ORDINANCE NO. 11254
AN ORDINANCE AUTHORIZING THE DISPOSITION BY
DONATION OF CERTAIN SURPLUS PERSONAL PROPERTY
OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, TO
THE CITY OF CHIHUAHUA, STATE OF CHIHUAHUA OF THE
UNITED MEXICAN STATES
WHEREAS, all matters addressed in this Ordinance are expressly and specifically
declared to be local and municipal matters under Article XX of the Colorado Constitution, as set
forth in Section 1-11-1 of the Pueblo Municipal Code; and
WHEREAS, Section 1-11-3(b)(1) of the Pueblo Municipal Code empowers the Pueblo
City Council, by ordinance adopted at any regular meeting of the City Council and upon such
terms and conditions as the City Council may determine, to sell and dispose of any personal
property owned by the City; and
WHEREAS, the City of Pueblo and the City of Chihuahua, Chihuahua, Mexico, are sister
cities, and the relationship predates April 22, 1991; and
WHEREAS, the Pueblo City Council has approved successive written agreements
formalizing the relationship, including the Sisterhood Agreement dated April 28, 2017, approved
by Resolution No. 13777, which by its terms remains in effect indefinitely, and a further
Cooperation Agreement approved by Ordinance No. 10507 on July 10, 2023; and
WHEREAS, under Article III of the Sisterhood Agreement dated April 28, 2017, the
parties commit to promote training, advice on best practices, courses and coaching to optimize
the police and fire services, and to promote donations of equipment for those sectors; and
WHEREAS, the Pueblo Police Department has determined that the personal property
described in Section 1 of this Ordinance is surplus and is no longer used or needed by the
Department; and
WHEREAS, no item of the property bears a serial number, no item has a unit cost in
excess of fifty dollars ($50.00), and no item appears on the record of non -expendable property
maintained under Section 7-28(g) of the City Charter; and
WHEREAS, the City Council finds and determines that the disposition of the property by
donation to the City of Chihuahua serves a public purpose of the City by carrying out a
commitment made in the Sisterhood Agreement and by sustaining a cooperative public safety
relationship from which the City has drawn training and professional exchange benefits. NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:

SECTION 1
The following personal property owned by the City of Pueblo and held by the Pueblo
Police Department is hereby declared surplus and no longer used or needed by the City:
(a) Twenty-two (22) fabric radio pouches;
(b) Twenty-four (24) fabric flashlight pouches;
(c) Twenty-four (24) fabric OC spray pouches;
(d) Nineteen (19) fabric handcuff pouches;
(e) Twenty-three (23) fabric magazine pouches; and
(f) Loose hook and loop fastener stock removed from decommissioned ballistic vests, uncut and
not configured to fit any particular vest carrier.
SECTION 2.
The disposition of the property described in Section 1 of this Ordinance, by donation and
without consideration, to the City of Chihuahua, State of Chihuahua of the United Mexican
States, for the use of its Direccion de Seguridad Publica Municipal, is hereby approved and
authorized. The property is transferred in its current condition, as is, without warranty of any
kind, and the fastener stock described in Section 1(f) is not represented as suitable for use with
any protective equipment.
SECTION 3.
The Chief of Police is directed to obtain, from an authorized representative of the
receiving agency, a written receipt identifying the property delivered, its intended use, and the
date of delivery, and to file a copy of the receipt with the Purchasing Agent.
SECTION 4.
The officers and staff of the City of Pueblo are authorized to perform any and all acts
consistent with the intent of this Ordinance to effectuate the disposition described herein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

CHIHUAHUA, STATE OF CHIHUAHUA OF THE UNITED MEXICAN

SUMMARY:
Attached is an Ordinance authorizing the donation of surplus fabric duty pouches and
loose hook and loop fastener stock, no longer used or needed by the Pueblo Police
Department, to the City of Chihuahua, State of Chihuahua, Mexico, for the use of its
municipal police agency pursuant to Section 1-11-3(b)(1) of the Pueblo Municipal Code.
The property consists of one hundred twelve (112) fabric pouches and a quantity of
fastener stock removed from decommissioned ballistic vests. The City receives no
payment.
PREVIOUS COUNCIL ACTION:
On May 24, 2021, City Council adopted Ordinance No. 9937, approving an Agreement
to Donate Property and Release of Claims transferring surplus self-contained breathing
apparatus and related equipment from the Pueblo Fire Department to the City of
Chihuahua.
On April 10, 2017, City Council adopted Resolution No. 13657, approving the donation
of one hundred expired and decommissioned ballistic vests to the City of Chihuahua
and its police department.
On May 11, 2015, City Council adopted Resolution No. 13224, approving an equipment
donation agreement transferring a surplus fire pumper, an air compressor and fill
station, and twenty-eight self-contained breathing apparatus bottles to the City of
Chihuahua.

On March 24, 1997, City Council adopted Resolution No. 8095, approving an
equipment sale agreement transferring two used fire trucks to the City of Chihuahua.
BACKGROUND:
The City of Pueblo and the City of Chihuahua, Chihuahua, Mexico, are sister cities. The
relationship predates April 22, 1991, when City Council adopted Resolution No. 6732
reciting that members of the Sister City Commission had visited Chihuahua in a sister
city capacity and that Pueblo City Council desired to maintain and further develop the
relationship. Council has since approved successive written agreements formalizing the
relationship, including the agreement approved by Resolution No. 13038 on August 25,
2014, the Sisterhood Agreement dated April 28, 2017 approved by Resolution No.
13777, and a further Cooperation Agreement approved by Ordinance No. 10507 on
July 10, 2023.
Article III of the April 28, 2017 Sisterhood Agreement addresses public safety directly.
Under that Article the parties commit to promote training, advice on best practices,
courses and coaching to acquire new techniques and methodologies to optimize the
police and fire services, and to promote donations of equipment for those sectors. The
four transfers listed above were made under that framework.
The Training Unit of the Pueblo Police Department has identified the following items as
no longer used or needed: twenty-two (22) radio pouches, twenty-four (24) flashlight
pouches, twenty-four (24) OC spray pouches, nineteen (19) handcuff pouches, and
twenty-three (23) magazine pouches, in mixed navy and black fabric, together with
loose hook and loop fastener stock removed from decommissioned ballistic vests. The
fastener stock is uncut and is not configured to fit any particular vest carrier. No item
bears a serial number, and no item has a unit cost in excess of fifty dollars ($50.00), so
none appears on the record of non -expendable property maintained under Section 7-
28(g) of the City Charter.
Unlike the equipment transferred in 2015, 2017, and 2021, none of this property is
expired, decommissioned, or withdrawn from service for safety reasons. The items are
serviceable and are surplus only because the Department no longer needs them.
Sergeant Ortega of the Pueblo Police Department will deliver the property to the
receiving agency, the Direccion de Seguridad Publica Municipal of the City of
Chihuahua.
FINANCIAL IMPLICATIONS:
The City of Pueblo receives no payment. The property is of nominal value. No
appropriation is required and the Ordinance creates no ongoing cost obligation.

ALTERNATIVES:
If this Ordinance is not approved, the property cannot be donated. The Purchasing
Agent would dispose of it by sealed bid sale under Section 7-28(f) of the City Charter,
or the Police Department would continue to hold it in storage. Neither course produces
meaningful revenue for the City, and neither serves the sister city relationship.
RECOMMENDATION:
Approve the Ordinance.
