The City and County of Pueblo have received a cumulative total of approximately $2,568,765 in Justice Assistance Grant funds through this award. BACKGROUND: The Edward Byrne Memorial Justice Assistance Grant Program, administered by the United States Department of Justice, Bureau of Justice Assistance, provides funds to units of local government to improve law enforcement technology and upgrade necessary equipment. The program supports a broad range of activities to prevent and control crime and improve the criminal justice system. Pueblo County has been certified as a disparate jurisdiction by the Colorado State Attorney General's Office. Under federal Justice Assistance Grant rules, a certified disparate county and the city or cities within the county must divide the available funds by mutual agreement, and if the parties cannot reach agreement, no jurisdiction receives funds. The City serves as the applicant and fiscal agent for the award. The parties have reached agreement on the disbursement of the FY2025 award in the April 7, 2026 Memorandum of Understanding. Under that agreement, the City receives $93,424.52 (76% of the total award) and Pueblo County receives $29,502.48 (24% of the total award). Of the County's share, the Pueblo County Sheriff's Office receives $23,601.98 (80%) and the Tenth Judicial District Attorney's Office receives $5,900.50 (20%). The federal award instrument was issued July 31, 2026, with an acceptance period that required execution of the award document before the next available Council meeting. Mayor Graham accordingly executed the award document and the accompanying Memorandum of Understanding so that the Grant funds would be available to the City and County. This Ordinance ratifies those executive acts and appropriates the Grant funds to Project No. PS2610. The City's share of $93,424.52 will fund four Police Department equipment projects: desktop, laptop, and other computer -related equipment for the entire Department; tactical breaching tools for the Special Investigations Division; additional Pueblo Metro Bomb Squad equipment (including manipulator and disrupter kits); and miscellaneous supplies, tools, and equipment upgrades supporting Department operations. A detailed line -item breakdown is provided in the attached Itemization of Projects. FINANCIAL IMPLICATIONS: The Grant provides $122,927 to the City and County of Pueblo with no required match. The City's share is $93,424.52. The remaining $29,502.48 is disbursed to Pueblo County under the Memorandum of Understanding, in the amounts set forth above. The FY2025 award is $18,893 greater than the FY2024 award. The City serves as fiscal agent and administers the drawdown. The County provides the City with quarterly reports, which the Police Department monitors. Docusign Envelope ID: 70947661-11 F5-8077-8388-22FF344E08BC BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: The Bureau of Justice Assistance requires the applicant to provide an opportunity for public comment on the proposed use of Justice Assistance Grant funds, which was held on Tuesday, August 25, 2026. City and County law enforcement leadership have agreed to the disbursement terms set forth in the Memorandum of Understanding. The City Attorney's Office, the Pueblo County Attorney's Office, and the City Finance Department have reviewed and approved the award documents and the Memorandum of Understanding. ALTERNATIVES: If this Ordinance is not approved, the Mayor's signatures on the award document and the Memorandum of Understanding will not be ratified, the City will not accept the $122,927 Grant, and the funds will not be available to the Pueblo Police Department, the Pueblo County Sheriff's Office, or the Tenth Judicial District Attorney's Office. RECOMMENDATION: Approval of the Ordinance. ATTACHMENTS: 1. 2025 BJA JAG MOU signed 2. 2025 JAG Itemization of Projects 3. Henneberg Deputy Assistant Attorney General Office for Civil Rights Notice for All Recipients The Office for Civil Rights (OCR), Office of Justice Programs (OJP), U.S. Department of Justice (DOJ) enforces federal civil rights laws and other provisions that prohibit discrimination by recipients of federal financial assistance from OJP, the Office of Community Oriented Policing Services (COPS), and the Office on Violence Against Women (OVW). Several civil rights laws, including Title VI of the Civil Rights Act of 1964 and Section 504 of the Rehabilitation Act of 1973, require recipients of federal financial assistance (recipients) to give assurances that they will comply with those laws. Taken together, these and other civil rights laws prohibit recipients from discriminating in the provision of services and employment because of race, color, national origin, religion, disability, and sex or from discriminating in the provision of services on the bases of age. Some recipients of DOJ financial assistance have additional obligations to comply with other applicable nondiscrimination provisions like the Omnibus Crime Control and Safe Streets Act of 1968, which prohibits discrimination on the basis of religion in addition to race, color, national origin, and sex. Recipients may also have related requirements regarding the development and implementation of equal employment opportunity programs. OCR provides technical assistance, training, and other resources to help recipients comply with civil rights obligations. Further, OCR administratively enforces civil rights laws and nondiscrimination provisions by investigating DOJ recipients that are the subject of discrimination complaints. In addition, OCR conducts compliance reviews of DOJ recipients based on regulatory criteria. These investigations and compliance reviews permit OCR to evaluate whether DOJ recipients are providing services to the public and engaging in employment practices in a nondiscriminatory manner.
