The amendments implement the classification changes the Southern Colorado Building Commission recommended by its Resolution No. 2026-09, adopted July 29, 2026. A paired Resolution adopting the accompanying fee schedule for services rendered within the City of Pueblo is scheduled for introduction and adoption at the October 26, 2026, Council meeting, concurrent with second reading and final passage of this Ordinance, so that no fee becomes operative ahead of the classification that authorizes it. PREVIOUS COUNCIL ACTION: Chapter 1 of Title IV of the Pueblo Municipal Code was amended in full by Ordinance No. 11082 to reflect the change from the Pueblo Regional Building Department to the Southern Colorado Building Department under the Intergovernmental Agreement between the City of Pueblo and the Town of Boone, Colorado. No amendment to Sec. 4- 1-24 has been enacted since Ordinance No. 11082. BACKGROUND: The Intergovernmental Agreement for the Operation of the Southern Colorado Building Department (the IGA), effective January 1, 2026, establishes the Southern Colorado Building Department (SCBD) as a joint facility of the City of Pueblo and the Town of Boone. Section 23 of the IGA provides that the SCBD Building Commission recommends a schedule of fees to the member entities, and the member entities, after considering the recommendation, adopt the schedule. Docusign Envelope ID: 4207D491-02C7-8FD3-809C-190FF1 EC4E65 On July 29, 2026, the SCBD Building Commission adopted its Resolution No. 2026-09 recommending a fee schedule for adoption by the City Council. The recommended schedule prices three mechanical contractor classifications that do not exist in Sec. 4-1- 24 as amended by Ordinance No. 11082: Mechanical Contractor -B; a Mechanical Contractor -C authorized to perform residential work on a per -discipline basis; and Mechanical Contractor -D. The City Council cannot price by resolution a license classification the Code does not create. This Ordinance is the necessary predicate to Council's adoption of the accompanying fee schedule. The amendments do the following. Mechanical Contractor -B is added as a new subsection for holders performing gas fitting, refrigeration, or sheet metal venting work in commercial or residential structures, limited to no more than two of those disciplines. Mechanical Contractor -C is modified from a Limited license authorizing work in any structure to a Residential license authorizing one or more of gas fitting, refrigeration, or sheet metal venting in residential structures only. Mechanical Contractor -D is added as a new subsection for Master Plumbers licensed by the State of Colorado holding a current Plumbing Contractor license issued by the Department, authorized to perform gas piping and metal venting work under a mechanical permit. Subsections (a) and (e) of Sec. 4-1-24 are amended to replace references to the "Mechanical C contractor limited to gas" classification with references to Mechanical Contractor -D, so that the internal cross-references remain accurate. Two additional categories on the Building Commission's recommended fee schedule, Water Connected Appliance and Journeyman Refrigeration License, correspond to no license classification in Title IV, Chapter 1, of the Pueblo Municipal Code. Those two categories are excluded from the accompanying Resolution's fee schedule pending reconciliation between the Southern Colorado Building Department and its General Counsel. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Southern Colorado Building Commission recommended adoption of the underlying classification changes by its Resolution No. 2026-09, adopted July 29, 2026. STAKEHOLDER PROCESS: Notice and public hearing on this Ordinance will proceed in accordance with the City Charter and Pueblo Municipal Code. ALTERNATIVES: If this Ordinance is not adopted, the three mechanical contractor classifications the Southern Colorado Building Commission recommended cannot be issued forwork within the City of Pueblo, and the accompanying Resolution adopting the fee schedule cannot price those classifications. RECOMMENDATION: Docusign Envelope ID: 4207D491-02C7-8FD3-809C-190FF1 EC4E65 Approval of the Ordinance. The Code already lets a plumbing contractor do gas piping under a Mechanical C license limited to gas and do venting after a sheet metal exam, so I need to know how "Mechanical D" differs from that. Mechanical D is for Master Plumbers so that they can pull a'Meclhhanical Permitfor Gas Piping and Metal Ventng. As a'Master Rlurrmlber' through the State they are allowed to install Gas piping and Metal Venting. • Manufacturer Home Setter: confirm whether you want it as its own class or issued as a Building D specialty. The specialty route avoids an ordinance for that one. SGCO BD does not license the manufactured home setters only charges fee SS. for administration fee.
