ORDINANCE NO. 11177
AN ORDINANCE AMENDING SECTION 15-1-6 OF THE
PUEBLO MUNICIPAL CODE RELATING TO MOTORIZED
VEHICLES UPON BIKEPATHS
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Section 15-1-6 — "Motorized vehicles in certain areas" of the Pueblo Municipal Code is
hereby amended to read as follows:
Sec. 15-1-6. - Motorized vehicles in certain areas.
(b) Except as otherwise provided in Subsection (c) of this Section, it shall be unlawful
for any motorized vehicle to be driven or operated in any City -owned park or recreation area or
upon any area designated or posted as part of river trail or bike path system within the City
unless the operator has first obtained a permit for operation from the Director of Parks and
Recreation.
(f) It shall be unlawful for any Class 3 electrical assisted bicycle, as defined by the
November 2024 Revision 1.0 Model Traffic Code incorporated by City Code Section 15-1-1, to
be driven or operated in any City -owned park or recreation area or upon any area designated or
posted as part of river trail or bike path system within the City unless the operator has first
obtained a permit for operation from the Director of Parks and Recreation.
SFCTION 2_
The officers and staff of the City are authorized to perform any and all acts consistent
with this Ordinance and to implement the policies and procedures described therein.
SECTION 3.
This Ordinance shall become effective immediately after final action by the Mayor.

Attached for consideration is an ordinance amending Pueblo Municipal Code Section
15-1-6 — "Motorized vehicles in certain areas" to resolve an ambiguity referencing "the
Director."
PREVIOUS COUNCIL ACTION:
On August 24, 2022 City Council passed Ordinance 10257, updating Section 11-1-10 to
set forth permissible and impermissible vehicle use upon City recreation paths,
including specifications for a -bike usage. On December 11, 2025, City Council passed
Ordinance 11086 adopting the 2024 Revision of the Model Traffic Code.
BACKGROUND:
Section 15-1-6(b) provides that "it shall be unlawful for any motorized vehicle to be
driven or operated in any City -owned park or recreation area or upon any area
designated or posted as part of river trail or bike path system within the City unless the
operator has first obtained a permit for operation from the Director." This Ordinance
would clarify that "Director" refers to the "Director of Parks and Recreation."
Section 15-1-6(f) provides that "it shall be unlawful for any Class 3 electrical assisted

ALTERNATIVES:
City Council may request that staff draft an alternate amendment to this Section which
would grant permit -issuing authority to a Director other than the Director of Parks and
Recreation.
RECOMMENDATION:
Staff recommends that a Director be designated in this section to resolve the ambiguity.
