AN ORDINANCE AMENDING SECTION 607 OF CHAPTER 1 OF
TITLE XI OF THE PUEBLO MUNICIPAL CODE RELATING TO
NOISE AND CLARIFYING AND RECOGNIZING CONSISTENT
WITH STATE STATUTE ITS NONAPPLICATION TO THE
STATE, POLITICAL SUBDIVISIONS OF THE STATE AND
NONPROFITS
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Subsection (d) of Section 607 of Chapter 1, Title XI of the Pueblo Municipal Code is
hereby amended by the addition of a new paragraph (10) thereto to read as follows:
(10) This Section is not applicable to the use of property by the State, any
political subdivision of the State, or any other entity not organized for profit,
including, but not limited to, nonprofit corporations, or any of their lessees,
licensees, or permittees, for the purpose of promoting, producing, or holding
cultural, entertainment, athletic, or patriotic events, including, but not limited to,
concerts, music festivals, and fireworks displays. This subsection (10) shall not
be construed to preempt or limit the authority of the City to otherwise regulate
noise abatement.
SECTION 2.
The officers and staff of the City are authorized and directed to perform any and all acts
consistent with the intent of this Ordinance to effectuate the policies and procedures described
herein.
SECTION 3.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
Section 11-1-
statute its nonapplication to the State, political subdivision of the State and nonprofits
when holding cultural, entertainment, athletic, or patriotic events, including, but not
limited to, concerts, music festivals, and fireworks displays.
PREVIOUS COUNCIL ACTION:
BACKGROUND:
-12-101 to -110, C.R.S.
establishes statewide standards for noise level limits based on zoning and time of day.
The State NAA allows local governments to adopt standards that are no less restrictive
State NAA has been amended to exclude and does not apply to cultural, entertainment,
athletic, or patriotic events, including, but not limited to, concerts, music festivals, and
fireworks displays, when conducted by the government or a non-profit organization. §
25-12-103(11), C.R.S. (2024). The proposed ordinance expressly adopts the same
exclusion.
FINANCIAL IMPLICATIONS:
None anticipated.

Not applicable.

Not applicable.
ALTERNATIVES:
Not adopt the Ordinance in which case it would remain unclear as to application to
concerts, music festivals, and fireworks displays, when conducted by the government or
a non-profit organization.
RECOMMENDATION:
Approve the Ordinance.
