ORDINANCE NO. 11207
AN ORDINANCE APPROVING A SECOND AMENDMENT TO
LEASE IMPROVED PROPERTY FOR THE USE OF LAND AT
THE PUEBLO MEMORIAL AIRPORT BETWEEN THE CITY OF
PUEBLO, A COLORADO HOME RULE MUNICIPAL
CORPORATION, AND THE STATE OF COLORADO
DEPARTMENT OF PUBLIC SAFETY, DIVISION OF FIRE
PREVENTION AND CONTROL, AND AUTHORIZING THE
MAYOR TO EXECUTE THE SAME
WHEREAS, the City of Pueblo is the owner and operator of the Pueblo Memorial Airport
together with the land on which said Airport is situated; and
WHEREAS, the State of Colorado Department of Public Safety, Division of Fire
Prevention and Control, is desirous of leasing one thousand eight hundred (1800) square feet of
land for a fire -retardant containment tank and infrastructure; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Second Amendment to Lease Improved Real Property ("Lease"), by and between
the City of Pueblo, a Municipal Corporation, and the State of Colorado Department of Public
Safety, Division of Fire Prevention and Control, a copy of which is attached hereto and made a
part hereof by reference, after having been approved as to form by the City Attorney, is hereby
approved.

The Mayor is hereby authorized to execute the Lease in the name and on behalf of the
City of Pueblo, where the Mayor may execute the Lease by electronic signature and such
electronic signature shall be attributable to the Mayor and the City of Pueblo.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Ordinance and the attached Lease to effectuate the terms and conditions
described therein.

SUBJECT: AN ORDINANCE APPROVING A SECOND AMENDMENT TO LEASE
IMPROVED PROPERTY FOR THE USE OF LAND AT THE PUEBLO
MEMORIAL AIRPORT BETWEEN THE CITY OF PUEBLO, A
COLORADO HOME RULE MUNICIPAL CORPORATION, AND THE
STATE OF COLORADO DEPARTMENT OF PUBLIC SAFETY,
DIVISION OF FIRE PREVENTION AND CONTROL, AND
AUTHORIZING THE MAYOR TO EXECUTE THE SAME.
SUMMARY:
The State of Colorado Department of Public Safety, Division of Fire Prevention and
Control, ("State") is desirous of extending their lease and adding an additional one
thousand eight hundred (1,800) square feet of land for the use of a pumping station to
prevent storm water contamination from potential illicit discharge of fire retardant.
PREVIOUS COUNCIL ACTION:
City Council approved the Lease Agreement through Ordinance 10243 on August 8,
2022, and the First Amendment to Lease on October 23, 2023, through Ordinance
10578.
BACKGROUND:
The State has been leasing office space and the Base at the Pueblo Memorial Airport
since 2022. On September 13, 2023, an illicit discharge of fire retardant that reached
the City of Pueblo Stormwater system prompted a notice of violation and corrective
action by the State. As a result, the State installed a pumping system into the drainage
catch basin to pump any discharge of fire retardant into a containment tank to prevent it
from entering the stormwater system. The State provided the infrastructure and the
pumping mechanisms, and the City provided approximately one thousand eight
hundred (1800) square feet for installation and additional room for spatial barrier.

If City Council does not approve this Ordinance, the additional space will not be added
to the leasehold.

The Department of Aviation recommends approval of this Ordinance.
