A RESOLUTION ACCEPTING AN EASEMENT FROM
COLORADO HORIZONS DEV. CORP.
WHEREAS, Colorado Horizons Dev. Corp. on March 25, 1991, granted
an easement to the City of Pueblo; and
WHEREAS, such easement is necessary to construct a public side-
walk with standard handicap ramp at the Northeast corner of Prairie Avenue
and Northern Avenue, and has been approved as to form by the City Attorney;
now, therefore;
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

The easement granted by Colorado Horizons Dev. Corp., dated
March 25, 1991, which easement is on file with the City Clerk, is hereby ap-
proved and accepted.

The City Clerk is directed to record said easement in the office
of the Pueblo County Clerk and Recorder.

SIDEWALK AND UTILITY EASEMENT
THIS EASEMENT, granted this 25th day of March, 1991, by COLORADO
HORIZONS DEV. CORP., Grantor, to the CITY OF PUEBLO, A Municipal Corpora-
tion, Grantee:
WITNESSETH:
THAT FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) and
other good and valuable consideration, paid by Grantee, receipt of which
is hereby acknowledged, Grantor hereby grants to Grantee, its successors
and assigns, an easement for the purpose of public sidewalk and public
utilities, in, through, over, under and across Grantor's property situate
in Pueblo County, Colorado, and described as follows:
An Easement located in the Southwest corner of Lot 23, Block
13, Smith's Mesa Addition, according to the recorded plat
filed for record January 15, 1891, in Book 7 at Page 21 of
the Pueblo County Records, being more particularly described
as follows:
Beginning at the Southwest corner of said Lot 23, said point
also being on the East right of way line of Prairie Avenue at
its intersection with the North right of way line of Northern
Avenue; thence Northerly along the West line of said Lot 23
and East right of way line of Prairie Avenue, a distance of
13.0 feet; thence Southeasterly a distance of 18.4 feet more
or less to a point on the South line of said Lot 23, said point
also being on the North right of way line of Northern Avenue;
thence Westerly along the South line of said Lot 23 and North
right of way line of Northern Avenue, a distance of 13.0 feet
to the point of beginning.
TOGETHER WITH the right to enter upon said property for the purpose of
construction, maintenance, control, and repair, and together with the right
to use so much of the adjoining property of Grantor that may be reasonably
necessary during the period of initial construction for said purposes. The
Grantor reserves the right to use and occupy said property for any purpose
consistent with the right and privilege above granted and which will not
interfere with or endanger any of the Grantee's equipment or facilities
therein or use thereof. Such reservation by the Grantor shall in no event
include the right to locate or erect or cause to be located or erected any
building or any other structure or mobile home trailer unit upon the easement
herein granted.
"Grantor" shall include the plural and the feminine. This easement shall
be binding upon, and shall inure to the benefit of the heirs, personal rep-

resentatives, successors, or assigns of the Grantor and Grantee.
