BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that;
SECTION 1.
There is hereby established an Urban Homesteading Program ( "Program ")
to be administered by the Department of Housing and Community Development
( "Department "). The Program is established to promote the rehabilitation
and construction of single - family residences on selected surplus City lots
or properties that have been foreclosed -on or boarded -up. All properties
must be financially feasible for rehabilitation to provide decent, safe
and sanitary housing within the City. Single - family residences which do
not meet and comply with City's housing and building codes and single -
family residential lots or housing acquired by the City through Community
Development Block Grant (CDBG) and urban renewal programs under the United
States Department of Housing and Urban Development (HUD) may be transerred
to a successful applicant under the Program.
SECTION 2.
(a) Applicants for transfer of Single - Family Property shall be
credit - worthy and establish at the time of application reliable documen-
tation to include personal reference and credit checks, satisfactory
to the Department, that;
1. Applicants are not presently homeowners or have no interest
in any real property wherever located.
2. Applicants must have the capability to secure the necessary
financing to rehabilitate or construct the residence and
manage the repayment of the debt.
3. Applicants are residents of the City and have so resided
within the City for at least two years.
(b) A successful applicant shall enter into an agreement with the
City whereby such applicant covenants and agrees that;
1. The applicant will rehabilitate the residence or construct a
residence on the Single - Family Property to code standards
within two years.
2. The applicant will occupy the residence on the Single - Family
Property as applicant's primary residence for a period of
five years.
(c) The Department, subject to the approval of the City Manager,
shall select Single - Family Property for the Program. The Department shall
advertise for applicants interested in participating in the Program.
The Program shall provide precedures for the assistance of private
financing or if it chooses to provide financing for the rehabilitation
using Ca mnnzity Development Block Grant funds. Successful applicants
will be selected based on meeting financial and programatic guidelines
established by the Department of Housing and Comiunity Development and
HUD /FHA complement programs that may be used in conjunction with the
program -
SECTION 3.
This resolution shall become effective upon final passage.
