Project Account C12617, Eagleridge Blvd Cul-De-Sac is hereby established. SECTION 2 Funds in the amount of $150,000.00 are hereby transferred, budgeted and appropriated from Deposit Account D0103, Commercial Building Escrows to Project Account C12617, Eagleridge Blvd Cul-De-Sac. SECTION 3. Amendment No. 8, by and between the City of Pueblo, a Municipal Corporation, and Short -Elliott -Hendrickson, Inc., a Colorado Corporation, a copy of which is attached hereto, having been approved as to form by the City of Pueblo Attorney, is hereby approved, and City Council authorizes the additional work contemplated by Amendment No. 8 to be performed in the amount of $17,070.00. BACKGROUND: QQ Operating Holding Company, LLC, will be constructing a Quick Quack Car Wash on the southeast corner of Eagleridge Blvd. and Dillon Dr. As part of the development project, the developer is responsible to construct public improvements to mitigate the impacts of activities generated by the development. The City has been awarded a Highway Safety Improvement Program (HSIP) grant for the construction of a new roundabout that will improve the safety of all roadway users at the intersection. The project covers many of the improvements that would have otherwise been required by the developer, but required improvements to the easternmost end of Eagleridge Boulevard was not included within the City's roundabout project scope. Because of existing site conditions on the eastern leg of the Dillon/Eagleridge intersection and the anticipated timing of the City's roundabout construction project, it is likely that significant portions of Quick Quack Operating Holding Company's work will need to be redone to accommodate the roundabout construction project. Rather than removing the newly -installed improvements, it is in both parties' best interests for the City to perform the additional work as part of its roundabout project and for the Developer to provide funds to cover the anticipated cost of the additional work. Amendments No. 1 through No. 3 were executed by the purchasing agent as they were determined to be minor amendments. Amendment No. 1 to this contract was to clarify and more specifically identify the scope of work to be performed under the agreement. Amendment No. 2 to this contract was to provide a rate change, allowing 2022 staff and Docusign Envelope ID: 14D47584-BCF8-8DD5-8049-2212D3AB4E11 rate updates to the existing contract. This amendment did not increase the $229,243.00 base contract compensation. Amendment No. 3 to this contract was to add additional services for traffic study and Operations Evaluation Level 1 as required by CDOT. This amendment increased the base contract amount by $22,228.00. Amendment No. 4 provided additional services for an Operations Evaluation Level 2 as required by CDOT and increased the base contract amount by $18,685.00, making the contract amount $270,156.00. Amendment No. 5 provided additional work for the project to upsize the sanitary sewer mains located in the same footprint of the proposed roundabout and increased the base contract by $22,031.00, making the contract amount $292,187.00. Amendment No. 6 is related to the revised geometry requested by City of Pueblo staff and the traffic forecasting data that was provided, additional survey and design of the I- 25 Northbound off -ramp as requested by CDOT, as well as supplemental SUE for the additional survey limits and additional fiber that has been installed along the project limits. Amendment No. 7 is to provide right-of-way staking for acquisition of easements, redesign of the Dillon Drive median, and development of conceptual construction phasing and traffic control plans. The proposed Amendment No. 8 is to provide the design for the cul-de-sac at the east end of Eagleridge Boulevard. FINANCIAL IMPLICATIONS: Funds in the amount of $150,000.00 will be transferred, budgeted and appropriated, from Deposit Account D0103 - Commercial Building Escrows to Project Account C12617, Eagleridge Blvd Cul-De-Sac. Funding for Amendment No. 8 ($17,070.00) will be paid from Project Account C12617, Eagleridge Blvd Cut -De -Sac. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. The roundabout shall provide a free -flow condition for all turning movements to eliminate the existing stop -controlled intersection configuration. Medians and concrete curb and gutter, as well as striping and appropriate signage will be installed on all four quadrants to delineate lanes and instruct drivers. Additional improvements to include crosswalks, curb ramps, landscaping, and other appurtenances will also be installed. The design and construction of the project will be funded through a grant received from the Colorado Department of Transportation; therefore, all design and requirements will adhere to FHWA oversight. The City of Pueblo desires to complete the Eagleridge Boulevard Cul-de-Sac design and construction plans as a separate bid set to satisfy the agreement with Quick Quack Car Wash Scope: The Basic Services provided by SEH as set forth herein is provided subject to the attached Agreement for Professional Services. Unless task is explicitly included in scope of work, task is explicitly excluded. Our services will consist of: Proiect Management 1. Specific Exclusions/Assumptions ■ It is assumed that sufficient topographic information is available to sufficiently detail and design the extended limits of Eagleridge Boulevard. If additional survey is required, SEH will notify the City of the additional need and the anticipated additional effort required. ■ City of Pueblo will provide, or give access to, the SEH all existing planning documents, reports, and construction plans for Quick Quack Car Wash. ■ Client will provide, or give access to, the SEH all previously approved agreements between the City and/or Colorado Department of Transportation and Quick Quack Car Wash. ■ Street lighting design, beyond typical and standard regulatory spacing requirements, is not included. ■ Right-of-way plans for property acquisitions are not included. Design and construction plans will be limited to Eagleridge Boulevard right-of-way and ties to Quick Quack Car Wash site improvements at right-of-way line. ■ No utility design is included in this scope and fee. ■ No drainage reports or stormwater design is included in this scope and fee. ■ Additional meetings, as requested by City of Pueblo, or required by CDOT, shall be conducted on a time and materials basis, based on the Rate Schedule Method. ■ This fee proposal assumes that there will be no more than one (1) review/response cycle, per phase, with City of Pueblo on the information provided. ■ The fee assumes that the study area and scope of work provided by SEH at the time of the proposal will not change. Any modifications to the scope that affect the study area, project limits or scope shall be considered additional services and negotiated by City of Pueblo and SEH prior to any additional work commencing.
