Home My WebLink About11187ORDINANCE NO. 11187 AN ORDINANCE APPROVING AND ADOPTING THE CITY OF PUEBLO'S 2026 ACTION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AND THE HOME INVESTMENT PARTNERSHIP ACT GRANT (HOME), AUTHORIZING THE MAYOR OF THE CITY OF PUEBLO TO SUBMIT THE APPLICATION TOGETHER WITH ALL REQUIRED AND NECESSARY CERTIFICATIONS, ASSURANCES, AND DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND APPROPRIATING AND BUDGETING CDBG AND HOME FUNDS THEREFORE AND AUTHORIZING THE MAYOR TO EXECUTE SUBRECIPIENT AGREEMENTS FOR COMMUNITY DEVELOPMENT SERVICES WHEREAS, the City of Pueblo is designated as an entitlement city under the Housing and Community Development Act of 1974, and will receive Community Development Block Grant (CDBG) and HOME Investment Partnership Act Grants (HOME) for fiscal year 2026; and WHEREAS, the City of Pueblo conducted a citizen participation process that included two public hearings within the City of Pueblo in addition to a third public hearing before City Council to obtain the views of citizens, non- community needs; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. listing projects and programs for funding from CDBG and HOME federal funds has been developed to give maximum feasible priority to activities which will benefit low- to moderate- income families and/or aid in the prevention or elimination of slum and blight, as required by HUD, and is hereby approved, adopted, and incorporated herein. SECTION 2. The Mayor is hereby authorized to submit, in the name of the City of Pueblo, the applications (SF-424/SF-424D) and the 2026 Action Plan, together with all required and necessary certifications, assurances, and documentation to the U.S. Department of Housing and Urban Development for $1,433,918.00 in 2026 CDBG funds and $ 773,865.49 in 2026 HOME funds. SECTION 3. CDBG funds in the amount of $1,433,918.00 and HOME funds in the amount of $ 773,865.49, the 2026 allocation, are hereby budgeted and appropriated for the projects and in the amounts set forth in the 2026 Action Plan. A list of the recommended projects is herein included as Attachment A, which will become finalized after council action. SECTION 4. for the 2026 year is $174,119.74. During the 2026 budget process, $200,000.00 was budgeted and appropriated for the HOME match. SECTION 5. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 6. If any section, paragraph, clause, or provision of this Ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause, or provision shall not affect any of the remaining provisions of this Ordinance. SECTION 7. This Ordinance shall become effective on the date of final action by the Mayor and City Council. SECTION 8. The Mayor is authorized to execute Community Development Services Agreements for the following organizations as outlined in the attached 2026 Annual Action Plan. The Action Plan contains Advisory Committee (CAC) and Staff. On April 10, 2026, the City of Pueblo was notified by Housing and Urban Development (HUD) of the 2026 award amounts: CDBG - $1,433,918 HOME - $773,965.49 PREVIOUS COUNCIL ACTION: Ordinance #10985 was passed on July 14, 2025, approving and adopting the City of -year (2025-2029) Consolidated Plan for the Community Development Block Grant and the HOME Investment Partnership Act Grant, which serves as the guiding document for this Action Plan. BACKGROUND: As an entitlement city, the City of Pueblo is required by the U.S. Department of Housing and Urban Development (HUD) to complete an Annual Action Plan for each of the years of the Consolidated Plan. This Action Plan and the accompanying documentation Grant (CDBG) and HOME Investment Partnership Act Grant (HOME). This is the second Action Plan under the 2025-2029 Five-Year Consolidated Plan. A public meeting was held to receive citizen input and to hear applicant presentations on July 15, 2025. The notice of the availability of the 2026 Annual Action Plan was published on April 19, 2026 and made available to the public for review on the same day, formally opening the public comment period for thirty days. This ordinance will also authorize the Mayor to execute Community Development Services Agreements for the following organizations as outlined in the attached 2026 Annual Action Plan Draft Attachment A. Public Services CD2602 Supportive Services Posada $ 95,195.00 CD2603 Housing Stabilization Catholic Charities $ 25,000.00 CD2604 Charity Works Catholic Charities $ 35,000.00 CD2605 Senior Transportation SRDA $ 59,892.00 FINANCIAL IMPLICATIONS: The City anticipates receiving $1,433,918.00 in CDBG funding and $ 773,865.49 in HOME Consortium grant funding. The HOME Consortium grant is shared with Pueblo County on an 87%/13% City/County basis. The HOME grant requires a 25% match. 2026 annual budget, approved on November 16, 2025. This ordinance budgets and appropriates based on the attached 2026 Annual Action Plan Draft Attachment A. BOARD/COMMISSION RECOMMENDATION: The Citizens Advisory Committee (CAC) has recommended that the City Council approve the activities outlined in the 2026 Action Plan, which were presented Council during Work Session on May 4, 2026. STAKEHOLDER PROCESS: The following stakeholder processes were undertaken by the Department. Starting May 1, 2025 through May 31, 2025, applications for grant funding were made available to the community. Public hearings were held in Council Chambers following the Citizen Advisory Committee applicant presentations on July 15, 2025. The public hearings were open for public comments, and for funding applicants to present their requests to the CAC. No public comments were received. The 30-day comment period began April 19, 2026, with the publication of a public notice in The Pueblo Chieftain and online at www.pueblo.us/95. ALTERNATIVES: The City Council can choose not to apply for the CDBG and HOME grants, in which case a number of community services and community projects will need to find alternative funding. RECOMMENDATION: Approval of the Ordinance. Note: If council action is delayed after June 2026, it will put the City of Pueblo in jeopardy of not receiving this funding. The final date for HUD to accept the Annual Action Plan is July 17, 2026, and it is advisable to give HUD a minimum of two weeks to review, making the submittal goal of no later than July 3, 2026.
