A RESOLUTION SUBMITTING MODIFICATIONS
TO THE URBAN RENEWAL PLAN FOR THE
AMENDED PHASE ONE URBAN RENEWAL
PROJECT FOR DOWNTOWN, PUEBLO,
COLORADO, DATED JANUARY 28 1988 TO
THE PLANNING AND ZONING COMMISSION FOR
REVIEW AND RECOMMENDATIONS
WHEREAS, the Urban Renewal Authority of Pueblo, Colorado,
adopted modification to the Urban Renewal Plan for the Amended
Phase One Urban Renewal Project for Downtown Pueblo dated January
28, 1988 and has submitted such modifications to the City Council
for approval; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City Council does hereby find and determine that the
modifications to the Urban Renewal Plan for the Amended Phase One
Urban Renewal Project for Downtown Pueblo, dated January 28, 1988
(the "1988 Urban Renewal Plan ") adopted by Resolution No. 91 -1 of
the Board of Commissioners of the Urban Renewal Authority of
Pueblo, Colorado, a copy of which is attached hereto, are
substantial modifications to the procedures in the approved 1988
Urban Renewal Plan, and the City Council's approval thereof is
subject to the requirements of §31 -25 -107, C.R.S. The City
Council shall hold a public hearing on the modifications to the
1988 Urban Renewal Plan on July 22, 1991 at 7 :30 p.m. in Council
Chambers, City Hall, 1 City Hall Place, Pueblo, Colorado, and the
City Clerk shall give notice of such public hearing by
publication in The Pueblo Chieftan at least ten days prior to the
hearing.
SECTION 2.
The modifications to the 1988 Urban Renewal Plan are hereby
submitted to the Planning and Zoning Commission for review and
recommendations as to their conformity with the general plan for
the development of the City as a whole.

A RESOLUTION OF THE BOARD OF
COMMISSIONERS OF THE URBAN RENEWAL
AUTHORITY OF PUEBLO, COLORADO
MODIFYING THE URBAN RENEWAL PLAN FOR
THE AMENDED PHASE ONE URBAN RENEWAL
PROJECT FOR DOWNTOWN PUEBLO DATED
JANUARY 28, 1988 BY AUTHORIZING THE
ACQUISITION OF INTERESTS IN PROPERTY
BY CONDEMNATION
WHEREAS X31- 25- 105(1)(e), C.R.S., of the Colorado Urban
Renewal Law was amended in 1990 to require that any acquisition of
any interest in property by condemnation by an urban renewal
authority must be approved as part of an urban renewal plan or
substantial modification thereof, and
WHEREAS, the Urban Renewal Plan for the Amended Phase One
Urban Renewal Project for Downtown Pueblo dated January 28, 1988
does not authorize or approve the acquisition of property by
condemnation. Now therefore,
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE URBAN
RENEWAL AUTHORITY OF PUEBLO, COLORADO, that:
SECTION 1.
The second paragraph of paragraph a. Property Acquisition of
Section 7. PROJECT ACTIVITIES of the Pueblo Urban Renewal Plan
for the Amended Phase One Urban Renewal Project for Downtown
Pueblo dated January 28, 1988 (the "1988 Urban Renewal Plan") be
amended to read:
The remaining property to be acquired, Parcel No. 6, will be
acquired by the Authority by condemnation in the manner
provided by the laws of the State of Colorado for the
exercise of the power of eminent domain by any other public
body.
SECTION 2.
The legal description of Parcel No. 6 contained in Section 2,
Urban Renewal Area Boundaries, of the 1988 Urban Renewal Plan be
amended to read:
P ARCE L NO. 6
Lots.2 through 5, Block 1, Central Pueblo;
all of Block 60, except Lots 5 through 14, Hobson's
subdivision of a part of the City of Pueblo, according to the
amended plat filed for record October 26, 1887; and all of
the former adjacent railroad right -of -way described as
follows: beginning at the northwesterly corner of Lot 1,
Block 60, Hobson's subdivison as recorded in Volume 2, Page
17, in the office of the County Clerk, thence southeasterly
along the original Atchison, Topeka and Santa Fe Railroad
right -of -way a distance of approximately 303.27 feet to a
point, said point being the northeasterly corner of Block 60,
Hobson's subdivision, thence northeasterly 112.32 feet to a
point on the original northeasterly right -of -way of the said
railroad company, said point being the southeasterly corner
of Lot 15, Block 56, Hobson's subdivision amended, thence
northwesterly along the original A.T. &S.F. right -of -way, a
distance of 370.82 feet, thence southwesterly a distance of
101.34 feet to the point of beginning; together with all
vacated streets and alleys adjacent thereto, County of
Pueblo, State of Colorado.
SECTION 3.
The Board of Commissioners of the Urban Renewal Authority of
Pueblo, Colorado does hereby find and determine that the
modifications to the 1988 Urban Renewal Plan contained in Sections
1 and 2 hereof are necessary and in the public interest.
SECTION 4.
Immediately upon - approval and adoption of this Resolution the
Chairman of the Board of Commissioners is authorized and directed
to submit this Resolution and the modifications to the 1988 Urban
Renewal Plan contained herein to the City Council of the City of
Pueblo pursuant to X31 -25- 107(7) C.R.S.

The foregoing Resolution was approved and adopted by the
Board of Commissioners of the Urban Renewal Authority of Pueblo,
Colorado at a meeting of the Board of Commissioners duly called
and held on June 18, 1991.
