AN ORDINANCE APPROVING A 2ND AMENDMENT TO AN
INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY
OF PUEBLO ("CITY"), A COLORADO MUNICIPAL
CORPORATION, AND THE FEDERAL HIGHWAY
ADMINISTRATION ("FHWA"), FROM THE RAISE GRANT
PROGRAM, AWARD NUMBER 693JJ32440495, RELATING TO
THE WEST SIDE CONNECTOR PROJECT, AND AUTHORIZING
THE MAYOR TO EXECUTE SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that
SFCTION 1
The 2nd Amendment to the Intergovernmental Agreement ("IGA") between the City of
Pueblo ("City"), a Colorado Municipal Corporation, and the Federal Highway Administration
("FHWA"), Award Number: 693JJ32440495, West Side Connector Project, a copy of which is
attached, having been approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is authorized to execute and deliver the IGA 2nd Amendment in the name of
the City and the City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 3.
The officers of the City are authorized to perform any and all acts consistent with this
Ordinance and IGA to implement the policies and procedures described herein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
This Ordinance approves a 2nd Amendment of an Intergovernmental Agreement
("IGA") between Pueblo, a Colorado Municipal Corporation ("City") and the Federal
Highway Administration ("FHWA") relating to the RAISE grant for the West Side
Connector Project.
PREVIOUS COUNCIL ACTION:
Ordinance 10787 dated September 9, 2024, established Project DT2401, which
approved an IGA between the City and FHWA, budgeted and appropriated funds in the
amount of $16,834,725.00 for the West Side Connector Project.
Resolution 15880 approved on January 27, 2025, awarded a contract to Pinyon
Environmental, Inc. for Project No. 24-136 Provide NEPA for West Side Improvements.
Resolution 15901, dated February 10, 2025, awarded an Agreement for Professional
Engineering Services to Bolton & Menk Inc to render design services for the West Side
Improvements.
Ordinance 11064, approved on October 27, 2025, approved the 1st Amendment to the
IGA between the City and FHWA, regarding the Raise Grant program for the West Side
Connector Project.
Resolution 16913, dated December 8, 2025, awarded an agreement for professional

services in the amount of $3,396,234.31 to Bolton & Menk, Inc for Project No. 25-002
Planning Consultant for 24th Street Bridge and Downtown Corridor.
Resolution 16266, dated March 9, 2026, established a new Project Account HU2603,
transferred funds in the amount of $37,621.43 from HUAN01 to HU2603, approved
Amendment 2 to the agreement for professional services between the City and Pinyon
Environmental, Inc.
BACKGROUND:
The City was awarded a RAISE Grant which funds several project components that will
improve transportation connectivity between the west side of the City and downtown. In
the first component, Sun Mountain Boulevard (formerly Spaulding Ave) will be extended
from 24th Street to 31st Street. The second component will rehabilitate seventy (70)
west side bus stops to comply with ADA standards. The third component consists of
planning and design for a 24th Street bridge and traffic corridor to connect the west side
area to downtown.
This Ordinance approves the 2nd Amendment to the Intergovernmental Agreement,
originally effective on September 11, 2024, between the City and FHWA. This
Amendment modifies the scope of the project, by changing the intersections on Sun
Mountain Boulevard to stop -sign controlled intersections instead of roundabouts and to
change the number of bus stops to approximately 70. After a full warrant study was
completed by Bolton & Menk, it was determined that roundabouts were not warranted
on Sun Mountain Boulevard. In addition, the Amendment obligates funding in the
amount of $11,834,725.00 for Option Phase 1: Construction of West Side Bus Stop
Rehabilitation and Sun Mountain Boulevard Extension.
FINANCIAL IMPLICATIONS:
This amendment obligates the rest of the funding awarded by the Raise West Dide
Connector Grant, in the amount of $11,834,725.00
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
None.
ALTERNATIVES:
Currently, there are no alternatives to completing the project without the construction
funds.
RECOMMENDATION:
Approve the Ordinance.
