Background Paper for Proposed
Ordinance
COUNCIL MEETING DATE: October 26, 2026
TO: President Mark Aliff and Members of City Council
CC: Mayor Heather Graham
VIA: Clyde Bishop, City Clerk
FROM: Beritt Odom, Director Planning and Community Development
SUBJECT: AN ORDINANCE AMENDING SECTION 17-10-05(I) OF TITLE XVII OF
THE PUEBLO MUNICIPAL CODE RELATING TO PUBLIC -PRIVATE
PARTNERSHIP SIGNS
SUMMARY:
An amendment to Chapter 10, Section 5 of Title XVII of the Pueblo Municipal Code
relating to Public -Private Partnership Signs.
PREVIOUS COUNCIL ACTION:
On November 10, 2025, City Council Approved Ordinance No. 11071 relating to
amending the Pueblo Municipal Code and allowing private -partnership signs on city -
owned property and on properties zoned for government use (S-1).
BACKGROUND:
An ordinance allowing Public -Private Partnership (PPP) Signs was passed by City
Council in November 2025 after a 6-0 recommendation of approval by the Planning and
Zoning Commission (Ordinance No. 11071). The ordinance allows for PPP Signs on
properties zoned for government use (S-1) and on City -owned properties under the
review and guidance of the Planning and Zoning Commission.
However, the previous ordinance did not include a process for public noticing, and it
included a small typo in the notes section. This ordinance addresses both problems: the
text amendment will add language stating "When any PPP sign is to be developed or
redeveloped, the development plan therefore shall be first submitted for review and
approval by the Planning and Zoning Commission. The decision of the Planning and
Zoning Commission shall be made after a notice and public hearing has been held in
the manner required for a zoning map amendment." The minor typo will be corrected by
deleting two sets of asterisks that do not correlate to the above provisions.
Docusign Envelope ID: 6DED9F2C-301 B-8590-83CB-3E4B14E6E761
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their September 9, 2026, Regular Meeting,
voted 6-0 to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing by publication of the proposed amendment fifteen (15) days prior to the
Public Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, Title XVII of the Pueblo Municipal Code
will not be amended to fix the two existing oversights regarding Public -Partnership
Signs.
RECOMMENDATION:
Approve the proposed Ordinance.

AN ORDINANCE AMENDING SECTION FIVE OF CHAPTER TEN OF
TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO
OFF -PREMISES SIGNS
BACKGROUND AND ANALYSIS:
An ordinance allowing Public -Private Partnership (PPP) Signs was passed by City Council in November 2025
after a 6-0 recommendation of approval by the Planning and Zoning Commission (ordinance NO. 11071). The
ordinance allows for PPP Signs to be constructed on properties zoned (S-1) and on City -Owned properties
under the review and guidance of the Planning and Zoning Commission. Prior to the construction of PPP
Signs, the Planning and Zoning Commission is required to review and approve the development including the
sign area, sign height, site, and public improvements required for the overall site.
The purpose of the proposed text amendment is to include noticing language for Public -Private Partnership
Signs (PPP Signs) in a manner that is similar to other development reviews, such as (S-1) Government use
district site plan reviews and rezonings. This will make the procedure for PPP signs consistent with other plan
reviews that the P&Z Commission conducts at their public hearings. The text amendment will also rectify an
inconsistency in punctuation within the Off -premises sign table and the notes section of the table.
The proposed ordinance amends Section 17-10-05 (i) of the Pueblo Municipal Code. The text amendment will
add language stating, "When any PPP sign is to be developed or redeveloped, the development plan therefor
shall be first submitted for review and approval by the Planning and Zoning Commission. The decision of the
Planning and Zoning Commission shall be made after a notice and public hearing has been held in the manner
required for a zoning map amendment.". A typo in the note section of the table will also be corrected.
Currently, there are two sets of astricts in the notes section that do not correlate to the above information,
which will be deleted.
RECOMMENDED ACTION:
If the Planning and Zoning Commission finds the proposed Text Amendment is appropriate, staff
recommends a recommendation of APPROVAL of the Text Amendment be forwarded to City Council.
