HomeMy WebLinkAbout16412Docusign Envelope ID: A678F306-1 95C -8B32 -82B E-1 6359A026079 RESOLUTION NO. 16412 A RESOLUTION ESTABLISHING THE AIRPORT POLICY ADVISORY COMMITTEE WHEREAS, Section 14-1 of the Charter of the City of Pueblo, a Colorado Municipal Corporation, creates a Department of Aviation, the head of which is the Director, and provides that the Department shall be responsible for such functions as shall be determined by ordinance of the City Council; and WHEREAS, Section 3-1-2(b) of the Pueblo Municipal Code provides that all users of and persons on the airport shall be governed by the Code and the rules, regulations and procedures that will from time to time be promulgated by the Airport Manager, and Section 3-1-1(d) of the Pueblo Municipal Code defines Airport Manager to mean the Director of Aviation; and WHEREAS, Section 3-1-2(l) of the Pueblo Municipal Code, Airport Policies and Procedures, subjects all users of and persons on the airport to the Storm Water Management Plan, the Spill Prevention Control and Countermeasure Plan and other environmental regulations; to the policies, rules, regulations and procedures of the airport; and to the minimum standards, business licensing policy, permitting policy and rates and charges now in effect or hereafter adopted or revised for the airport; and WHEREAS, revised Rules and Regulations and revised Minimum Standards for Pueblo Memorial Airport are in preparation, and the airport policies and procedures described in Section 3-1-2(l) of the Pueblo Municipal Code govern entry, operation and conduct at the airport; and WHEREAS, City Council finds that the preparation and future revision of those instruments will benefit from the counsel of persons who hold experience in aviation and airport operations; and WHEREAS, Section 2-5 of the Charter provides that all boards and commissions shall be appointed by the Mayor, subject to Council confirmation, that appointments by the Mayor shall specify the term of office of each individual in order to achieve overlapping of tenure, and that all boards and commissions shall choose their own chairmen; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. There is hereby established the Airport Policy Advisory Committee (the "Committee") as an advisory committee to the Mayor and City Council. The Committee shall consist of five (5) members to serve without compensation. Four (4) members shall be appointed by the Mayor, subject to Council confirmation, and shall be subject to removal by the Mayor. The Director of Aviation shall serve as a voting member by virtue of office. Each appointed member should have experience in aviation or airport operations or other demonstrated involvement with Pueblo Memorial Airport. Appointed members shall be appointed for terms of four (4) years, provided that members initially shall be appointed for staggered terms. Of the members initially appointed, two (2) shall be appointed for terms of two (2) years and two (2) shall be appointed for terms of four (4) years. The Mayor shall make an appointment, subject to Council confirmation, for any unexpired term in the event a vacancy arises. The Committee shall select its own officers and may adopt bylaws not inconsistent with this Resolution. SECTION 3. The functions of the Committee shall be as follows: a) To review and make recommendations to the Mayor and the Director of Aviation on the content, adoption and revision of the environmental regulations described in Section 3-1-2(l)(1) of the Pueblo Municipal Code. b) To review and make recommendations to the Mayor and the Director of Aviation on the content, adoption and revision of the policies, rules, regulations and procedures of the airport described in Section 3-1-2(l)(2) of the Pueblo Municipal Code, including the Rules and Regulations for Pueblo Memorial Airport. c) To review and make recommendations to the Mayor and the Director of Aviation on the content, adoption and revision of the minimum standards, business licensing policy, permitting policy and rates and charges described in Section 3- 1-2(l)(3) of the Pueblo Municipal Code, including the Minimum Standards for Pueblo Memorial Airport. d) To review and make recommendations on such other airport matters as the Mayor or the Director of Aviation may refer to the Committee. e) To make periodic reports, and reports upon request of the Mayor or City Council, with respect to its activities. Recommendations of the Committee are not binding, and nothing in this Resolution divests the Airport Manager of the authority to promulgate rules, regulations and procedures conferred by Section 3-1-2(b) of the Pueblo Municipal Code. The Committee shall make no recommendation concerning the Charter, the Pueblo Municipal Code, or any ordinance or resolution pending or proposed before the City Council. SECTION 4. The Committee shall have no regular staff or budget but may request administrative assistance, which the Mayor may assign. The Committee is a local public body within the meaning of Section 24-6-402(1)(a)(I), C.R.S. Notice of its meetings shall be given as provided in Section 24-6-402(2)(c), C.R.S., and minutes shall be taken and promptly recorded as provided in Section 24-6-402(2)(d)(II), C.R.S. SECTION 5. