RESOLUTION NO. 16419
A RESOLUTION APPOINTING THE CITY CLERK AS THE
DESIGNATED ELECTION OFFICIAL FOR THE SPECIAL
MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 3, 2026,
AND RATIFYING THE CITY CLERK'S CERTIFICATION OF THE
CONTENT OF THE BALLOT FOR SAID ELECTION
WHEREAS, the City of Pueblo (the "City") is a home rule municipality organized under
Article XX of the Colorado Constitution and its Charter; and
WHEREAS, C.R.S. § 1-1-104(8) defines the "designated election official" as the person
designated by the governing body as the person who is responsible for the running of an
election, and Section 5-1-12 of the Pueblo Municipal Code adopts the Colorado municipal
election laws except as otherwise provided in the Code; and
WHEREAS, the City has referred to the eligible electors of the City, at the November 3,
2026 election, a ballot question relating to the imposition of an additional one -quarter percent
(0.25%) sales and use tax rate for Department of Fire and Technology Related to Public Safety
purposes, and the eligible electors of the City are further considering, at the same election, a
citizen -initiated ballot question relating to the imposition of an additional sales tax rate for the
operations and capital improvement of the Pueblo Zoo; and
WHEREAS, Section 5-1-10 of the Pueblo Municipal Code and C.R.S. § 31-11-111
authorize the City Council, by resolution or ordinance, to fix the ballot title for each initiative,
referendum, or referred measure to be submitted to the eligible electors of the City; and
WHEREAS, the City Clerk has certified to the Pueblo County Clerk and Recorder the
content of the ballot for the November 3, 2026 election insofar as the City's ballot measures are
concerned; and
WHEREAS, the City Council desires to appoint the City Clerk as the Designated Election
Official for the City with respect to the November 3, 2026 election, and to ratify the City Clerk's
certification of the ballot content; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1
The City Clerk shall be, and hereby is, appointed as the Designated Election Official for
the City with respect to the November 3, 2026, Special Municipal Election, pursuant to C.R.S. §
1-1-104(8) and Section 5-1-12 of the Pueblo Municipal Code.
SECTION 2.
The content of the ballot for the City's Special Municipal Election to be held on
November 3, 2026, as certified by the City Clerk to the Pueblo County Clerk and Recorder, is as
follows:

Ballot Question No. 2A - IMPOSITION OF ONE -QUARTER PERCENT SALES AND USE
TAX FOR DEPARTMENT OF FIRE AND TECHNOLOGY RELATED TO PUBLIC SAFETY
PURPOSES
SHALL THE CITY OF PUEBLO'S TAXES BE INCREASED BY $5,878,267.00
ANNUALLY (FIRST FULL FISCAL YEAR INCREASE) AND BY WHATEVER AMOUNTS
ARE RAISED ANNUALLY THEREAFTER, BEGINNING JANUARY 1, 2027, BY
ADOPTING ORDINANCE NO. 11243 IMPOSING AN ADDITIONAL ONE -QUARTER
PERCENT (0.25%) SALES AND USE TAX AND ESTABLISHING A SPECIAL FUND TO
BE KNOWN AS THE "DEPARTMENT OF FIRE AND TECHNOLOGY RELATED TO
PUBLIC SAFETY SALES AND USE TAX FUND" FOR THE DEPOSIT OF SUCH
REVENUES TO BE SPENT SOLELY FOR DEPARTMENT OF FIRE AND
TECHNOLOGY RELATED TO PUBLIC SAFETY PURPOSES WITHIN THE CITY OF
PUEBLO, AND SHALL ALL REVENUES DERIVED FROM SUCH TAX BE
COLLECTED, RETAINED AND SPENT, NOTWITHSTANDING ANY LIMITATIONS
PROVIDED BY LAW, AS A VOTER -APPROVED REVENUE CHANGE AND AN
EXCEPTION TO THE LIMITS WHICH WOULD OTHERWISE APPLY PURSUANT TO
ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION OR ANY OTHER
LAW?

ANNUALLY (FIRST FULL FISCAL YEAR INCREASE) AND BY WHATEVER AMOUNTS
ARE RAISED ANNUALLY THEREAFTER, FOR FIVE YEARS FROM JANUARY 1, 2027
THROUGH DECEMBER 31, 2031, BY ADOPTING ORDINANCE NO. 11244 IMPOSING
AN ADDITIONAL ONE -SIXTH OF ONE PERCENT (0.167%) SALES TAX AND
ESTABLISHING A SPECIAL FUND FOR THE DEPOSIT OF SUCH REVENUES TO BE
SPENT ONLY FOR THE OPERATIONS AND CAPITAL IMPROVEMENT OF THE
PUEBLO ZOO; AND SHALL ALL REVENUES DERIVED FROM SUCH TAX BE
COLLECTED, RETAINED AND SPENT, NOTWITHSTANDING ANY LIMITATIONS

SECTION 3.
The certification by the City Clerk to the Pueblo County Clerk and Recorder of the
content of the ballot for the November 3, 2026 Special Municipal Election, insofar as the City's
ballot measures are concerned, is hereby ratified in accordance with applicable law.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent
with this Resolution to implement the policies and procedures described herein.
SECTION 5.
This Resolution shall take effect immediately upon final passage and approval.

THE CITY CLERK'S CERTIFICATION OF THE CONTENT OF THE
BALLOT FOR SAID ELECTION
SIIMMORY.
This Resolution appoints the City Clerk as the Designated Election Official for the
November 3, 2026, Special Municipal Election. This Resolution also ratifies the City
Clerk to the certification of the content of the ballot for said election.
PREVIOUS COUNCIL ACTION:
On July 27, 2026, by Ordinance No. 11230, City Council directed that the November 3,
2026, Special Municipal Election be conducted as part of a Coordinated Election with
Pueblo County.
BACKGROUND:
C.R.S. § 1-1-104(8) provides that the designated election official is the person
designated by the governing body as responsible for the running of an election.
Consistent with prior practice, the City Council designates the City Clerk in that role.
C.R.S. § 1-5-203 (3)(a) requires that the Designated Election Official of each political
subdivision participating in a Coordinated Election to certify the order of the ballot and
ballot content. Such certification is to be delivered to the County Clerk and Recorder no
later than sixty (60) days before the Coordinated Election.
FINANCIAL IMPLICATIONS:
The City shall pay to the County Clerk the City's share of the actual cost of materials
and services directly attributable to the City's participation in the Coordinated
Election pursuant to the intergovernmental agreement with Pueblo County.

Funding for the costs associated with conducting this Special Municipal Election is
allocated in the City Clerk's 2026 Departmental Budget.

Not applicable to this Resolution.

Not applicable to this Resolution.
ALTERNATIVES:
If this Resolution is not adopted, the appointment of the City Clerk as Designated
Election Official and the ratification of the ballot content certification will not be
formalized by Council action.
RECOMMENDATION:
Approval of the Resolution.
