HomeMy WebLinkAbout16377Docusign Envelope ID: 4812E3BA-6CFF-881C-83E7-7F90AA806F2C RESOLUTION NO. 16377 A RESOLUTION APPROVING THE SERVICE PLAN FOR JACKSON RANCH METROPOLITAN DISTRICT NOS. 1-7 WHEREAS, a proposed Consolidated Service Plan for Jackson Ranch Metropolitan District Nos. 1-7 (collectively, the "Districts") was filed with the City Clerk (the "City Clerk") of the City of Pueblo, a Colorado Municipal Corporation (the "City"), pursuant to Section 32-1-204.5, C.R.S.; and WHEREAS, the City Council of the City (the "Council") held a public hearing on said Service Plan on July 27, 2026; and WHEREAS, notice of said public hearing was duly published in the "Pueblo Chieftain," a newspaper of general circulation within the boundaries of the Districts, on June 28, 2026; and WHEREAS, a notice of the date, time, and location of the public hearing was mailed on July 7, 2026, to the governing body of the existing municipalities and special districts which have levied an ad valorem tax within the next preceding tax year and which have boundaries within a radius of three miles of the proposed boundaries of the Districts and, on July 7, 2026, to the petitioner and to the property owner; and WHEREAS, the Council has considered the Service Plan in reference to the information and criteria required and set forth in Section 32-1-202(2) and Section 32-1-203(2), C.R.S., and in light of testimony and other evidence presented to it at said public hearing; and WHEREAS, the Council hereby finds that the Service Plan should be approved as provided herein, pursuant to Section 32-1-204.5, C.R.S., NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The information contained within the Service Plan for Jackson Ranch Metropolitan District Nos. 1-7 satisfies the requirements of Section 32-1-202(2), C.R.S. SECTION 2. Evidence satisfactory to the Council of each of the following was presented, as provided in Section 32-1-202(2) and 32-1-203(2), C.R.S.: a. There is sufficient existing and projected need for organized service in the area to be served by the proposed Districts; and, b. The existing services in the areas to be served by the proposed Districts are inadequate for present and projected needs; and, c. The Districts are capable of providing economical and sufficient services to the areas within their proposed boundaries; and, d. The areas to be included in the Districts do have, and will have, the financial ability to discharge the proposed indebtedness on a reasonable basis. The requirements of Section 32-1-204.5, C.R.S., and of the applicable provisions of the Pueblo Municipal Code, if any, relating to the contents and standards for approval of the Service Plan, have been fulfilled. SECTION 4. The Council hereby approves and authorizes the attachment of this Resolution to the respective Petitions for organization of the Districts to be filed in the District Court in accordance with Section 32-1-205, C.R.S., and Section 32-1-301, C.R.S. SECTION 5. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Resolution to implement the policies and procedures described herein. SECTION 6. This Resolution shall become effective immediately upon final passage and approval. The area where the districts would be established totals approximately eight hundred ninety-nine (899) acres located south of State Highway 78 and west of Little Burnt Mill Road, in the City of Pueblo, Pueblo County, Colorado. In accordance with Section 32-1-204.5, C.R.S., City Council is required to approve the Service Plan prior to proceeding with the remaining steps to form the districts under state statutes. PREVIOUS COUNCIL ACTION: None. BACKGROUND: City Council's approval of the Consolidated Service Plan for Jackson Ranch Metropolitan District Nos. 1-7 (collectively, the "Districts," and the plan, the "Service Plan") is the initial step in creating metropolitan districts under Title 32 of the Colorado Revised Statutes. The proposed Districts are located generally east and south of the Southside Landfill, southwest of the Ventana Subdivision, and northwest of Little Burnt Mill Road, in the City of Pueblo, Pueblo County, Colorado, and cover approximately 899 acres of currently undeveloped land. The Service Plan sets forth the financing, construction, operation, and maintenance of the public improvements and services to be provided within the service area. The Districts are proposed to be formed as separate, distinct legal entities from the City, each with its own elected board of directors under the Colorado Special District Docusign Envelope ID: 4812E3BA-6CFF-881C-83E7-7F90AA806F2C Act. Subject to voter approval, the Districts will have authority to impose mill levies on property within their respective boundaries to finance authorized services and debt payments, as more specifically described in the Service Plan. The proposed Districts may not deviate in any material manner from the requirements of the Service Plan. The Service Plan