A RESOLUTION TRANSFERRING $232,369.13 FROM
PROJECT C12113 - CITY OF PUEBLO WASTEWATER

STREET AND $396,450.56 FROM PROJECT C12113 - CITY OF
PUEBLO WASTEWATER INFRASTRUCTURE - NORTHERN
AVENUE SEWER, WITH $25,000 TO BE TRANSFERRED TO
PROJECT C12113 - EL CENTRO RENOVATIONS AND THE
REMAINDER TO PROJECT C12113 - NEIGHBORHOOD TRASH
CLEANUP, AS AN EXPANSION OF PROGRAM SERVICES
CONSISTENT WITH U.S. TREASURY SLFRF GUIDANCE.
WHEREAS, the City Council previously appropriated American Rescue Plan Act
("ARPA") State and Local Fiscal Recovery Funds ("SLFRF") for Project C12113 — Wastewater
Infrastructure — West 11th Street to West 21st Street and Project C12113 — Wastewater
Infrastructure — Northern Avenue Sewer, both of which have completed their intended scopes
and retain unexpended balances; and
WHEREAS, the U.S. Treasury's SLFRF Final Rule and obligation guidance permit
recipients to reclassify excess obligated SLFRF funds to other eligible, previously obligated
projects, and further authorize use of SLFRF funds to cover increased costs associated with
obligated projects; and
WHEREAS, Project C12113 — El Centro Renovations was obligated prior to December
31, 2024 and requires an additional $25,000 to complete the back stoop exiting the gym due to
cost increases; and
WHEREAS, Project C12113 — Neighborhood Trash Cleanup was authorized by
Resolution No. 15039 for cleanup activities in Qualified Census Tracts ("QCTs"), and
transferring the remaining funds to this project represents an expansion of program services
fully consistent with its original scope and allowed uses under Resolution No. 15039, not a
change in scope; NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The City hereby authorizes the transfer of:
$232,369.13 from Project C12113 — Wastewater Infrastructure — West 11th Street to West 21st
Street, and $396,450.56 from Project C12113 — Wastewater Infrastructure — Northern Avenue
Sewer, with: $25,000 transferred to Project C12113 — El Centro Renovations to complete the
back stoop exiting the gym; and the remainder, $603,819.69, transferred to Project C12113 —
Neighborhood Trash Cleanup.

SECTION 2.
These transfers do not constitute a change in the scope of either receiving project. The
additional funds will be used to expand program services consistent with the original
authorization in Resolution No. 15039, including cleanup activities in Qualified Census Tracts
and related operational support.
SECTION 3
This action is compliant with U.S. Treasury SLFRF guidance permitting recipients to
reclassify excess obligated funds to previously -obligated eligible projects, and to cover
increased costs associated with obligated project activities.
SECTION 4.
City staff are hereby authorized to perform all acts necessary or desirable to implement
this Resolution.
SECTION 5
This Resolution shall become effective immediately upon final passage

SUMMARY:
This Resolution authorizes the transfer of unused American Rescue Plan Act (ARPA)
State and Local Fiscal Recovery Funds (SLFRF) from two completed Wastewater
Infrastructure projects into two existing ARPA-authorized projects: El Centro
Renovations and Neighborhood Trash Cleanup (Project C12113). Specifically:
$232,369.13 from C12113 — Wastewater Infrastructure — West 11th Street to West 21st
Street
$396,450.56 from C12113 — Wastewater Infrastructure — Northern Avenue Sewer
Of these amounts:
$25,000 is transferred to Project C12113 — El Centro Renovations to address cost
increases associated with completing the back stoop exiting the gym; and
The remaining $603,819.69 is transferred to Project C12113 — Neighborhood Trash
Cleanup.
These transfers do not change the scope of either receiving project but constitute an

expansion of program services fully permitted under Treasury rules.
PREVIOUS COUNCIL ACTION:
City Council previously established and obligated all above -referenced ARPA projects
prior to the federal obligation deadline of December 31, 2024.
City Council previously obligated ARPA funds for:
• The Wastewater Infrastructure - West 11th Street to West 21st Street Project via
Resolution 14947
• C12113 — City of Pueblo Wastewater Infrastructure — Northern Avenue Sewer via
Resolution 14948
• The El Centro Renovations Project via Resolution 14854, and
• The Neighborhood Trash Cleanup Project via Resolution 15039
BACKGROUND:
Both Wastewater Infrastructure projects have concluded their planned scopes and
retain unspent ARPA balances. Treasury SLFRF guidance allows recipients to
reclassify or transfer excess obligated funds to another eligible, previously obligated
project when the receiving project remains active and within allowed uses. This is
reinforced in Treasury SLFRF expenditure guidance, which states:
"Recipients may reclassify funds to another project if the project is an eligible activity
and was obligated by December 31, 2024."
"Recipients may use SLFRF funds to cover increased costs for contracts that allow
change orders as long as the contracts were obligated by December 31, 2024."
The transfer to El Centro Renovations covers necessary cost increases related to the
gym back stoop.
The transfer to Neighborhood Trash Cleanup (C12113) supports continued cleanup
operations consistent with Resolution 15039, including personnel, equipment use,
trash/debris removal, and other QCT services. These are not new scope items, but
expanded program services already within the original authorization.
Treasury SLFRF guidance emphasizes that recipients must complete all programmatic
activities by December 31, 2026, and expanding such activities within an obligated
project is allowable.

Total Transferred ARPA Funds:
$232,369.13 from C12113 - Wastewater Infrastructure — West 11th St to West 21st St
with $25,000 going to C12113 - El Centro Renovations & the balance going to C12113 -
Neighborhood Trash Cleanup.

ALTERNATIVES:
Council may decline the transfers. If so, the El Centro project would remain
underfunded, delaying required safety improvements, and Neighborhood Trash
Cleanup would not have the funding to continue services in the qualified census tracts.

Approval of this Resolution.
