ORDINANCE NO. 11250
AN ORDINANCE APPROVING THE MEMORANDUM OF
UNDERSTANDING BETWEEN THE PUEBLO COUNTY
SHERIFF'S OFFICE AND THE PUEBLO POLICE DEPARTMENT
REGARDING THE ALTERNATE AND DEFAULT ROUTING OF
E911 CALLS FOR EACH PUBLIC SAFETY ANSWERING POINT,
AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1 _
The MOU between the Pueblo County Sheriff's Office and the Pueblo Police
Department, a copy of which is attached hereto and incorporated herein, is approved.
SECTION 2.
The Mayor is hereby authorized to execute the MOU in the name and on behalf of the
City of Pueblo, where the Mayor may execute the MOU by electronic signature and such
electronic signature shall be attributable to the Mayor and the City of Pueblo.
SECTION 3
The officers and staff of the City of Pueblo are directed and authorized to perform any
and all acts consistent with the intent of this Ordinance and the attached agreements to
effectuate the transactions described therein.
SECTION 4.
If any section, paragraph, clause, or provision of this Ordinance shall for any reason be
held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph,
clause, or provision shall not affect any of the remaining provisions of this Ordinance.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUBJECT: AN ORDINANCE APPROVING THE MEMORANDUM OF
UNDERSTANDING BETWEEN THE PUEBLO COUNTY SHERIFF'S
OFFICE AND THE PUEBLO POLICE DEPARTMENT REGARDING THE
ALTERNATE AND DEFAULT ROUTING OF E911 CALLS FOR EACH
PUBLIC SAFETY ANSWERING POINT, AND AUTHORIZING THE
MAYOR TO EXECUTE THE SAME
SUMMARY:
This Ordinance approves a MOU between the Pueblo County Sheriff's Office
Communications Center ("SOCC") and the Pueblo Police Department's Communication
Center ("PDCC") to establish an understanding for the routing and handling of alternate
and default routed E911 calls at each Public Safety Answering Point ("PSAP").
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
Alternate routing of E911 calls may occur for two reasons: 1.) An emergency situation
exists that requires the evacuation of the communications center; or 2.) A disruption to
phone service at the respective PSAP occurs requiring all 911 calls to be routed to the
alternate PSAP.
Default routing may occur when all 911 trunks into a PSAP are busy. All overload calls
will then automatically be routed to another pre -designated PSAP.
The Pueblo Police Department's Communication Center (PDCC) is the PSAP for the
City of Pueblo. E911 calls made within city limits are routed to PDCC. The PDCC will
be the designated alternate and default routing point for SOCC's E911 calls.
The Pueblo County Sheriff's Office Communications Center (SOCC) is the PSAP for

Pueblo County. E911 calls made within Pueblo County, outside of city limits, are routed
to SOCC. The SOCC will be the designated alternate and default routing point for
PDCC's E911 calls.
FINANCIAL IMPLICATIONS:
None.
BOARD/COMMISSION RECOMMENDATION:
Consideration of The Board of Pueblo County Commissioners will be dependent on
approval of this Ordinance.

MEMORANDUM OF UNDERSTANDING
BETWEEN PUEBLO COUNTY SHERIFF'S OFFICE COMMUNICATION CENTER
AND THE CITY OF PUEBLO POLICE DEPARTMENT COMMUNICATIONS
CENTER FOR ALTERNATE AND DEFAULT ROUTING OF E911 CALLS
I. PURPOSE AND INTENT OF MEMORANDUM
This Memorandum of Understanding ("MOU") between Pueblo County Sheriff's Office
Communications Center ("SOCC") and City of Pueblo Police Department Communications
Center ("PDCC") is designed to establish an understanding for the routing and handling of
alternate and default routed E911 calls at each Public Safety Answering Point ("PSAP").
II. OVERVIEW
SOCC will be the designated alternate and default routing point for PDCC's E91 I calls.
PDCC will be the designated alternate and default routing point for SOCC's E911 calls.
III. DEFINITION OF TERMS
Alternate routing may occur for two reasons: 1.) An emergency situation exists that requires the
evacuation of the communications center; or 2.) A disruption to phone service at the respective
PSAP occurs requiring all 911 calls to be routed to the alternate PSAP.
Default routing may occur when all 911 trunks into a PSAP are busy. All overload calls will
then automatically be routed to another pre -designated PSAP.
IV. PSAP RESPONSIBILITIES
Each PSAP shall establish written procedures to enable its agency to comply with this MOU.
Each PSAP shall set its own alternate and default -routing to the other PSAP via 911 .net.
Each PSAP shall provide a workstation for each of the affected PSAP's dispatchers with the
affected PSAPs radio talk groups available for communication with field units.
V. ALTERNATE ROUTED CALLS
SOCC and PDCC agree to accept alternate routed calls for each other. The PSAP required to
have its 911 calls alternate routed will notify the receiving PSAP of the situation. The affected
PSAP will immediately send at least two dispatchers to the receiving PSAP to assist in handling
the additional call load.
The PSAP receiving the alternate -routed 911 calls will take all the information necessary to
handle the emergency. The information will be forwarded to the affected agency for dispatch of
proper units until such time as the responding dispatchers arrive to handle the calls for their
agency.

VI. DEFAULT ROUTED CALLS
SOCC and PDCC agree to accept default -routed calls for each other. The receiving PSAP will
take all of the information necessary to handle the emergency and forward the information to the
affected PSAP for dispatch of proper units.

VIII. TERM AND MODIFICATION
Term. This MOU will become effective upon the execution by both parties. The initial term of
this MOU shall be through December 31, 2031. Thereafter, this MOU may be renewed for an
additional five-year period upon written agreement of both parties and subject to the termination
provision below.
Termination. Notice of intent to terminate this MOU shall be provided in writing no later than
July 31St of any annual term.
Modification. This MOU constitutes the entire agreement between the parties with respect to
the specific matters contained herein and supersedes all previous discussions, understandings,
and agreements. Any amendments to or waivers of the provisions herein shall be made by the
parties in writing. No other agreements, oral or otherwise, regarding the subject matter of this
MOU shall be deemed to exist or to bind either party hereto.
IX. COST ASSOCIATED WITH THE AGREEMENT
Any cost associated with the implementation of this Agreement shall be the responsibility of the
party incurring the cost.

All financial obligations of parties under this MOU, in any calendar year, are contingent upon
funds for that purpose being budgeted and appropriated by each Party's governing body on or
before December 31 of the prior calendar year. Failure to budget and appropriate such funds by
December 31 for any subsequent calendar year shall constitute an event of non -appropriation.
Notwithstanding anything to the contrary in this MOU, in the event of non -appropriation, either
party may terminate this MOU upon thirty (30) days prior written notice given to the other Party.
XI. ASSIGNMENT OF RISK
The respective parties cannot, and by this agreement do not, agree to indemnify, hold harmless,
or assume the defense of the other party. To the maximum extent permitted by law, and without
waiving any of the rights, immunities and protections provided by the Colorado Governmental
Immunity Act, § 24-10-101, et seq., C.R.S., the parties agree that each shall be responsible for
any liability arising from the acts or omissions, intentional or negligent, of its officers, agents and
employees.
