HomeMy WebLinkAbout11172Docusign Envelope ID: E5CEC67B-7AE4-8371-8106-EFB298C8C498 City Clerk's Office Item # R3 COUNCIL MEETING DATE: May 11, 2026 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Clyde Bishop, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: AN ORDINANCE ACCEPTING A QUITCLAIM DEED FROM PADULA FAMILY PARTNERSHIP, LLLP, FOR RIGHT OF WAY AND DRAINAGE CROSSING AND APPROVING A QUITCLAIM DEED CONVEYING RESIDUAL AND SURPLUS LAND TO PADULA FAMILY PARTNERSHIP, LLLP SUMMARY: The Proposed Ordinance approves the transfer of lands necessary for the expansion of a portion of Jerry Murphy Blvd/Overton Road right of way for the construction of such right of way as a four -lane principal arterial roadway. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Padula Family Partnership, LLLP, a Colorado Limited Liability Limited Partnership ("PFP"), owns certain real property which is adjacent to Jerry Murphy Blvd/Overton Road right of way and necessary for the construction of such right of way as a four -lane principal arterial roadway and continued/expanded use as a drainage crossing comprising approximately 1.5 acres ("Donated Property"). The City owns certain real property located within PFP's property which will become surplus to City's needs as a drainage crossing upon transfer and acceptance of the Donated Property ("Surplus Property"). This Ordinance approves the acceptance of the Donated Property and authorizes the transfer of the Surplus Property. FINANCIAL IMPLICATIONS None. ALTERNATIVES: Not approve the Ordinance, but the effect would be that the City will not have the land necessary for the construction of the four -lane principal arterial roadway. The Quitclaim deed to be granted by Padula Family Partnership, LLLP a Colorado Limited Liability Limited Partnership ("PFP") to the City, having been approved as to form by the City Attorney, is hereby approved for acceptance. SFCTION 2_ The Quitclaim deed to be granted by the City to PFP having been approved as to form by the City Attorney, is approved, and the Mayor is authorized to execute and deliver same in the name of the City. SECTION 3. The City Clerk is directed to sequentially record said executed deeds in the office of the Pueblo County Clerk and Recorder with recording to be made in the following order: Quitclaim deed by City to PFP recorded first and Quitclaim deed by PFP to City recorded second. SECTION 4. The officers of the City are authorized and directed to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
