ORDINANCE NO. 11208
AN ORDINANCE AWARDING AND APPROVING AN
AGREEMENT BETWEEN THE CITY OF PUEBLO, A
COLORADO MUNICIPAL CORPORATION, AND SAFESIDE
FOUNDATION, A COLORADO NON-PROFIT CORPORATION,
FOR COMMUNITY SERVICES IN THE AMOUNT OF
$210,000.00, FROM PROJECT ACCOUNT HOARP40, HOME -
ARP CITY PROJECTS
WHEREAS, a Shelter Operations and Facility Use Agreement was approved by City
Council on June 9, 2025; and
WHEREAS, on March 27, 2023, City Council approved Ordinance #10419, accepting
the HOME -ARP allocation in the amount of $3,090,925 and
WHEREAS, additional funding is necessary to continue to fund Pueblo Shelter
Operations through 2026; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Community Services Agreement, a copy of which is attached and incorporated
herein, having been approved as to form by the City Attorney, is hereby approved.
SFCTION 2_
The Mayor is hereby authorized to execute said Amendment for and on behalf of the
City and the City Clerk is authorized to affix the seal of the City thereto and attest same.
SECTION 3.
The Mayor is hereby authorized to execute an Operating Agreement for and on behalf of
the City and the City Clerk is authorized to affix the seal of the City thereto and attest same.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent
with this Ordinance to implement the policies and procedures described herein.
SECTION 5.
If any section, paragraph, clause, or provision of this Ordinance shall for any reason be
held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph,
clause, or provision shall not affect any of the remaining provisions of this Ordinance.

SECTION 6.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
This ordinance awards and approves an agreement to SafeSide Foundation to continue
operations at the Pueblo Shelter through December 31, 2026.
PREVIOUS COUNCIL ACTION:
On March 27, 2023, City Council approved Ordinance #10419, accepting the HOME -
ARP allocation in the amount of $3,090,925 and incorporating the HOME -ARP
Allocation Plan.
On April 13, 2026, City Council approved Ordinance #11152, approving $145,000
transferred from C12113, ARPA Interest, and $100,000 budgeted and appropriated from
the unappropriated fund balance, to account 10180200-58156 — Shelter Operations.
BACKGROUND:
On March 16, 2026, Mayor Graham presented a proposal during the City Council work
session to fund the Pueblo Shelter through the remainder of the 2026 calendar year.
Without additional support, the shelter's current funding will be exhausted at the end of
May 2026, leaving a critical gap in operations for the rest of the year.
To fund shelter operations through 2026, the following was proposed:
$145,000 C12113, ARPA Interest
$100,000 budgeted and appropriated from the unappropriated fund balance.
$210,000 HOARP40, HOME -American Rescue Plan Act
This additional funding will not only sustain ongoing shelter services through December
31, 2026, but also support the implementation and management of planned capital

improvements at the site, which are expected to come online later in 2026.
FINANCIAL IMPLICATIONS:
Funds in the amount of $210,000 from HOARP40, HOME -ARP will be encumbered.

ALTERNATIVES:
Council could deny this action and it would result in a lack of funding for shelter
operations.
RECOMMENDATION:
Approval of the Ordinance.
