AN ORDINANCE AMENDING THE FISCAL YEAR 2026
STAFFING ORDINANCE BY ABOLISHING ONE (1) VACANT
FULL-TIME WW COMPLIANCE OFFICER POSITION AND
ADDING ONE (1) FULL-TIME PERMIT COMPLIANCE
SPECIALIST AND ADDING ONE (1) FULL-TIME
PRETREATMENT COMPLIANCE TECHNICIAN POSITION TO
THE AUTHORIZED STAFFING OF THE WASTEWATER
DEPARTMENT
WHEREAS, it is necessary to revise the positions for the ultimate efficiency and
functionality for the City of Pueblo Wastewater Department; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following sections captioned "Wastewater Administration" and "Wastewater
Pretreatment" of Ordinance No. 11084, being the 2026 Staffing Ordinance, is amended as
follows:

SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Ordinance to effectuate any transactions described therein.

SECTION 3.
This Ordinance shall be deemed to amend the Fiscal Year 2026 Budget and staffing with
respect to the number and allocation of positions within the Wastewater Department and shall
become effective on the date of final action by the Mayor and City Council.

ORDINANCE BY ABOLISHING ONE (1) VACANT FULL-TIME WW

PERMIT COMPLIANCE SPECIALIST AND ADDING ONE (1) FULL-TIME
PRETREATMENT COMPLIANCE TECHNICIAN POSITION TO THE
AUTHORIZED STAFFING OF THE WASTEWATER DEPARTMENT
SUMMARY:
The Wastewater Department requests to abolish one full-time position in the
Wastewater Administration Division that is currently vacant and no longer needed and
add two additional full-time positions to the Pretreatment Division.
PREVIOUS COUNCIL ACTION:
On December 8, 2025, Ordinance No. 11084 was approved by City Council. This
Ordinance provided authorized staffing for Fiscal Year 2026.
BACKGROUND:
The Wastewater Compliance Officer position was created in 2024 to conduct field
investigations, manage data, and ensure compliance related to sump pump
connections. This position is currently vacant and is no longer needed because the
sump pump survey has been completed and the Wastewater Department gathered the
information needed to comply with the State of Colorado requirements for the
Discharger Specific Variance on sump pumps connected to the sanitary sewer in areas
with groundwater that has high concentrations of selenium and sulfate.
The Wastewater Pretreatment Program currently has one Pretreatment Compliance
Technician position that is responsible for water sampling, conducting routine
inspections, monitoring flows, and reviewing documents from sector control programs.

The Department would benefit from another Pretreatment Compliance Technician
because of the workload of the grease program and the industrial survey. The City has
approximately 400 food service facilities and engine service facilities. These facilities
are required to submit semiannual reports that must be processed in a timely manner to
ensure the information is correct. This position is also required to inspect food service
facilities and other industries. Currently with only one Pretreatment Compliance
Technician these inspections and necessary document reviews are not done promptly.
To ensure that information submitted to the Pretreatment Program is done in a timely
manner another Pretreatment Compliance Technician is needed.
The Wastewater Pretreatment Program currently has one Permit Compliance Specialist
position that is responsible for water sampling, conducting permitted industry
inspections, drafting permitting documents, reviewing periodic compliance reports, and
drafting enforcement actions. The Department would benefit from another Permit
Compliance Specialist to address the current backlog of inspections, to conduct
investigations, and to address noncompliance in the timeframe that is required by the
Pueblo Municipal Code and federal regulations. The Environmental Protection Agency
noted that the Pretreatment Program was not meeting the requirements and
recommended that City of Pueblo should increase the number of full-time employees to
meet deadlines. Federal regulations state that the Pretreatment Program must have
resources allocated to implement the approved program.
FINANCIAL IMPLICATIONS:
All costs for 2026 associated with this proposal will be paid through vacancy savings.

ALTERNATIVES:
The no action alternative would be to retain current staffing levels. Without approval of
this Ordinance, the City of Pueblo will not be able to efficiently support the important
work of the Wastewater Department and the requirements of Clean Water Act.
RECOMMENDATION:
Approval of the Ordinance.
