HomeMy WebLinkAbout6545I 2 RESOLUTION NO. 6545 A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE WITH COLORADO REVISED STATUTES SECTION 31 -12- 107 (1) OF THE PETITION FOR ANNEXATION OF THE AREA COMMONLY KNOWN AND DESCRIBED AS PUEBLO MEMORIAL AIRPORT NO. 3 - SOUTHEAST CORNER OF ATLAS AVENUE AND SKYWAY STREET WHEREAS, a Petition For Annexation of the area described in Section 1 hereof has been filed with the City Clerk, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The Petition For Annexation of the following described area situated in Pueblo County, Colorado, is hereby found and determinied to be in substantial compliance with the provisions of C.R.S. §31 -12- 107(1): A parcel of land located within the County of Pueblo, State of Colorado, to -wit: A parcel of land being a portion of the E 1/2 of the SE 1/4 of Section 25, Township 20 South, Range 64 West and the W 1/2 of the SW 1/4 of Section 30, Township 20 South, Range 63 West of the Sixth Principal Meridian, being more particularly described as follows: BEGINNING at a point on the apparent westerly right of way line of Skyway Street and the present City limits line accord- ing to the recorded plat of the Annexation to the City of Pueblo filed for record April 6, 1990 in Book #2492 at Page #617 in the records of the Pueblo County Clerk and Recorder from which the E 1/4 corner of said Section 25 bears N 33 -49 -58 E., (bearings based on the east line of the said SE 1/4 of Section 25 to bear N 00 -05 -41 W., with all bearings contained herein being relative thereto) a distance of 1084.67 feet; thence N 88 -32 -10 E., along the apparent northerly right of way line of Atlas Avenue and said right of way line extended westerly and easterly, a distance of 1275.66 feet to a point on the apparent easterly right of way line of Keeler Parkway; thence S 01 -31 -26 E., along said apparent right of way line and the apparent easterly right of way line of United Avenue, a distance of 796.74 feet to a point on the apparent southerly right of way line of said United Avenue; Thence S 88 -29-21 W., along said apparent southerly right of way line, a distance of 1275.66 feet; Thence N 01 -31 -26 W, along said apparent westerly right of way line of Skyway Street and said right of way line extended southerly a distance of 797.79 feet to the point of beginning, said parcel contains 23.35 acres. 9RrTTnW 7 A public hearing to determine if the area proposed to be annexed meets the applicable requirements of C.R.S.931 - 12 -104 and §31 -12 -105 to establish eligibility for annexation under the Municipal Annexation Act of 1965 shall be held before the City Council in Council Chambers, Second Floor, City Hall, One City Hall Place, Pueblo, Colorado, on Tuesday,May 29, 1990, commencing at 7:30 o'clock p.m. or as soon thereafter as City Council business allows. The City Clerk shall publish notice of the public hearing once a week for four successive weeks in the Pueblo Chieftain. The first publication of such notice shall be at least thirty (30) days prior to the date of the hearing. A copy of the published notice, together with a copy of the Petition For Annexation shall be sent by registered mail by the City Clerk to the Board of County Commissioners and the County Attorney of Pueblo County and to any school district or special district having territory within the area to be annexed at least twenty -five days prior to the date of the hearing.
