HomeMy WebLinkAbout67733 RESOLUTION NO. 6773 A RESOLUTION APPROVING THE FINAL WRITTEN PROPOSAL OF THE CITY OF PUEBLO TO THE INTERNATIONAL BROTHERHOOD OF POLICE OFFICERS LOCAL 537 FOR A SUCCESSOR AGREEMENT TO THE COLLECTIVE BARGAINING AGREEMENT WHICH EXPIRES DECEMBER 31, 1991 WHEREAS, the City of Pueblo and the International Brotherhood of Police Officers Local 537 have failed to reach agreement on a successor to the present contract which will expire December 31, 1991, within the time limits set by the City Charter; and WHEREAS, the Charter of the City of Pueblo requires arbitration in such event and further requires that the corporate authorities submit a final written proposal prior to such arbitration; and WHEREAS, the City's 1991 annual average cost for salary and the following benefits provided to police officers in the bargaining unit with the departmental average of thirteen years of service is: Salary Longevity Pay Uniform Allowance Pay Family Health and Dental Insurance Pension Contributions TOTAL Patrol $3,462 $3,462 Officer Corporal Sergeant $29,916 $30,864 $34,356 $420 $420 $424 $1,340 $1,340 $1,340 $3 „462 $3,462 $3,462 $2,426 $2,502 $2,782 $37,S64 $38,S88 $42 ,360 WHEREAS, in addition to the above salary and benefits, each police officer in the bargaining unit with the departmental average of thirteen years of service is entitled to: paid leave each year consisting of 18 days vacation, 1.0 days additional vacation in lieu of holidays, 2 days personal leave, 18 days sick leave with an accrual. of 190 days; overtime compensation of one and one- -half times regular salary; call back compensation, one year injury leave with full salary and benefits; and if applicable, 4 days paid funeral leave, paid union business leave, military leave, and educational incentives; and WHEREAS, the City Council finds and determines that the above salaries and other benefits paid to members of the Police Department are fair and reasonable; and WHEREAS, the City Council finds that sala increases of the magnitude proposed by the police union are not .justified and cannot be granted without either cutbacks in other essential services or tax increases, or both; and WHEREAS, the 1992, 1993 and 1994 budgets for the City of Pueblo will require substantial expenditures in all areas of essential public services, capital expenditures, and economic development; and WHEREAS, a three year contract will eliminate the time, turmoil and expense which otherwise would be involved in the negotiation and arbitration process each year; and WHEREAS, the City Council finds that for all of the above reasons, fiscal responsibility requires that the City's final. wage and benefit proposal for calendar years 1992, 1993 and 1994 to the police officers union be limited to a continuation of the City's insurance contributions under the present formula, up to a maximum of $269 per month, and a salary increase of $105 per month payable as a $25 per month increase in January 1992, a $35 per month increase in January 1993, and a $45 per month increase in January 1994; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: Section 1. The final written proposal of the City of Puebla to the International B rothe rhood of Police Officers is approved as follows: That all provisions of the current collective bargaining agreement by and between the City of Puebla and the International Brotherhood of Police Officers Local 537 will remain unchanged during calendar years 1992, 1993,and 1994, except for those provisions which were changed by mutual agreement of the parties during 1991 negotiations, except for the following amendments: That Article 22 is amended to read as follows: ARTICLE 22. TERM OF AGREEMENT This Agreement shall become effective January 1, 1992 and all of its provisions shall remain fully effective through December 31, 1994 unless amended by the parties as herein set forth. The second year of this Agreement may be reopened for negotiations during 992 and the third year of this Agreement may be reopened for negotiations during 1993, by the Union upon written notice to the other party in substantial conformity with the provisions of the Charter of the City of Pueblo, if the audited sales and use tax revenues of the City of Pueblo for the, preceding year reflects an increase of eight (8 %) percent or more" Such negotiations shall be limited to the provisions of Article 27. Salary and Article 33.._1 Health Benefit Plan. That ARTICLE 27. The City reserves the right to determine and select the ins u ran ce com pany or other provider of health care benefits for such plan so Lang as the exercises of such rig t is, consistent wit jkp icable law For an employee covered by an individual plan, the City will contribute monthly Seventy -Five Dollars ($75 .00) plus one-half (1/2) of the difference between the full most on the individual plan and Seventy -Five Dollars ($75.00) towards such individual's coverage. For an employee covered by a family plan, the City shall contribute monthly One Hundred Eighty-Five Dollars ($185.00) plus one-half (1/2) of the difference between the full cost of the family plan and One Hundred Eighty-Five Dollars ($185.00) towards the cast of such family plan, g to a maximum monthl contribution of Two Hund red and Sixty- -Nine Do llars ($2_69.00). in addition to the $ZO.00 per m onth dent_ al in contributio pro vided herein. If the City is unable to obtain such a health benefit plan, it shall pay directly to a health benefit plan provider selected by the employee the above-cited sums, calculated upon the basis of the cost for the last health benefit plan provided by the City and covering the employees. 33.1»2 The City may arrange for a health benefit plan which provides deductibles in the amount of One Hundred Dollars ($100.00) per i nd i v i dua l or Tw Hundred Dollars ($200.00) per fam ily and co in the amount of Four Hundred Do 1 l a rs ($400.00) per individual and Eight Hundred Dollars ($800.00) per family.