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Resolution to implement the policies and procedures described therein. PREVIOUS COUNCIL ACTION: There has been no previous Council action regarding the Airport Policy Advisory Committee. City Council has previously acted with respect to a separate airport committee. The Pueblo Memorial Airport Advisory Committee was established by Resolution No. 8793 on September 13, 1999. On May 22, 2006, Resolution No. 10727 repealed Resolution No. 8793 and reestablished that committee at eleven members. On March 8, 2021, Resolution No. 14575 repealed Resolution No. 10727 and reestablished that committee to conform the appointment process to Section 2-5 of the City Charter as amended. BACKGROUND: Section 14-1 of the Charter creates a Department of Aviation, the head of which is the Director, and provides that the Department shall be responsible for such functions as shall be determined by ordinance of the City Council. Section 3-1-2(b) of the Pueblo Municipal Code provides that all users of and persons on the airport shall be governed by the Code and the rules, regulations and procedures that will from time to time be promulgated by the Airport Manager, which Section 3-1-1(d) defines to mean the Director of Aviation. Section 3-1-2(l), Airport Policies and Procedures, subjects those persons to the Storm Water Management Plan, the Spill Prevention Control and Countermeasure Plan and other environmental regulations; to the policies, rules, Docusign Envelope ID: A678F306-1 95C -8B32 -82B E-1 6359A026079 regulations and procedures of the airport; and to the minimum standards, business licensing policy, permitting policy and rates and charges now in effect or hereafter adopted or revised for the airport. Revised Rules and Regulations and revised Minimum Standards for Pueblo Memorial Airport are in preparation. Those instruments and the other policies described in Section 3-1-2(l) govern entry, operation and conduct at the airport, and they are incorporated by reference in leases and operating agreements at the airport. Four members are appointed by the Mayor, subject to Council confirmation, for four year terms with initial terms staggered, and the Director of Aviation serves as a voting member by virtue of office. Each appointed member should have experience in aviation or airport operations or other demonstrated involvement with Pueblo Memorial Airport. Members serve without compensation. The Committee selects its own officers and may adopt bylaws not inconsistent with the Resolution. Recommendations of the Committee do not bind the Airport Manager, who retains the promulgation authority conferred by Section 3-1-2(b) of the Pueblo Municipal Code. The Committee makes no recommendation concerning the Charter, the Pueblo Municipal Code, or any ordinance or resolution pending or proposed before the City Council. Section 3 of Resolution No. 14575 assigns the Pueblo Memorial Airport Advisory Committee the functions of investigating, evaluating, promoting and recommending programs for commercial airlines and general aviation services at Pueblo Memorial Airport, creating a community awareness program as to the availability and use of air service at the airport, and making periodic reports of its activities to the Mayor, City Council and the Board of Pueblo County Commissioners. Those functions do not reach the airport policies and procedures described in Section 3-1-2(l) of the Pueblo Municipal Code. The Airport Policy Advisory Committee does not replace that committee. FINANCIAL IMPLICATIONS: There are no financial implications for the City. Members of the Committee serve without compensation, and the Committee has no regular staff or budget. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: If City Council does not approve this Resolution, the status quo continues. The Department of Aviation would prepare and revise the airport policies and procedures described in Section 3-1-2(l) of the Pueblo Municipal Code without a standing advisory body.
