Docusign Envelope ID: CF99BA22-B454-81 BA-8337-D0DF05350CBA City Clerk's Office Item # R2 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: October 13, 2026 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Clyde Bishop, City Clerk FROM: Beritt Odom, Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE 3.601 ACRES FROM INDUSTRIAL (1-2) AND AGRICULTURAL (A-4) ZONE DISTRICTS TO A CENTRAL BUSINESS (B-4) ZONE DISTRICT SUMMARY: The applicant is requesting to rezone 3.601 acres within the Sunnyside Subdivision from Industrial (1-2) and Agricultural (A-4) Zone Districts to a Central Business (B-4) Zone District to facilitate future commercial development. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject area consists of 5 parcels within Block 12 of the Sunnyside Subdivision located south of Lake Minnequa. One parcel is currently zoned Industrial (1-2) while the remaining four parcels are currently zoned Agricultural (A-4). Both 1-2 and A-4 Zone Districts are present in the surrounding area; however, most properties adjacent to this portion of W Pueblo Blvd are within a Highway and Arterial Business (B-3) and Central Business (B-4) Zone District. The A-4 Zone District is concentrated around Lake Minnequa, and the 1-2 Zone District is concentrated south of W Pueblo Blvd. The Central Business (B-4) Zone District is intended to provide areas of business and services required by the region at large. The B-4 Zone District allows ample uses by - right that are primarily commercial in nature. The 2022 Regional Comprehensive Plan designates three of the parcels adjacent to W. Pueblo Blvd. for Commercial Mixed -Use, characterized by a mix of commercial, employment, and service -oriented uses to serve adjacent neighborhoods and the broader region. Primary land uses in this designation include large -format retail, services, office, and entertainment. Thus, the allowed uses in the proposed B-4 Zone District match the characteristics of a Commercial Mixed -Use designation. The Docusign Envelope ID: CF99BA22-B454-81BA-8337-D0DF05350CBA remaining two parcels adjacent to Lakeshore Dr. and Reno Ave. are designated as Parks and Open Space, characterized by parks, open space, trails, and natural areas preserved for recreational purposes. However, this designation appears to be an unintentional southern extension of parks designation stemming from Lake Minnequa. The 2010 Minnequa Lake Park and Open Space Master Plan designates these two parcels as a Development Site, explicitly separate from the park and open spaces activities to the north. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their September 9, 2026, Regular Meeting, voted 6-0 to recommend approval of the rezoning. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will not be rezoned in accordance with the Pueblo Municipal Code. One parcel will remain in the 1-2 Zone District while the remaining parcels will remain in an A-4 Zone District. RECOMMENDATION: Approval of the Ordinance. ATTACHMENTS: 1. CONCURRENT N/A REQUESTS: REQUEST: Rezone 3.601 acres from Industrial (I-2) and Agricultural (A-4) Zone Districts to a Central Business (B-4) Zone District, generally located south of Lake Minnequa on W. Pueblo Blvd. BACKGROUND AND ANALYSIS: The applicant is requesting to rezone 3.601 acres from an Industrial (I-2) and Agricultural (A-4) Zone District to a Central Business (B-4) Zone District to facilitate future commercial development. The subject area consists of 5 parcels — 1514412104, 1514412105, 1514412106, 1514412108 and 1514412109 — within Block 12 of the Sunnyside Subdivision which was annexed into the city in 1972 and is generally located south of Lake Minnequa on W. Pueblo Blvd. The Industrial (I-2) Zone District is intended to provide areas for manufacturing, warehousing, and limited retailing of products by which the operations involved are not obnoxious to surrounding uses. Uses allowed within the I-2 Zone District include a car wash, food and drink processing facility, print shop, storage, tow service, truck stop, warehousing, and recycling. The Agricultural (A-4) Zone District is intended to provide areas for low -density residential development in a rural atmosphere with limited agricultural activity. There are limited land uses allowed in the A-4 Zone District, including single-family residences, ADUs, a garden center, nursery, park, a religious institution, farming, and ranching. Both I-2 and A-4 are present in the surrounding area; however, most properties adjacent to this portion of W Pueblo Blvd are within a Highway and Arterial Business (B-3) and Central Business (B-4) Zone District. The A-4 Zone District is concentrated around Lake Minnequa, and the I-2 Zone District is concentrated south of W Pueblo Blvd. Z-26-14 The Central Business (B-4) Zone District is intended to provide areas of business and services required by the regional at large. There are 74 uses by -right, including a bakery, bar, pet shop, restaurant, big box retail, theater, and urgent care. These are primarily commercial in nature. There are 35 uses by -review, requiring approval by the Zoning Board of Appeals. A few of the uses by -review are industrial or residential, such as warehousing and multifamily residences. Finally, there are 36 conditional uses, which require an administrative review to ensure they comply with objective standards set forth in the code. For example, an automobile repair and community garden are conditional uses. The 2022 Regional Comprehensive Plan designates three parcels adjacent to W. The remaining two parcels adjacent to Lakeshore Dr. and Reno Ave. are designated as Parks and Open Space, characterized by parks, open space, trails, and natural areas preserved for recreational purposes. However, this designation appears to be an unintentional extension of the Minnequa Lake Park and Open Space designation. The 2010 Lake Minnequa Master Plan designates these two parcels as a Development Site, explicitly separate from the park and open spaces activities to the north.
