CONCERNING PROFESSIONAL ENGINEERING SERVICES FOR SOUTH LANDFILL AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAME BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The Amendment to Agreement dated April 9, 1990 by and between KLH Engineering Consultants, Inc. ( "Engineer ") and the City of Pueblo, a true copy of which is on file in the office of the City Clerk ( "Amendment "), which modifies and extends the Agreement between Engineer and the City of Pueblo dated February 11, 1985, concerning professional engineering services for the south land- fill, be and hereby is approved and the City Manager authorized and directed to execute same for and on behalf of the City, and the City Clerk to affix the seal of the City and attest same. SECTION 2. Unexpended appropriations in Account No. 001 -790 in an amount not to exceed $40,000 shall be transferred to Account No. 001- 0900- 900 - 000 - 900 -902. All fiscal obligations of the City of Pueblo incurred pursuant to the Amendment shall be appropriated and made by expenditure from Account No. 002- 1985 -100- 000 -040- 8520. INTRODUCED: April 9, 1990 ATTEST: 4 City Clerk By HOWARD WHITLOCK Councilman APPROVED: G President of the Cit Council AMENDMENT TO AGREEMENT FOR ENGINEERING SERVICES THIS INSTRUMENT, made and executed this 9th day of April, 1990, by and between the City of Pueblo, a Municipal Corporation (hereinafter "City ") and KLH Engineering Consultants, Inc., a Colorado Corporation (hereinafter "Engineer "). WITNESSETH, That in consideration of the mutual covenants and conditions set forth herein, the City and Engineer agree as follows: 1. That certain Contract between City and Engineer dated February 11, 1985 ( "Contract ") is amended and modified as provided by the terms of this Amendment. The parties agree, however, that nothing in this Amendment is intended to, nor shall be construed as, releasing Engineer from any of his contractual or professional duties or responsibilities under the Contract or with respect to the services which were to have been performed thereunder. 2. The term of the Contract is extended to and until December 31, 1990. 3. In addition to the services to be furnished by Engineer under the Contract, Engineer shall perform the professional services and prepare the reports described in Engineer's July 24, 1989 letter to City, attached hereto as Exhibit A. 4. Engineer shall perform all quality control, construction observations and verify in writing to the County of Pueblo and State of Colorado that the specifications for soil type, runon diversion berms, final cover contours, final cover compaction, landfill and leachate pond liner compaction, and monitor well construction have been achieved, in accordance with the require- ments for such quality control observation and written verifica- tions set forth in the Certificate of Designation Requirements for the landfill including those set forth in the Amendment to Certificate of Designation approved December 13, 1988. 5. City shall pay additional compensation to Engineer for consulting services; Section II, Item 5 of Contract being amended to provide for Engineer to be compensated for consulting services during calendar year 1990 at the time and material rates set forth in Exhibit B hereto. Engineer shall submit monthly statements reflecting the services performed and itemizing the labor and materials furnished. The monthly requests for payment must be approved by City's Director of Public Works prior to payment becoming due to Engineer. In no event shall additional compensa- tion to Engineer hereunder exceed $40,000 for the duration of calendar year 1990. (303) 544 -6823 July 24, 1989 Tom Cvar Director of Public Works City of Pueblo Pueblo, Colorado Re: Pueblo South Landfill KLH 80 117 02 KLH letter dated 4 -17 -89 Dear Tom, We have been asked by City Attorney Tom Florczak, to expand the definitions of the engineering services that KLH Engineering Consultants, Inc. will be performing on the extension of duties under the original contract (P.O. 5 -00 -889). KLH proposes to continue engineering services to support the City in the implementation of the extension of the Certificate of Designation (COD) to approximately March 31, 1991. The following tasks were agreed upon verbally as follows: 1. Administer the Modification of Landfill Plan, to suite require- ments of operation by Zupan. As part of the Plan of Extension of the COD, a greater portion of the "west'area of the landfill needed to show a "re- grading plan" to include some overfilling and to allow additional fill during the 3rd and 4th quarter of 1988, and the lst quarter of 1989. KLH was required to set grades and indicate areas to be filled. Again, as Zupan moves into the "mounding" operation on the east side of the landfill area, locations and grade stakes are to be set as a guide to orderly fill operations by Zupan. 2. & 3. Prepare quarterly reports on progress of plan thru closure (expected by March 31, 1991) and continue consulting services. These are duties of KLH performed as Task 5 of the Original Contract, and include consulting services to March 31, 1991, as follows: A registered professional engineer is required to provide a quarterly report to the City that all requirements of the design, construction and monitoring, as required by the Certificate of Designation, are being achieved. The consultant will assist and advise the contractor in complying with engineering design on the drainage, final cover, testing for density on each lift of fill, targeting the different EXHIBIT A — Page Two 7/24/89 soil types to be used. The consultant will also be required to certify to the County and State Health Department that the proper soil is being used, that run on diversion berms are used, that final cover contours and compaction are being observed and achieved. The design of the ground water monitor system (Task 1 of original contract) and construction of surface water diversion system (Task 2) and design of methane monitoring system (Task 3) are all complete and need no further attention. Task 4 of the original contract, "to provide as'built drawings on Tasks 1, 2 & 3 are now complete and no further services needed.
