitrator's recommendations accepted by the
International Brotherhood of Police Officers, Local 537, which
generally provide:
4% annual salary increase on January 1, 1992; additional 4%
salary increase on January 1, 1993; increase City contribu-
tion toward health insurance premiums by $7.50 per month
single and $10.00 per month family for 1992, and by $10.00
per month single and $15.00 per month family for 1993, above
the amounts of City contributions under Proposal No. 2 below;
increase City contribution toward dental insurance premiums
from $20.00 per month to $30.00 per month; three year term of
contract with reopener for 1993 wages if sales tax revenues
increase over level of preceding year by 8% or more; reopen
negotiations for 1994 wages and health insurance regardless
of sales tax revenue increase or decrease.

the ballot card where indicated)
PROPOSAL NO. 2. Final written proposal of the City of Pueblo,
which generally provides:
$25.00 per month wage increase for 1992; $35.00 per month
wage increase for 1993; and $45.00 per month wage increase
for 1994; continue current formula for City health insurance
contributions but set the limit on City contributions at
$269.00 per month, plus $20.00 per month contribution toward
dental insurance; three year term of contract with reopeners
for 1993 and 1994 on wages and health insurance if sales tax
revenues increase by 8% or more over level of preceding year.

Proposal No. 2 should indicate his or her vote by punching

FIRE FIGHTERS
(Vote For Only One Of The Following Proposals)
PROPOSAL NO. 1. Arbitrator's recommendations accepted by the
International Association of Fire Fighters Local No. 3, which
generally provide:
5.6% wage increase effective January 1, 1992; continue health
insurance under present formula with no cap on City contribu-
tions; provide that fire fighter premium payments for family
coverage shall not exceed the levels they would have paid had
the City not changed policies or carriers; one year term of
contract.
FOR PROPOSAL NO. 1. (an elector desiring to vote for
Proposal No. 1 should indicate his or her vote by punching
the ballot card where indicated)
PROPOSAL NO. 2. Final written proposal of the City of Pueblo,
which generally provides:
$25.00 per month wage increase for 1992; $35.00 per month
wage increase for 1993; and $45.00 per month wage increase
for 1994; continue current formula for City health insurance
contributions but set the limit on City contributions at
$252.00 per month, plus $50.00 per month benefit pool; three
year term of contract with reopeners on wages and health
insurance for 1993 and 1994 if sales tax revenues increase by
8% or more over level of preceding year.

Proposal No. 2 should indicate his or her vote by punching
the ballot card where indicated)
OTHER CLASSIFIED EMPLOYEES
(Vote For Only One Of The Following Proposals)
PROPOSAL NO. 1. Final written proposal of the City of Pueblo,
which generally provides:
$25.00 per month wage increase for 1992; $35.00 per month
wage increase for 1993; and $45.00 per month wage increase
for 1994; continue present formula for City health insurance
contributions but set the limit on City contributions at
$281.00 per month, plus $24.66 per month contribution toward
dental insurance; three year term of contract with reopeners
for 1993 and 1994 wages and health insurance if sales tax
revenues increase by 8% or more over level of preceding year.

FOR PROPOSAL NO. 1. (an elector desiring to vote for
Proposal No. 1 should indicate his or her vote by punching

PROPOSAL NO. 2. Final written proposal of the Pueblo Association
of Government Employees, which generally provides:
City drug testing of employees is subject to agreement of
union; current Rule of Three for promotional appointments is
replaced by Rule of One; employees allowed to choose work
assignments by seniority in any department where work is
assigned on a daily basis; no increase in monthly pay rate
for 1992; continue sick leave at current level of 18 days per
year but increase amount which employee may use for illness
of others from current 3 days for illness of spouse or child
to 7 days for illness in "immediate family ", as defined;
employee may donate any accrued sick days to another employee
who has exhausted all sick leave; a single health insurance
carrier for all City employees shall be selected by a
committee of two representatives of the City and two
representatives of this union, and if City fails to convene
said committee for said purpose City shall pay the entire
cost of insurance for employees and dependents; City shall
adopt a cafeteria plan for City employees which complies with
section 125 of the Internal Revenue Code, with at least 50%
of the plan administrators appointed by classified employees;
if City consolidates any operations with any other govern-
mental entity or organization, employees of that consolidated
organization shall be members of this union bargaining unit;
one year term of contract.

Proposal No. 2 should indicate his or her vote by punching
the ballot card where indicated)
SECTION 6.
The complete text of the arbitrator's recommendations for the
police and fire contracts, the final proposal of the Pueblo
Association of Government Employees, and the final proposals of
the City of Pueblo to all three employee unions, shall be
available for public inspection at the City Clerk's office.
SECTION 7.
This Resolution shall become effective upon final passage.

City reserves the right to select health insurance carrier;
sets a limit on City health insurance contributions at $281 per
month under present formula, plus $24.66 per month contribution
toward dental insurance; three year term of contract with
reopeners for 1993 and 1994 wages and health insurance if sales
tax revenues increase by 8% or more over level of preceding year;

PROPOSAL NO. 2. Final written proposal of the Pueblo Association
of Government Employees, which generally provides:

No increase in monthly pay rate for 1992; requires City to
implement and maintain a drug testing program subject to agreement
of Pueblo Association of Government Employees; City shall offer
promotional appointment to person whose name is ranked highest on
civil service eligible list; requires work assignments by
seniority where work is assigned on a daily basis, unless City
establishes by clear and convincing evidence that employee is not
qualified to perform the work; allows employees to use up to 7
days of current sick leave in each consecutive 12 months for a
verifiable illness of employee's "immediate family ", as defined;
allows employees to donate accrued sick leave to other employees
who because of illness or emergency have exhausted all sick leave;
requires selection of a single health insurance carrier by a
committee of two representatives of the City and two
representatives of Pueblo Association of Government Employees and
provides that the City shall pay the entire cost of insurance for
employees and dependents if it fails to convene the committee for
said purpose; requires the adoption of an agreed upon cafeteria
plan for City employees, with at least 50% of the plan
administrators appointed by the classified employees; if City
consolidates any operations with any other governmental entity or
organization, employees of that consolidated organization shall be
granted the collective bargaining rights which are granted to
employees of the City of Pueblo under section 8 -14 of the City
Charter; one year term of contract.
