APPENDIX A: CONTRACTOR LICENSING FEES APPENDIX B: DESCRIPTIONS Diana Oldemeyer, Chairperson Docusign Envelope ID: 9C7BB82E-F9CE-8F5A-8192-96883611 C08A City Clerk's Office Item # M1 COUNCIL MEETING DATE: October 26, 2026 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Clyde Bishop, City Clerk FROM: Harley Gifford, Deputy City Attorney SUBJECT: A RESOLUTION ADOPTING A FEE SCHEDULE FOR THE SOUTHERN COLORADO BUILDING DEPARTMENT FOR SERVICES RENDERED WITHIN THE CITY OF PUEBLO SIIMMORY. This proposed Resolution adopts the fee schedule attached as Exhibit A for licenses, registrations, applications, and plan review services performed by the Southern Colorado Building Department (SCBD) within the City of Pueblo. Section 4-1-15(a) of the Pueblo Municipal Code directs that Department fees be established by resolution of the City Council. The fee schedule reflects the categories the SCBD Building Commission recommended by its Resolution No. 2026-09, adopted July 29, 2026, with two categories excluded and noted in the Background section. This Resolution is presented concurrently with the paired Ordinance amending Sec. 4- 1-24 of the Pueblo Municipal Code to create the Mechanical Contractor -B, Mechanical Contractor -C (Residential), and Mechanical Contractor -D classifications. Second reading and final passage of the paired Ordinance is scheduled for the October 26, 2026 Council meeting, concurrent with introduction and adoption of this Resolution, so that no fee becomes operative ahead of the classification that authorizes it. PREVIOUS COUNCIL ACTION: None. Since the effective date of the Intergovernmental Agreement for the Operation of the Southern Colorado Building Department on January 1, 2026, no fee schedule has been adopted by the City Council under Section 9 of that Agreement. BACKGROUND: The Intergovernmental Agreement for the Operation of the Southern Colorado Building Department (the IGA), effective January 1, 2026, provides at Section 9 that all license, building permit, plan review, and inspection fees for activities within each member entity shall be established as provided by ordinance or resolution of the respective member Docusign Envelope ID: 9C7BB82E-F9CE-8F5A-8192-96883611 C08A entity. Section 23 of the IGA provides that the Building Commission recommends a schedule of fees, and the member entities, after considering the recommendation, adopt the schedule. Section 4-1-15(a) of the Pueblo Municipal Code, as amended by Ordinance No. 11082, provides that the fees and charges for licenses, examinations, permits, inspections, reinspections and all other services or activities performed by the Department, the Building Official, and the Boards shall be established by the resolution of the City Council. That section is the direct authority for adopting the attached fee schedule by resolution. The SCBD Building Commission adopted its Resolution No. 2026-09 on July 29, 2026, recommending the fee schedule reflected in Exhibit A. Exhibit A is structured in three sections. Section 1 establishes the annual license and registration fees under PMC Sec. 4-1-15(a). Section 2 establishes a $95.00 administrative fee under PMC Sec. 4-1- 15(b)(2) for each application for a license or registration listed in Section 1, and a $95.00 administrative fee under PMC Sec. 4-1-15(a) for each manufactured home setter application, which is a Department service that does not involve the issuance of a license. Section 3 establishes a $35.00 plan review re -submittal fee under PMC Sec. 4- 1-15(a) for revisions submitted after the second revision. Exhibit A does not restate the annual renewal cycle or the renewal fee multipliers codified at PMC Sec. 4-1-15(b)(1), which by their own terms apply to the fees established in Section 1 of Exhibit A. Two categories on the Building Commission's recommended schedule are excluded from Section 1 of Exhibit A: Water Connected Appliance and Journeyman Refrigeration License. Neither category corresponds to a license classification in Title IV, Chapter 1, of the Pueblo Municipal Code. Both have been referred to the Southern Colorado Building Department's General Counsel for reconciliation. FINANCIAL IMPLICATIONS: The Resolution establishes the fees the Southern Colorado Building Department collects from applicants for licenses, registrations, applications, and plan review services within the City of Pueblo. Pursuant to IGA Section 23, the Department is intended to be self-supporting through fees. No City general fund revenue or expenditure results from adoption of this Resolution. BOARD/COMMISSION RECOMMENDATION: The Southern Colorado Building Commission recommended adoption of the fee schedule by its Resolution No. 2026-09, adopted July 29, 2026. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: If this Resolution is not adopted, no fee schedule authorized under the Docusign Envelope ID: 9C7BB82E-F9CE-8F5A-8192-96883611 C08A Intergovernmental Agreement for the Operation of the Southern Colorado Building Department will be in effect within the City of Pueblo, and the Department cannot lawfully charge for licenses, registrations, or plan review services for activities within the City. RECOMMENDATION: Approval of the Resolution. ATTACHMENTS: 1. Residential only Gas Fitter, Refrigeration, and/or (Metal Venting. "Mechanical D": tell me exactly what it authorizes. The Code already lets a plumbing contractor do gas piping under a Mechanical C license limited to gas and do venting after a sheet metal exam, so I need to know how "Mechanical D" differs from that. Mechanical D is for Master Plumbers so that they can pull a'Meclhhanical Permitfor Gas Piping and Metal Ventng. As a'Master Rlurrmlber' through the State they are allowed to install Gas piping and Metal Venting. • Manufacturer Home Setter: confirm whether you want it as its own class or issued as a Building D specialty. The specialty route avoids an ordinance for that one. SGCO BD does not license the manufactured home setters only charges fee SS. for administration fee. Manufacturer ii forme Setters can only set the Home, they will either need to have a Contractor with a Contractor C License or Contractor with D licenses for discipline needed (Decks, Concrete, Drywall, Framing, etc) SOUTHERN COLORADO 4RII BUILDING DEPARTMENT Contractor License Fees YEARLY FEE ADMINISTRATIVE ---m FEE (1 TIME) ..... Building "A" Contractor License _......_.....wW. $310.00 ... $95 .. _ —_...................................................................._.....................
