A RESOLUTION ACCEPTING AN EASEMENT FROM
FRANK A. TORRI, PAUL L. TORRI, AND ELSIE
C. BLAGG
WHEREAS, Frank A. Torri, Paul L. Torri, and Elsie C. Blagg, on
February 7, 1990, granted an easement to the City of Pueblo; and
WHEREAS, such easement is necessary to construct a public side-
walk with standard handicap ramp at the Northwest corner of Prairie Avenue
and Ivywood Lane, and has been approved as to form by the City Attorney;
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

The easement granted by Frank A. Torri, Paul L. Torri, and Elsie
C. Blagg, dated February 7, 1990, which easement is on file with the City
Clerk, is hereby approved and accepted.

The City Clerk is directed to record said easement in the office
of the Pueblo County Clerk and Recorder.

SIDEWALK AND UTIL EASEMENT
THIS EASEMENT, granted this _ day of February, 1990, by FRANK A.
TORRI and PAUL L. TORRI and ELSIE C. BLAGG, GRANTOR, to the CITY OF PUEBLO,
a Municipal Corporation, GRANTEE:
WITNESSETH:
THAT FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) and other
good and valuable consideration, paid by GRANTEE, receipt of which is hereby
acknowledged, GRANTOR hereby grants to GRANTEE, its successors and assigns,
an easement for the purpose of public sidewalk and public utilities, in,
through, over, under and across GRANTOR'S property situate in Pueblo County,
Colorado, and described as follows:
An easement located within that parcel of land described
in deed filed for record November 21, 1974, in Book 1799
at Page 297, in the Records of the Pueblo County Clerk
and Recorder, being more particularly described as follows:
Beginning at the Southeast corner of said parcel, said
point also being on the West right -of -way line of Prairie
Avenue at its intersection with the North right -of -way
line of Ivywood Lane; thence Westerly along the South
line of said parcel, said line also being the North
right -of -way line of Ivywood Lane, a distance of 7.0 feet;
thence Northerly at right angles to last course, a distance
of 1.55 feet; thence Northeasterly a distance of 7.6 feet
more or less to a point on the East line of said parcel,
said point also being on the West right -of -way line of
Prairie Avenue, Northerly at a distance of 4.55 feet
from the Southeast corner of said parcel; thence Southerly
along the East line of said parcel, said line also being
the West right -of -way line of Prairie Avenue, to the point
of beginning,
TOGETHER WITH the right to enter upon said property for the purpose of
construction, maintenance, control, and repair, and together with the right
to use so much of the adjoining property of GRANTOR that may be reasonably
necessary during the period of initial construction for said purposes. The
GRANTOR reserves the right to use and occupy said property for any purpose

consistent with the right and privilege above granted and which will not
interfere with or endanger any of the GRANTEE'S equipment or facilities
therein or use thereof. Such reservation by the GRANTOR shall in no event
include the right to locate or erect or cause to be located or erected any
building or any other structure or mobile home trailer unit upon the ease-
ment herein granted.
"GRANTOR" shall include the plural and the feminine. This easement shall
be binding upon, and shall inure to the benefit of the heirs, personal repre-
sentatives, successors, or assigns of the GRANTOR and GRANTEE.