consists of a description of the proposed services, financial analyses, and general engineering plans showing how proposed facilities and services will be provided and financed. The Service Plan provides a general description of the facilities to be constructed, general estimated costs, and the standards of construction, including a statement that the facility and service standards of the Districts will be compatible with those of the City. Approval of the Service Plan by City Council does not imply any approval by the City of any development plan or improvement plan that is utilized or described in the Service Plan. The seven -district structure is intended to provide flexibility to finance, operate, and maintain the public improvements needed to serve the Project as it phases in over time and to accommodate different anticipated land uses, including residential, commercial, industrial, and mixed -use property. The Districts are expected to enter into one or more intergovernmental agreements among themselves to govern the financing, installation, and construction of the improvements contemplated in the Service Plan, and each District will be responsible for coordinating the operation and maintenance of improvements within its boundaries, including any decision regarding the imposition of operations and maintenance mill levies. The initial boundaries of each District are as follows: District No. 1, approximately 136.45 acres; District No. 2, approximately 47.06 acres; District No. 3, approximately 122.81 acres; District No. 4, approximately 133.90 acres; District No. 5, approximately 88.70 acres; District No. 6, approximately 146.25 acres; and District No. 7, approximately 223.70 acres. The Service Plan permits the boundaries of each District to be adjusted from time to time by inclusions and exclusions in accordance with Sections 32-1-401 et seq. and 32-1-501 et seq., C.R.S. The Service Plan provides for the planning, design, acquisition, construction, installation, relocation, redevelopment, and financing of street, water, sanitation, safety protection, park and recreation, transportation, and limited fire protection improvements and services, as well as security services and covenant enforcement services within and outside the service area. Under the Service Plan, the Districts are authorized to provide such additional services and exercise such powers as are expressly or impliedly granted by Colorado law, subject to the limitations contained in the Service Plan. The City is not obligated to own, operate, or maintain any of the improvements provided by the Districts, although any improvements ultimately accepted by the City must be designed and constructed in compliance with City Standards and the Pueblo Municipal Code. Improvements not dedicated to the City for ownership, operation, and maintenance may be owned, operated, and maintained by the Districts or by other appropriate entities. The estimated cost of the public improvements is approximately $57,590,127 in 2026 Docusign Envelope ID: 4812E3BA-6CFF-881C-83E7-7F90AA806F2C dollars. The Service Plan provides that the total Debt the Districts may issue, in the aggregate, shall not exceed $75,000,000. The Financial Plan provides for a Maximum Debt Mill Levy of sixty (60) mills for the payment of principal and interest on Debt that exceeds fifty percent (50%) of a District's assessed valuation, subject to adjustment for changes in the method of calculating assessed valuation or any constitutionally or legislatively mandated tax credit, cut, or abatement. Debt that is equal to or less than fifty percent (50%) of a District's assessed valuation is not subject to the Maximum Debt Mill Levy. The Maximum Debt Mill Levy Imposition Term is forty (40) years from the year of initial imposition, subject to refunding as permitted by Section 11-56-101 et seq., C.R.S. FINANCIAL IMPLICATIONS: Approval of the Service Plan does not impose any liability on the City, nor create any responsibility or liability on the part of the City for any of the Districts' obligations. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Notice of the filing of the Service Plan with the City Clerk has been distributed to all existing taxing districts within the service area of the proposed Districts. Notice of the public hearing on the proposed Service Plan has been mailed to taxing entities with boundaries within a three-mile radius of the proposed Districts in accordance with Title 32, Colorado Revised Statutes. Publication of the public hearing on the proposed Service Plan was made in the Pueblo Chieftain newspaper, in accordance with Title 32, Colorado Revised Statutes. ALTERNATIVES: If the Service Plan is not approved, the proponent will be unable to proceed with the formation of the Districts, which requires Council's prior approval of the Service Plan under C.R.S. § 32-1-204.5 as a precondition to filing the organizational petition under C.R.S. § 32-1-301.
